While I agree with your point, for him to "change his mind" on this would further diminish the authority of SCOTUS and set up a situation where they would all be out of a job on day one of a T* dictatorship. If they want to keep their Supreme jobs, they must keep the orange maniac out of the WH.

If the Democratic party was ever worried about Roe V. Wade's overturning, they would have ratified it as an actual Right. What they did for the last ump-teen years was campaign on the fear of it's protection being eliminated. The Right was never eliminated, because it was never established as a Right. The ethical and moral dilemma of allowing abortion was brought to the state level. What your state determines to do there-after is up to state lawmakers. Hopefully whoever you vote for actually has your interests at heart.

You are right about Kavanaugh, but it is worse. Lawerence is making a misread; there was a this or that. Trump was impeached for the crime, but was not convicted. Therefore, he cannot be subject to double jeopardy because he certainly did not leave office voluntarily; he was voted out. Ende. Nice try, Lawerence. QED

When someone says "it's settled law", it's a legal ambiguity. Settled law does not mean set in concrete. Laws change, settled law changes. Saying "it's settled law" merely means you accept it as law TODAY, but it does not bind you to adherence forever. You'll note they never say "I will (or will not) change X settled law. THAT would be possibly perjury should they then later go opposite to which they testified.

At the time of the original writing, Clinton was president; By putting this in front of SCOTUS now, they'll have to answer this question while Biden is president. Think they'll declare presidents to be above the law while a Dem holds office? I'd wager good money that the Traitor King's outrage over this is because he was _hoping_ to be back in office before this happened, as they'd be giving him power; Now their partisan demands will force them to keep that power away from Biden. I'm actually quite pleased with this, and watching all the MAGAts going nuts over it has been most delightful.

Clearly Kavanaugh is referencing a situation where the president is impeached and removed for that crime first by the senate or voluntarily resigns which neither happened; you seem to suggest that just because a judge believe something 25 years ago he couldnt possibly have experienced anything that can lead to a change of mind in certain situations, seems like a stretch for a journalist to get all 7:58 7:58 7:58 excited over these writings like a little kid who just saw Santa clause on Christmas Eve.

They said that it was "settled law" and they saw no reason to touch it until the most impoverished state of Mississippi caused it to be unsettled law again. This was the plan for 50 yrs.

Really? I don’t remember that. At least not that way. I recall that he said the only way to guarantee the right to abortion was to make it law. It never was. It was just a judicial decision that was a landmark case. Referred to a bunch but not a real law.

@@daviddrake5991 Those tapes were part of the prosecution in the Watergate case and the fact SCOTUS ruled the President of the United States does *not* have absolute immunity is relevant to this discussion. It's more evidence TFG does *not* have immunity for any actions he took during or after he leaves the office of the President. TFG is declaring he has absolute immunity from any sort of prosecution, civil or criminal for anything and everything he does, legal or illegal, during or after he left the office of the President of the United States.

The fact that Ford pardoned Nixon is exactly why there is no absolute presidential immunity. A pardon doesn't exonerate, it simply waives punishment.

My guess....SCOTUS will not touch this. It will do a quick review and decide not to hear it. Sending this case back down to the Appellate Court. The Appellate Court is already speeding up in anticipation of getting this case. Let's see what actually happens 🤞

Kavanaugh has already established (in writing) that he is MORE than willing to "change his mind upon considered reflection" if it is advantageous for him to do so. He already did this when he was against unitary powers for a President (during the Clinton administration, when he wrote the article cited) after which he promptly executed a perfect "Republican 180" when "Dubya" was the President. Do you think a conservative would change their mind so drastically if it was politically expediently to do so? I dunno, ask Mitch McConnell or Lindsay Graham.

It's not politically expedient for Kavanaugh, though. For one thing, he doesn't like Trump or need him for anything. For another thing, if Trump becomes a dictator, what use would he have for a Supreme Court? It doesn't benefit Kavanaugh to help Trump with this.

The latter definitely didn't happen and they'll argue the former that Trump didn't "voluntarily" leave, which to a degree is true and is apparent by the fact he tried to illegally remain in power. It's a stupid argument for sure but one they'll make and it may end up being a loophole that Kavanaugh may use to justify a vote that presidents are immune if he wants to help Trump.

When someone says "it's settled law", it's a legal ambiguity. Settled law does not mean set in concrete. Laws change, settled law changes. Saying "it's settled law" merely means you accept it as law TODAY, but it does not bind you to adherence forever. You'll note they never say "I will (or will not) change X settled law. THAT would be possibly perjury should they then later go opposite to which they testified.

Clearly Kavanaugh is referencing a situation where the president is impeached and removed for that crime first by the senate or voluntarily resigns which neither happened; you seem to suggest that just because a judge believe something 25 years ago he couldnt possibly have experienced anything that can lead to a change of mind in certain situations, seems like a stretch for a journalist to get all excited over these writings like a little kid who just saw Santa clause on Christmas Eve.

I can't believe that Lawrence is naïve enough to believe that Justice Brewski won't just say that doesn't apply to tfg - he also said Roe was settled precedent and then backtracked on that too.....
