As lawsuits in multiple states seeking to disqualify Trump from the ballot in 2024 pick up steam, Judge J. Michael Luttig joins Ali Velshi to discuss the debate surrounding the 14th Amendment's disqualification clause, the argument being made by Trump’s lawyers in response to the cases, and why lawyers and the public have misunderstood the wording of Section 3. “Frankly, all parties to this different litigation in the various states, to this point, have misunderstood Section 3 of the 14th Amendment. As I said, it disqualifies one who has engaged in insurrection or rebellion against the Constitution of the United States. It does not, by its term, disqualify one who has engaged in insurrection or rebellion against the United States or the authority of the United States… and there is a world of constitutional difference between those two.”

Just read the 14th Amendment. It is very simple where it states that giving "comfort" is sufficient grounds for disqualifying Trump. Trump gave comfort by saying he will pardon those in jail for the Jan 6th event. Very simple, plain, and clear, so just disqualify Trump now.

My wife has recently obtained her American citizenship. In the application form, there was a question about participating in the overthrow of the US government. If she had answered yes to the question, her application for citizenship would have been denied without having been convicted of the crime.

This was very helpful. I had not thought of the distinction between rebellion against the United States and rebellion against the Constitution. When you think of it in those terms, it's more clear that Article III applies. Someone still needs to define what it means for it to be self executing. Someone still needs to decide to enforce it.

All self-executing means is that an action of Insurrection or Rebellion against the Constitution triggers the 14th Amendment Section 3 to automaticqlly disqualify any elected Official that participates in or gives aid or comfort to someone who engaged in said Insurrection or Rebellion. There shouldn't need to be any debate as to the disqualification being as it's self-executing, but of course Trump will fight anything to try to get back in power & destroy our Constitution & our Freedoms along with it!

Self executing means it doesn't need executive branch interference, literally anyone can bring those charges. It was specifically so any community member could make an affidavit submit it to any authority and it holds the same weight as the attorney general.

He is correct to point out that the text disqualifies officials who have 'engaged in insurrection or rebellion' against THE CONSTITUTION of the US. He should also point out that it also refers to officials who have GIVEN AID OR COMFORT to the enemies of the US constitution (for example, by issuing presidential pardons for persons who were convicted of secretly conferring with the Russian government?).

As a non-involved American watcher, it is glaringly obvious, not hampered by arcane legal niceties, but stated clearly by the level-headed words in the Constitution. Any person who has played any part in any insurrectionist activities will not be allowed to run for the presidency of the United States. Doing so would be madness. Totally agree, this could have been resolved earlier, the problem is the people with the authority not following through on their duties as elected officials, some of these judges are inserting their own personal beliefs instead following the Constitution and the law, same as those who serve in other official compacities, the only way this country can function at it's highest capacity, and form some sense of balance, is if those in charge follow the rules established beforehand, regardless of who the person is, the Constitution clearly speaks for itself, and is not a part of the problem, it is the incapability of humans who refuse to rise to the occasion that is.

Public declaration of your intent to provide pardons to those who were involved in the events in and around Jan06 would also be "providing aid and comfort..." In addition to those members of congress who have called them political prisoners or hostages, down-playing their behavior, labeling them as "Patriots," and propping them up, providing them with praise One could argue that all of these acts could be construed as providing aid & and comfort, thus disqualifying anyone who engaged in such actions.

Something to the effect of (to quote a famous witness for the J6 committee): “if you dare come after me, what’s the use of keeping the Constitution.” In other words, I’m king and I’ll do whatever I please if I’m president again. A bit like when he said “how about cleansing the lungs with disinfectant to knock out of the Covid virus”, which amounts to the same as “how about injecting bleach” which is often used humorously. @@n00bc0de7When these lawsuits based on the 14th Amendment, Article 3 go before the SCOTUS, which at least one of them inevitably will, Judge Michael Luttig, along with Neal Katyal, has agreed to help present it. It doesn't matter what Clarence Thomas wants, if at least 5 of the 9 Justices uphold it. Their decision doesn't have to be unanimous, only a simple majority agreement.

All this talk about upholding the Constitution, why is it that Article 1, section 2, clause 3, and section 9 , clause 4, continues to be ignored and has not been repealed, continues to tax the American people who have no liability for an income tax. The IRS uses the IRM as their tax guide which classifies tax coming in from the American people as a class 5 gift tax, which means the government knows that the American people are volunteering to give the tax money over to the IRS and authorize the withholding by signing their name under the declaration of, under the penalties of perjury. Furthermore, the IRS is limited in it's operations to the District of Columbia and not elsewhere per 4 USC 72.
