A Broward County judge had a change of heart after sentencing a 23-year-old man to 60 years in prison for violating his probation by driving with a suspended license.
The fact that a 60 year sentence can be instantly suspended by a single judge’s emotional change of heart, shows there is something grossly wrong with American law.

He was on probation. that is given in lieu of prison or jail time, and you are supposed to show that you can not be a criminal POS during that time period. If you can't even stay away from committing crimes during probation, then you deserve the extra time. Remember his violation here wasn't just that he was driving on a suspended license. He had bullets on him too, which is illegal if you are a felon to begin with. And come on? strong arm robbery? That is just a step away from murder. What are the chances this guy won't violate probation once again?
This is not a judge showing mercy. It is a judge showing a total lack of impulse control. It is scary to think about the fact that somebody with this much power could give you life behind bars just because he woke up at the wrong side of the bed that morning.

Killers, anyway. Manslaughter isn't murder. In college, I knew a biker who had been sentenced to five years and was out in three for accidentally killing a guy in a bar fight. He cried when he told me about it. His sentence was probably long enough. But, Murder One and Murder Two are intentional and draw long sentences.
If anyone wants an update, he died on June 20th 2020 after being gunned down. Some people just cannot escape the life, he was better off in Jail for his sake.
Happy& Heavenly a man raped a school girl aged 13, near my local park he hid in bushes with bush suit on and ambushed her, he got 10 years... 10 years that’s all for ruining a poor innocent girl with a mans disgusting tendency. Seriously!!! A business owner in my town molested a young girl and only got 3 years because the judge said he is a nice guy and a hard worker. Another guy in my county got 7 years for marijuana possession. The justice system might be a little slanted towards pedophiles.
I used to work as a court usher in the UK and we'd always know how each day's hearings would go depending on A.) which judges were in court and B.) what mood they were in. Neither should affect the sentences handed out, but they certainly did. Obviously this is a very extreme case, but it shows just how much power they have and how their mood/impulse can change people's lives so dramatically!
I can’t believe that judges don’t have some type of board or internal affairs dept to review cases like this that are inhumane. This is wrong for one person to have this much power over people’s lives without being held accountable for possible biases. It saddens me.

Yup.. in criminal justice I have seen sentences as low as 3 years like someone else said. Some have even completely gotten out of any sentencing what so ever. Absolutely sick

Would you rather a killer/rapist who tortured someone/multiple people be convincted with dying quickly? Or them being in prison being tortured for most or all their life?

The probation was driving without a license. If he harmed someone driving, then that may be a different story. But even so, people who have killed someone driving without a probation, don't get even close to 60 years. This sentence is ridiculous lol.

Probation can be suspended or shortened. So yeah it is long, but if the guy does better himself, I see no reason why they wouldn't take him off probation after a few years. One thing is for sure, probation is better than 60 years in prison.
The judge saw right through him. The judge is a judge for a reason. Oh he also committed more crimes after he was released and now he’s 6ft under. So I feel a lot better about this story. God truly works in mysterious ways 😊
It's called having compassion and showing grace. A Judge can do that. I'm sure if you were facing 60 years, and a Judge showed you mercy, you wouldn't reject that.

For real, though. Could you imagine if dude's wife left him the day before? Or if he's had just a general rough couple of days? That's going to affect his decision, even on a subconscious level. I don't want to undermine the training of a judge, but geez, we're all human.
He still has the 60 hanging over his head & if he violates his probation at any time during the 50 yrs of it , he will be shipped off to do the previously suspended 60.
This is fine and typical treatment for lifetime criminals, eventually you will get the "lock them up and throw away the key" thing if they don't stop, obviously he reached that point. The problem is that our prisons aren’t set up to rehab criminals it makes them worse. If you get out of prison and you can’t get a job because of your criminal record then there is a high chance you are going to commit another crime and end up back jail.
If you have a container full of cockroaches they all look the same, that’s how they look at us, myself included, they don’t have time to sit there and examine each defendant to see if he is sincere with with promise to change, if anything they have seen probably thousands of defendants who promised to change are right back in jail for another crime, so yes the system is broken but it’s overwhelming the amount of crime and people they see on a daily basis to be effective

Sadly, Herbert Smith died in 2020, shot by a rival gang member outside of a night club... He had broken his parole a few months after getting his second chance, and got caught after breaking into a house with a gun. He did 14 months for that, and then got killed shortly after getting out

The punishment should fit the crime. 60 years for breaking probation is ridiculous. Even though he suspended it, being on probation for 50 years is also incredibly excessive. You lose so many of your rights while on probation & you’re at the mercy of the system during that time. The judge should have just done the normal sentencing & had him in jail for 10 years or so at most then probation after that for 5 or so years. The sentence shouldn’t cover his entire life unless he committed something like murder or rape.

@@jmsmilin The death penalty should be illegal for obvious reasons if you've ever done any amount of intellectual studying on politics and the death penalty. Many innocent people are executed under the death penalty. To support the death penalty you also have to accept it as okay when someone innocent from your own family gets executed, even if it's your own son or daughter. If you can't accept that then it's massively hypocritical to support a system as horribly flawed, corrupt, and an even a more expensive alternative to life in prison. And yes, the death penalty costs more than life in prison. If anyone doesn't know why do some research into A) The U.S. Constitution and B) The Law.

2 Dallas cops was pulling females over for traffic stops and hand cuffed them and raped them in the back of there cop cars . They had been fired and given probation .

i know someone who got 7 years, and 99 years probation for kidnapping, and impersonating a officer. he is a narcisitic sociopath, and the courts can see that. when he gets out, he will back to his usual crimes and hopefully be caught again and put away for good.

The most insane part is 15 years probation. I'm willing to bet that probation compliance list is as long as a CVS receipt. He's going to get sent back to prison for some minor violation that would otherwise warrant a fine or a few nights in jail.

I know a guy murdered someone by shooting them in head then dumped their body in a lake and they only gave him 20 years. I've even heard of people getting 10 years for murder (reduced to manslaughter) for guilty pleas but they gave this dude 60 for a probation violation??
If a judge can add or wave away 60 years just like that, there's something wrong with the system. Sentences should be by the book, not give so much power to the whims of one man.
It's a double edged sword. Doing things strictly "by the book" is going to negate a good judge's ability to show mercy and address the gray areas of right and wrong. Allowing judges to have this kind of power over sentences will allow them to show mercy just as much as it will allow them to be unjustly harsh.
See normally they should be capable of emotionally disconnecting themselves from their job. This is an exception, which is why its getting so much attention.

He’s out. A suspended sentence means just that. That’s it was suspended. He probably walked free a few hours later. However that 60 years will hang over his head for the rest of his life. Because any violation and he will have to serve the sentence in custody rather than in the community.

@@yamap1 Unfortunately our system doesn't rehabilitate. People are responsible for their own actions but if re-offending is the norm that's a signal that our system isn't doing its part to help those who have made mistakes.

That is certainly a long sentence, but the perp didn't comply with his probation conditions and was caught with stolen goods and ammo...seems he has not learned his lesson in the least. He was given one more chance. Let's hope for his sake he doesn't blow it...again.
