Idk if its befause I think about if it was me what would I want to happen kind of thing, But I could never ever tell someone "hey I know you went through a traumatic moment probably the worst thing you've ever had to go through, but hey atleast he's in jail in another state. So don't worry about it" absolutely not. I'd want my day in court to face my abuser. As a survivor myself I never got that privilege I would never want it taken away from someone else.
My civics teacher in Chicago was so thrilled to be called for jury duty, it was her moment, and we were all happy for her. But she was crushed and so were we, her students, when she got bounced straight away for being 'too knowledgeable' about the workings of the law. To me, that was the biggest lesson I learned about the machinations of the USA. thnx.
It's well known that anyone with a PhD, for example, regardless of subject, will never serve on a jury. Anything considered expertise is rejected - God forbid anyone know how to think. But I've heard from YT lawyers that the reasoning is actually that you don't want someone on the jury who the others would defer to because of their status, effectively reducing a jury of 12 or whatever to a jury of 1. I have to admit that's very good reasoning, but I think it says rather terrible things about the place of knowledge and critical thinking in our society. It also very much overestimates whether most people act would defer to anyone else's knowledge. 😂
Serving jury duty was best education experience. TV judge shows are shows with law thrown in. Change justice system by participating. White people avoid jury duty but shocked about police. Majority of federal cases are plea deals. Black people must serve as 'jury of peers' to ensure justice is applied.
So... they cannot trust the jury to think on their own without beeing blinded by irrelevant titles but at the same time they are equipped enough to decide over lifes... doesn't eeally make sense to me.
When I was at school (back when Pontius was still a Pilate) one of my teachers was called for jury service. Afterwards when he could talk about it, the jury he was on had to determine a case where a girl had been raped, the rapist was caught, tried, and sentenced - but was out of prison within six months while his victim's life was in ruins. The victim's mother and brother had found the chap, and her brother had held the guy down while her mum put the kettle on - the whole lot got poured down into his pants, and 'boil in the bag' took on a whole new meaning. It was them who were on trial.
I am not someone that assumes alleged victims are telling the truth 100% of the time but the materson case seems legitimately terrible. The role Scientology played in protecting materson is disgusting and frankly the LAPD seem to have conspired against the victims. I hope justice is served but I realize how difficult the case will be. Honestly though Scientology played a huge role in the case and the judge shouldn’t protect Scientology over the victims.
I doubt the judge is trying to protect scientology, but rather the case, and maybe even herself from the church. Look into what they do to people who go against the "church"! It's just disgusting. LAPD likly has some pockets lined by the "church". I know there's alot of that down in Florida, allegedly.

I feel so bad for Anthony Rapp. I've met him a few times, he's always been a sweetheart and a stunning performer. I know the verdict came back today after an hour of deliberation and found Spacey not guilty but I would chalk that up to the incident being 30+ years old and the lack of evidence.
I agree, especially as it’s rare for male SA victims to testify in court. I believe Rapp is incredibly brave and hope he is able to find some sort of closure.
@@beccatorres I hope so too! According to what I've seen online it seems like he was glad to be able to tell the truth on the stand and get the story out there. One of the times I met him was at the stage door for one of his returns to Rent on Broadway. I actually brought his book for him to sign and he seemed touched that someone would want him to do so. He actually looked up at me and was like "really?" genuinely surprised. I don't know for sure but I feel like that says something about the value he puts on telling his story to empower others.
Interesting how potential jurors are asked if they have direct experience of SA but aren't asked if they have direct experience of committing these crimes.

When the accusations came out against Masterson, he was on a Netflix show called "The Ranch" and they were a few seasons in. He got fired from the show due to the accusations, made a press release sayin that they were false, and that was a few years ago. I am interested to see how this trial goes, as the Church of Scientology said that they take care of their own members with these types of accusations, so how is this NOT a trial against the Church as well?
The one time I made it through to the in court jury selection, I was the first one out of the room. I was basically having an anxiety attack and couldn't rip my eyes away from the defendant's... Who just clamped how she on mine and didn't blink at all as I was freaking out and apologizing as I left the courtroom. I felt so horrible that I couldn't help out the victim and her family! I beat myself up so much for it afterwards, thinking how I should've helped! 😭 Thankfully, listening to you for so long has helped me realize and come to terms that I wouldn't have been able to help anyone in the state I was in. As for "why didn't they tell?" type questions, there are so very, VERY many reasons why we don't tell at the time. Don't make us victims all over again when we FINALLY become able to do so. Just don't.

I am so confused as to why the victims cannot talk about their one time religion of Scientology? Especially since it was Scientology that played a significant role in their lives and social lives, how they met and interacted with the accused, and how they did or didn't report the assaults?! It dictated everything they did from the alleged assaults until this very moment. Why should they be forbidden to talk about how they were silenced?!
Because that's what the organisation does. Even though the way you were silenced is literally in written scripture from LHR or DM, as well as them having detailed records on exactly when and how you may have been disciplined, for what, and who reported you, they'll stop you talking if they can. @Emily D. Baker, I would love to see you collaborate with Aaron Smith Levin or Mike Rinder re: the Masterson case. They’re both well known ex-Scientologists, and Aaron in particular has the makings of an excellent legal mind.
I mean I think I can understand the defense's concern for Masterson. But... Like... You don't need to know a lot about scientology to know it basically consumes the adherent's lives. It doesn't seem insane to me for it to feature *heavily* in the trial as an explanation for the alleged victims actions (though anyone who knows anything about assault victims knows you don't need to be in a cult to be terrified out of coming forward). That's not putting scientology on trial that's just setting the stage. Or at least that's my non-lawyer perspective. It just boggles my mind to see the judge so aggressively trying to keep it out.

i said when all the muck was being drug up and these people accused that there was going to be a lot of very heavy and hard court cases coming up and they have begun. a prayer goes out to all involved that the process of justice helps more than it hurts
Ew, I think some people don't realize that just because the jury found him not guilty, it doesn't mean that the actions in question didn't happen. All it means is that there wasn't enough evidence to prove the claims against him. Anthony Rapp was 14 when this happened, he's 50 now. 36 years can fog memories, especially when there's trauma involved, and what physical evidence to this event exists at this point? It is my hope that Hollywood and the public don't forget the thing he is accused of.
I mean, excluding Anthony Rapp, I think Kevin Spacey is guilty for actions against others, just maybe not exactly Anthony. BUT either way, I have such conflicting feelings about him. He definitely needs to be accountable, but I still like what he has produced and enjoy watching him on the screen
These cases are ones that have me unable to do jury duty. Where I live if there is one area that you are excused from they do it for your lifetime because they never know what a case will be about. The victims in both cases need their justice for what they went through. Due to time it was to late for charges in another state for my daughter. I dislike like this because the victim doesn't remember stuff until therapy and are away from person.

Re Emily’s point about how many potential jurors have themselves experienced sexual violence, since they’re not done by just one person it follows that many many jurors have themselves committed such acts.

The "casting couch" has been a fact of life long before there ever was an entertainment industry. A similar "couch" exists in corporations, schools, churches, politics, law enforcement, etc., wherever there are those who use their ability to make, manipulate, or force such things to happen. One might call it one of the "perks" of materialism, but bottom line, the desire for sexual gratification is the core reason people strive to become rich or famous. So go after Weinstein, Spacey, Masterson, Cosby, and others, but don't forget the teachers, preachers, high reachers and other creatures who were there long before them, and those who will be there long after them.

On the subject of filming in the court room I think it is very important for transparency in our court system, I'm from Ohio and right now there is a murder trial going on in small town rural Ohio for someone who allegedly murdered eight people in the same family, I have been very happy that the court has been live broadcasting and allowing the video to be posted to RU-vid so I can hear all the witnesses on the stand what the jury hears and sees, The only thing I didn't like is that two of the murderers who have already pled guilty we're allowed to abstain from audio and visual. I think since they have pled guilty they should have to have their story out there for the public to hear, the prosecution was the one who fought to let them choose, not sure why, no matter what I'm very happy that the court is broadcasting most of it and if small town Ohio can figure out and afford to do this I don't see why LA County can't.

BC we ALL deserve our day in Court, I never got mine and I'm still upset that the police in Fl. decided BC I had seizure's afterwards that I could be proven to not know what I absolutely know , like what he rid to my throat first and how I was found by paramedics after friends saw me and called 911 thank God and them BC I was almost gone

Truth is as much as I love you, Emily and the community maybe we're better off watching people already on the shit list. Aaron Levin at Growing up in Scientology and Tony Ortega's The Underground Bunker blog are good resources. I'd just dont want to see an EDB hate website go up due to any coverage on the trial. I've been following this group for over 10 years and they are serious about their silly retribution tactics. But if we must ride I'm all in.💜

In regards to the Scientology and Masterson case: Can you reach out to Tony Ortega from the Underground bunker? He's in court everyday. On his RU-vid he links the emails he sends daily as the trial goes on. He sends like 4 a day of court transcripts plus does videos. Tont Ortega has reported on Scientology for YEARS. He knows alot and frequently communicates flwith ex Scientologists that has allt of insights in this case and Masterson.

I don't know why, but after all the fighting and sov-cit act the sobbing (while I agree was genuine) just felt uncomfortable and manipulative to me. And "I hope you make the *right* decision" just irked me.
I feel like The Masterson case really needs to to think about this case as if it was a different religion. During cases that have discussed other groups that have a very insular nature the discussion of the group didn't have the same cooling effect that the judge seems to be putting over this. You can treat religious beliefs with respect and still acknowledge they keep people from talking about sexual crimes. The southern Baptist convention is currently dealing with the situation similar. If people were not allowed to talk about how the fear of being excommunicated affect victims then it is a failing on the justice system

Emily is wonderful, but this is the first time we didn’t agree on something… I understand that from a lawyers perspective that it’s about the victim seeking justice… for me I just couldn’t do that… the only way I could convince myself to keep on going through the trial was telling myself “how will you feel when he does this to someone else?” I think a part of me knew that no matter the outcome of the trial it wouldn’t change anything for me… he still violated me, and I still felt like garbage… getting “justice” in that state of mind doesn’t really exist… it wasn’t a virtue signalling thing either, it was definitely a way of conning myself into making sure I wasn’t responsible for someone else getting hurt (and I understand that is the shame spiral and it is not my fault, but there a days where that is difficult to believe)… I think it’s a case of where someone’s ability to speak about their experience really comes down to courage, I didn’t have the courage to get justice for myself, but I did react well to the fear of being responsible for someone else’s suffering… is it healthy? No. Did the bad guy get what he deserves? Yes. But I guess it didn’t change anything for me…
