@@callmekirkland8 EDIT: please see other posts for clarification on definitions and such. I think you need to be careful there because there is R by coercion. If the women thought if they didn’t do it they would be black listed or banned from Hollywood it could reasonably be argued as R by coercion. (Particularly if that’s what was told to them to get them to agree) Not saying it would win but it could be argued. Also not saying what you are saying is inherently wrong either. It’s a delicate topic for sure.

This includes blackmail & threats, such as “if you don’t sleep with me you’ll never work in Hollywood again, I’ll ruin your reputation, etc” *Sexual coercion is not consent.*

I never told my now ex husband about my trauma until he wanted to do some things I wasnt willing to do and I told him why. He then proceeded to try and guilt me into letting him do it because 'they got to so why cant i it will be better since its me". Yeah. That happened. One of the many reasons he is my ex.

I’m so sorry honey!! My ex husband used to rape my all the time because I had a lot of problems with endometriosis that I had to get several surgeries for. I’m so sorry that you had an ex tell you what they did. Thank God I married a wonderful man who rescued my daughters and me and is an AMAZING man that I couldn’t have asked for or gotten anyone better. I pray this for you honey!! You deserve this too. We all do❤️

As someone who was a HUGE That 70s Show fan, I've been watching everything there is on this Masterson case. I can't express how disappointed I am in him. I literally watched that show like 20 times over, and Hyde was my favorite character. It's a real travesty that such an amazing show will now be forever tainted by his wrong doings. Cuz I'm sure I could watch the show again, but there's no way I couldn't think about what he did every time his character came on screen. I hope he gets what he deserves.

Aside from how brilliant you are at explaining things to us, what I like most about your show is your humanity and fairness. You are so sensitive to, and appreciative of, differences and diversity in this world and on your channel, and yet can call out f*ckery and throw shade when it's deserved with the best of them! Question about the Masterson case: Why is that person allowed to testify about what the victim told him about the alledged abuse? Wouldn't that be hearsay?

Gotta love how Weinstein's attorney is literally spelling out the casting couch power dynamic to the jury and thinks it's a defense. Couldn't what he described still be argued as coercion? Incredible.

The Weinstien opening reminds me of a case were a man broke into a house and took the owners captive, only releasing them after they promised to not go to the cops. And then after the couple went to the cops, he tried to argue that they broke their contract of silence (he lost duh) "No your order, they loved it. Just read them talking about how great it was while his approval of them meant the difference between eating and not eating"

Thank you for the explanation about hostile witness. My grandmother drew my mother and I into a case when I was 16 and they classified my mother as a hostile witness. I never knew why. Now I understand.

Replay crew…I was a juror on a trial where the def attorney claimed the plaintiff (who had a baby with a cousin) was not as innocent as we are being lead to believe. She was 15. This did not sit well with any juror. We were appalled by that statement. Why say that? Not appropriate.

I went to high school with a talented girl who went on to be an actress in Hollywood. Years later, though MANY years BEFORE “me too”, she was the subject of interviews & TV segments on this very subject/practice. I can’t help thinking of her when digesting all of this horror. It breaks my heart. I’m as disgusted with those who allowed it, ignored it, and covered it up as I am with the perpetrators. It sickens me.

Growing up in Scientology has a RU-vid channel and he talks about Danny Masterson and all that.He knows Lea Remini & was on 1st season of her show. He grew up in Scientology. It's Great channel!

Isn't consent supposed to be given at the beginning not at the end of something? Because I remember an old saying of" it's better to say sorry then ask for permission" which would imply that for a very very long time, consent would be before something happened, correct? Once you find yourself in a situation like that you are now being held captive. The only way out is to keep that person happy and if you can't remove them from your personal body or stop feeling like you could die, then most will do or say whatever they have to or remain absolutely quiet and silent so that the horribleness will stop and they can escape. Unfortunately if you don't know anybody that went through it or if you yourself have not gone through it, most average people don't know that that kind of situation can come up and you would be stuck in that choice. Please don't forget also that the penalty for getting it wrong is very painful or permanent. I'm sorry if this was put badly, I'm shaking.

So I work for Ford, specifically in a recall department. I've seen the extended warranty that he's speaking of and I feel that I need to point out that what he's talking about is NOT a safety recall. It's a just in case program. Just in case the customer had an issue that was covered by the extended warranty (within the extended warranty time frame), then the repair is covered by Ford.

The anger I feel when I listened to Weinsten's opening statement will violate the rules of this chat. I respect you too much to verbalize that. However, it doesn't surprise me. The trial against the monster who harmed me was much the same...in the '90s. I don't think the jury of today will fall for "She wanted it" defense. I am completely appalled. Emily! Great coverage. I was at CCB on Tuesday - you're correct (of course!) the elevators were terrible I forgot how small these courtrooms are. Masterson only had 3 pews and Weinstein 4, I believe. I was surprised that the Masterson gallery was half empty. It did give an interesting perspective being there and seeing all the nuances from both sides

My head is exploding listening to the Weinstein opening statement 🤯 WTF! I was a little girl when I was sexually abused and I still have flashbacks! It took decades for me to seek counseling because the memories of my abuse appeared when my daughter reached the same age I was when the abuse occurred. There is no straight line for this process. It comes to you when it comes to you. I’m just sick to my stomach for all of the victims having to go through this process. 💔

Ugh, this is the bullshit that makes people not understand consent. Consent needs to be given, not assumed, and can be taken away at any time. Consent is affirmative "yes I like this" "yes I want to move on." Not hearing "no" DOES NOT mean you have consent. An orgasm is the bodies natural reaction to sexual stimulation, an orgasm cannot assume consent (fake or not.) Honestly, I think this line of defense is DISGUSTING. I get it, zealous support of your client but... just DISGUSTING!

I am proof of not remembering for years. My oldest brother abused me from about to 10 years old. When I started remembering I was just over 30. I didn't believe it myself when I first started remembering. In the end I couldn't deny what had happened and it explained a lot of my behaviors as a young girl and teen

@@callmekirkland8 you would still have to have proof theirs still innocent until proven guilty just like murder if you murder someone and the cops find evidence 40 years later you can still be punished but some slime bag grapes someone but over 5 years went by then you can't do anything you don't get found guilty of crimes with no evidence prosecution has to prove beyond a reasonable doubt the person (or people) did it and witnesses aren't enough their has to be other evidence like dna, fingerprints, etc as it should be

I simultaneously agree and disagree with you. I assume that most people wouldn't abuse this kind of law (no statue of limitations) but it also opens the door for everyone to come up with accusations that can't be proven to destroy the lives of people they don't like :(

I was sexually assaulted but have NEVER told my husband of thirty years because, although I understand I was not to blame, I feel wholeheartedly ashamed of what happened. So ashamed that I will never tell what happened. I would rather let the shame die with me, than have anyone know what happened.

When/if you are ready, to whomever you want to share it with, saying it out loud will help it start to lose power over you. Words are powerful. Your voice is powerful. When/if you are ever ready, you will know. Either way, it is your story to tell to whoever you want. Also, It HAPPENED TO you. It was beyond your control. Emotions may tell you something else. Which is why it can help to have another person to remind you of the facts your emotions distort or make hard to remember, things that you NEED to remember. Things like NOTHING you may have done, makes what happened to you OK. And as horrific and as traumatic as it may be and as life altering as it may have been, it effects you, but it does NOT define you. You are MORE than the worst thing you have experienced. Sometimes, we can know these things intellectually, but not emotionally, and it helps to have someone tells us this. every single time we need to hear it; and as many times as we need to hear it.

Thank you for presenting info on other ongoing trials. I watched the Brooks trial from day one of his arrest. It was very frustrating to watch. I’m thankful our judicial system worked to convict a habitual offender.

Hi Emily! I love your work, thank you for all you do. At 17 I was rap%d by my cousin and didn’t tell my husband until 18 years into our marriage. I never told anyone in my family. Honestly it took me almost 25 years to even face or look back at what happened, so no, as much as my hubby is my very best friend in the world, I didn’t even trust myself to tell him. Now that he knows he’s ultra sensitive to Women’s rights, ( he was before but more so now knowing how badly his wife was hurt) so if anything “ positive “ came from this attack is that it created another ally in the Women’s movement, and we can use as many good men as we can to stand with us and say NO.

It always shocks the men in my life, not only the sheer number of women who have been assaulted but how we've been treated afterwards. Sometimes I feel like no matter how many steps we take in the direction of victim awareness there will always be an underlying current of blame.

Most of the wonderful men in my life realize that being a woman is a vastly different experience than being a man. I just think it's a conversation worth having with them. I was screaming as I listened to that opening argument. I cannot believe that’s what they’re going with. Also, there’s a peanut butter shortage! My husband and I were just talking about it this morning. I worked in an elementary school last year and it was just beginning to be an issue for food service in the spring, seems like it has caught up elsewhere.

My mouth dropped at the defenses opening statement. A *casting couch* ????!!! A "casting couch" is *never* transactional. If you feel you *have* to have sex with someone who holds all the power just to get a job or keep it - it is *not* TRANSACTIONAL, it is BLACKMAIL. How unbelievably gross of him to think a "casting couch" is a reasonable defense.

I'm baffled by the quotes from Weinstein's lawyer. That was absolutely BANANAS! What do they think they're accomplishing by being obviously misogynistic in the opening statements? "Bimbo"??! I thought we left that word in 1998 .. Do they really think the jury will be like yeah, makes sense.

Lemme just say this; I watched the trial with you. (Thanks so much for doing that for us!) The Brooks case.. *I Object to that name!* I am not one with a temper. At all. It was taking all of my might to not yell through the screen at him. I feel the Judge did give him too much leeway at the beginning, thus him taking full advantage of her grace. I don't envy her at all. Feel she did the best that she could do. Thanks again, Emily!

I initially thought the same thing about the judge. In hindsight, I now appreciate her patience. I think he will appeal. He’ll indeed need attorneys for that. The judge left no room for a mistrial.

Since you brought up the gold eagle on the flag, here’s a funny. I kept thinking, when the camera cut to that, that the eagle was going to be covering his eyes with his wings, like the Jesus statue in the movie, “Airplane”. Honestly, that was a humor relief I needed. 😂

Those issues are addressed during voir dire. (Jury selection process.) ⚖️🤓 Anyone who might be truly triggered by the facts/testimony presented during trial should be dismissed. 💪🏽👏🏽😉 Hope this helps!! Stay safe out there, be blessed. 🤓🤘🏽💋🔮⚖️

In big/notorious/difficult trials there is often questionnaires before voir dire. That allows privacy for someone, for example, who has been hit by a car be eliminated from the Brooks trial by the court and sent home before any in court questions.

Because being a victim of a similar crime is potentially prejudicial, voir dire would filter out people who already have trauma relating to events depicted in the case. It's the kind of thing that does contribute to overly-masculine juries in cases about sexual crimes and gender-based discrimination, but there's really no good way to fix that without changing almost everything about modern society.

Having lived and worked in the Hollywood industry and being one of those who added their "me too" voice with so many others, the Weinstein information is physically painful. I know horrible things have happened with the me too movement, but I really hope that something happens with the Weinstein case to help some healing begin. Consent was very rarely sought, much less an option. The information about those opening statements was painful to listen to, but I want to hear it and keep hoping that it's going to go the right way.

Emily, I have a question. How and when are cases decided to be televised? We saw Amber/Depp case, and now the Brooks case; what criteria is needed for a case to be put on TV?

I know what is not televised. For some reason we don't get to see Federal trials. The Brooks case allowed one camera, but I don't know if it was requested by someone or this is a weird good coming out of Covid.

The only thing I know is that often there’s talk around the case being of public interest. And in the Brooks case, there were too many survivors to fit in a court room. Not to mention victims not wanting to share space with their abuser.

Emily I am not surprised at all about the opening statement. This isnt the first time that method of thinking was stated. Documentaries and specials repeatedly document the casting couch. even actresses of old Hollywood had made statements like 'you do what you have to do if you want the job.' This isnt new. I dont agree with it and even as a kid I knew what they were talking about but could not understand how anyone would want something that bad. But I was not living their lives. Men and Women of power are often predators who attract both men and women who end up being victims.

I agree Emily, the defence lawyer is simply doing his job. His opening may appear distasteful, but if the lawyer has been instructed that the sex was consensual and transactional then it's his job to convey this. The "..otherwise she'd be just another bimbo....." comment was completely unnecessary and alienating, in my opinion. Thank you for doing such a great job.

As a victim, I am appauled that women are shunned for speaking up. This has been going on for years and years. Women just want justice. AH was a blow for all victims. As we can clearly see she was lying about her assaults but instead the aggressor!

Even in the appalling opening statement by the defense it was pointed out that “he is not Brad Pitt or George Clooney” so he had to rely on his powerful position to get women to have sex with him. Even the defense realizes the power dynamic was in play and the only way around that is to say the victims were willing to play that game. I really hope the jury sees that for what it is, the only option the defense has. It’s gross and that thinking is definitely the reason the abuse wasn’t reported immediately because the victims knew they would be subject to that line of thinking and probably thought it was no use and not worth risking their career for. Just disgusting and I hope in 2022, that thinking is proven to be no excuse for SA.
