The plaintiff lived in the defendant’s apartment. She says she had to move out because she couldn’t afford rent, but now she can’t get her security deposit back, so she’s suing. The defendant argues the plaintiff caused extensive damage in the apartment, so he deducted money from the security deposit for the repairs. He’s countersuing for additional repairs.

You are forgetting the part where she was late several times and then couldn’t pay so he had to lower the rent. Add on to that she destroyed his doors and I don’t think she is as great as you think she is…

He offered to reduce the rent to keep her as a tenant and then 2 years later claims it was a loan, what a sneaky piece of sh1t. And if he was so angry about the doors how come she was able to take photos just a few days before coming to court, meaning he hasn't changed the doors, so apparently his new tenant, isn't objecting, so the money to repair the doors will go straight in his pocket...

what does the new tenant has to do with her needing to fix his door!He reserves the right to fix the door whenever he wants but the fact still remains that she damaged his door and should pay to rectify the damages. Most people have a bias based on who is the perceived victim. Had this been a dude, I bet you wouldnt have that same feeling but women get the sympathy because they are women. She broke the door without permission and thats it. There is nothing else to argue other than she broke the door. I know for a fact that most rental units will paint every two to three years and if you move in and change the color of the paint to what you prefer and move without changing it back to its original color, they charge the tenant for the damage regardless if they were going to paint that unit because it was pre-scheduled to repaint .. In your view, if they were going to paint the apartment you painted due to maintenance scheduling, why should it matter if you changed it bacj to its original state or not, but, at that point, it doesnt matter what they intended to do.

When I rented apartments before marrying and after I was married. I got all my deposits back 100 % of it. I had good landlords. But I kept the places I lived as if they were what I owned. We have our own home ( now no rent and it's pd for. ) but we're seniors now. Rent has gone up so high. I don't see how people can afford it plus everything on top of that. I can remember my parents paying 35 $ amonth for a 2 bedroom. And looked for a 25 to 30 $ rent. LOL Old is blissful and blessed

There is a certain amount of what’s called “judicial discretion” that is available for judges to use in areas where the law is gray. Some judges go overboard with it, however.

The more cut and dry , the better . It makes you think rationally when emotions aren’t involved . They are not her family for her to be sympathetic to . They are just everyday litigants , coming to court , for her to solve their problems .

JM is 100% wrong on the late fees! Every other case where the landlord tried to claim old late fees that were never paid, she always said if you go that long without enforcing/collecting then it becomes void! Yet here she did the opposite of ALL of her other rulings! She should have been reprimanded by the bar for that! You can't rule differently than all your previous cases simply bc you're a landlord and sympathize with other landlords.

AS USUAL MILIAN DOES NOT KNOW THE LAW, IF A LATE FEE IS NOT COLLECTED THEN IT IS WAIVED. A REDUCED RENT IS CALLED A "PREFERENTIAL RENT" IN NYC LANDLORDS WOULD CHEAT TENANTS WITH A LOWER RENT TO GET PEOPLE TO TAKE AN APARTMENT THE 1ST YEAR. THEN RAISE THE RENT THE SECOND YEAR + THE FIRST YEARS RENT. IN 2019 THAT WAS OUTLAWED IN NYC. LATE FEES ARE WAIVED IF THEY ARE NOT COLLECTED.

They had a written contract. I thought a written contract couldn't be modified with a verbal contract, it needs to be modified with another written contract that did not exist. I think she shouldn't have received the rent back. She owed it.

I love the peoples court- i love judge M however i get confused bc ive watched so so many of these episodes and ive heard her say to the people “u need to have evidence a receipt- even if its just on paper- grab a piece if toilet paper and a crayon and write it out so that you have proof” but then i also see on multiple episodes where the plaintiff/defendant will have it written out in a note book or something to that extent- and then she will say “you know this is only your writing on a piece if paper- u dont have any legitimate receipts that can show me evidence/proof”……….so how can u say over n iver a crayon and tp will work just fine but then people will come with a notebook of receipts and its not good enough 😝 Still love the show and her and i will continue to watch it- i iust had to ask- am i the only one whose ever caught on to that? I hope not and i dont think i am-

I never truly get that - say you have an AC unit that's 10 year old, but working perfectly, but a tenant wrecks it. You might've had that AC working for another 5-10 years, but now due to someone elses negligence, have to get another unit now. The money given should be for a basic new unit, but what is the landlord supposed to do to not have any outlay of money? Search CL for an old worn AC unit? Obviously, if you had installed a new unit, you should be able to get the money to replace it proper.

"Kurt" the reporter at the end of the cases that does exit interviews looks like an ex mafia made-man soldier that would bash people's face in with a hammer to collect old debts. His real name is probably "Joey or Tommy". But hey, the People's court is a better gig, better hours. Just look at his reactions when people have stupid responses, he's wishing he had the hammer 😂.

Should have got the rent shortfall.. The original written agreement should stand until amended in the same formality ie in writing. So that means the default position is the original rent is payable. They havea dispute on the verbal agreement re whether it was a discount or deferral of part of the rent, so the TENANT should have proof in writing if she wants to argue the actual rent amount was changed, otherwise juts go with the last written record.

He can have the doors repaired for 300. You don't get a brand new item if someone damaged yours. For example if you totaled my car in an accident and instead of you paying the 1000 that the car is worth... I instead bought a 50000 new car and demanded you pay the 49,000 difference... Would you think that is fair.

Everyone's in here is obviously a tenant by everyon's comments. Before I became a landlord, I was a tenant for many years. To tenants it's always, the landlord is so mean and etc, and it's often not always the case. Some landlords do exactly what he did which is reduce the rent and the remaining amount they deduct it from the security deposit. I don't agree with this method. The security deposit should only be used for the apartment damages period. As a landlord, that's just too risky. The other thing about wanting to collect late fees when he never did was a sneaky move. There's something disingenuous about the landlord in this case. If you didn't ask for the late fees back then, you cannot collect it after the fact nany months after the tenant leaves. The plaintiff (tentant) is an idiot she signs a 2 year lease that she can't afford and then wants to break the lease because it no longer works for her budget. Well that's her personal problem, and the landlord shouldn't be making it his. I've been in this position twice and on both occasions I cut my losses. I rather the tenat moves out and find another tenant.

Guy isn’t running a soup kitchen. He reduced her rent , didn’t collect on late payments, let her out of the lease yet she claims he still owes her money back. So much for gratitude, but they both messed up when nothing was put in writing. She still received back more then she deserved.
