जय हिन्द एवं नमस्कार, क्या कोई दूकान मालिक, किराएदार पर निजी आवश्यकता एवं झूठा डिफाल्ट (डिफाल्ट का कोई ठोस प्रमाण नहीं था)का बेदखली (9) में दावा करने के बाद दौराने वाद ,उस दुकान को बिना सूचना (किराएदार व माननीय न्यायालय) दीए किसी अन्य को बेचान(रजिस्ट्री) कर सकता है?

जो किराया लेने या अपनी जरूरत पड़ने पर अपना घर खाली कराने की हिम्मत रखता है वो ही अपनी गाड़ी कमाई से खरीदा हुआ घर किराए पर दे वरना खाली रखे। कोर्ट कचहरी के चक्कर में कई मकान मालिक प्रभु को प्यारे हो चुके और किरायदार मालिक बने बैठे हैं। बाकी सब खुद समझदार हैं।

जिसमें निकालने की हिम्मत हो तो वह 15 20 साल बाद में निकाल सकता है नहीं तो दो-तीन साल में भी नहीं निकाल सकता सब ताकत का खेल है कोर्ट कचहरी में टाइम खराब करना है

The correct solution is Don't rent the property . Given under leave license act of the respective state . This will be out of rent control act . The provisions in the Leave License Act are helpful to land lords for eviction . Rent control act is totally in favour of tenant s .

IPC 406 and 403 criminal breach of trust should be applicable to immovable properties also. Reason: Based on the trust that the tenant will be paying the rent , land lord hands over his high value immovable property to the tenant for rent which is only a very small fraction of the property value . If the tenant does not pay the rent then it's clear breach of trust .

Don't know why the court is so lenient towards tenant .They will not pay rent for months,they will not vacate when asked to ,even refuse to renew agreement but still court will not take any action.

All court cases should be disolved within one years, this rule help from anxiety haresment, money, why cases took so much time to dissolved? This is inhumam? Some sort of injustice? And many more, victim understand this. So law maker body should think of this. Advocate fees also need to be fixed. Advocate charges so much, it's great problem also.

If tenant does not pay two continuously months then owner should evict tenant in less than 30 days. What a shame Supreme Court is still not able to fix this issue for once and all.

Way back in 1986 section 441 IPC was amended in Odisha and the tenant can be treated as a house trespasser if he does not vacate the house after one month of receiving the notice from the land lord. Section 448 IPC is a cognizable offence and FIR can be registered. 🙏

Basis for Notice to vacate should be ‘BREACH OF CONTRACT’ due to failure to pay rent and should/need not require any other reason.

There should be a clause in the agreement if the rent is not paid for 2 or 3 consecutive months ... depending on how much deposit has been paid ... then it automatically means that the landlord can give notice to tenant to vacate and deduct all dues from the deposit

Few days back I went to police station. 3 college boys came there to keep report against their landlord. Police personnel request them to give application in writing. The boys asked police official they can give hand written application. Police official replied you can get it from the typists and typist know what he has to write. How it is possible the typist know before the boys explained. It means whole story is pre decided. Aisa lagta hai ki yeh British time laws hai which are clearly leaning towards taking away any rights for the landlord and helping the tenants to become landlord. 75 years of independence but still we are lingering in such rules.

It is very difficult situation for owners, if tenants will not give rent, then how come owner will adjust every month. There should be some provision else people will take advantages for this kind of situations. I feel older laws need to change as per current time. I can understand few laws will remains as it is but other can be modified.

My dear gentlemen, It's common knowledge that in jurisprudence, there is no system of universal mutatis mutandis or automatic application of a court order or a judgement in another or even in a similar type of case. This order of Apex court cannot be construed to have foreclosed a landlords complaint whether through process of IPC sections or in terms of Rent control provisions. If that be the case all lakhs of existing cases will meet a sudden death in the courts and get devolved on Tribunals and consumer commissions. Let no one try to interpret a court judgement as to have attained finality forever, in a manner according to one's own understanding. Let's understand that each and every case is separate and carries it's trappings & uniqueness. One judgement in a case cannot become replicating feature in every case, nor it can stop a reasoned order of any other hon'ble court in variance to the quoted judgement.

One can also file a money suit to recover rent dues upto three years,this suit is less time consuming and can be decided as a summary proceedings based on admission of facts

भाई अगर घर और दुकान किराया ना दे तो उसे खाली करवाने के लिए क्या करें? अगर कोई किसी दुकान या घर में कई सालों से रह रहा है तो क्या वो उस पर अपना दावा भी कर सकता है कि वो कभी ना खाली करे और रेंट भी ना दे , क्युकी जब समय के साथ रेंट बढ़ाने की बात होती है तभी ये सब दिक्कतें आती हैं । क्या कोई ऐसा नियम है जो मकान या दुकान मालिक को समर्थन करता हो ! कोई वीडियो इस पर भी बनाइए । 🙏

First send a letter and mention about legal procedure. Give a reminder.. Approach Registrar of Housing societies.. With his help you can seal the defaulters flat. You are also empowered to disconnect water supply, sweeper services to the defaulters flat..

hum log 3 saal se ek makaan me kiraye se reh rahe hai. jo makaan maalik hai usne humko pehle se bataya bhi nhi aur upar k floor me construction ka kaam pichle 1 hafte se chalu Kara Diya hai jo kam se kam saalbhar chalega. Mein tution padata hu aur construction ki Roz awaaz k kaaran yha padana mushkil hogya hai. aur makaan malik kaam band nhi karra hai bolra hai khali karna ho toh kardo. achanak se dusra Ghar toh nhi mil sakta aur mera tution class ka roz ka disturbance hora hai toh makaan Malik k against kuch action le sakte hai kya ???

Why to go to SC just have one clause that if the rent remains unpaid fully or partially for whatever reason, for any part of the tenure of the rent agreement, then the tenant will have to evacuate the property within 10 days of the due date for payment of rent and in such case clause relating to 30 days notice will not apply. will sec 441 trespassing apply sir ?. I am LLB and a landlord hence this question.

कानुन किरायेदारकी सुरक्षा करता है और मकानमालीक बेचारा रोते रहता है.ईसलीये खाली करानेके लीये कभी कभी मकानमालीक हिंसा का सहारा लेता है.ईसलीये ईस बिमार न्यायव्यवस्थामे परिवर्तन जरूरी है.हम पैदल या बससे कोर्ट जातेथे और हमारा किरायेदार कारसे कोर्ट आता था.ऐसी परिस्थिती हो गयी थी.

100% सही बात कही है आपने,में मकान मालिक हूं 9, साल हो गए हैं अभी तक कोई रिज़ल्ट नहीं निकला है। 6, दुकानों पर केस चल रहा है जिसमे 2, दुकान पैसे देकर के खाली करवाई है बाकी की दुकान का केस चल रहा है। दुकान का किराया 400/रुपया महीना है। कोर्ट में कितनी बार किराया निकलवाने के लिए लिखित में मांगा गया है आज तक 1, रुपया नहीं मिला है। मे खुद डायबिटीज का मरीज़ हूं मेरा गुज़ारा इसी से चलता है हजारों रुपया महीना दवाइयों का खर्चा है कहां से लाएं।
