Govt can get round the latter point by migrants being given the opportunity to make their claim from within France when we return them, if we give them a claim form . I think the law just says we have to hear their claim if they make it to us. A lot of the boat people will not do that because they either know they don't have a valid claim (being economic migrants) or have already had an application refused and been deported before. I think there is also a disincentive to do so because if you make a claim, you and your fingerprints are in the system and at risk of a negative decision. Staying off grid might be an easier option if you get into the UK illegally. On the first point about passing through countries, its relevant to making a claim but it doesn't mean it's not relevant to considering the validity of the claim. I believe already claims are being turned down almost automatically because the people are making claims after coming from a safe country (France) unless there are peculiar circumstances. - which seems reasonable to me and has already passed legal scrutiny.

Generally the answer is they only speak English and or they have relatives here. If we were forced to flee the UK, I would think a large portion of the population would try to flee to Australia, despite there being safe countries en route.
