Imo, I think the Laundries were more concerned about their own situation more than intentional infliction of pain to Gabby's family. If their actions caused pain to her folks, I don't think they cared. It's all about them.

Same! That was my first thought 😅 However, not all families openly communicate with each other. I think some people come from families with a culture of avoiding conflict or things that might reflect poorly on the family. I can see how in those types of families one might not explicitly SAY "I killed her," but it would be understood what was meant. You also figure they had to know he was abusive towards her. She lived with them for a while, so hearing that she's "gone" may not have been completely out of left field 😕

I think he didn’t want to say to his parents, “I killed her, Mom and Dad, I strangled the life out of her.” Instead, he pathetically attempted to evade full personal accountability and used the euphemistic phrase, “She’s gone.” “She’s gone,” rather than I did it. She didn’t leave him. He murdered her at the end of a long burning rage across the country.

Re the quote: My immediate response was, He was implying to his parents that he got out of control, accidentally killed Gabby and that he needed a lawyer. If that was my son, the first thing I'd be saying is 'What do you mean she's gone?, and why do you think you need a lawyer? Could they be charged with obstruction? The Mother offered him tools if he needed them. Thanks for the great show!

If my husband went missing, left, got lost, or ran away - I wouldn’t be contacting my parents for a legal referral, I would be on the phone with police. Semantics wont change the logical implications of someone’s actions. You don’t call an attorney during an emergency, unless you’re responsible for it.

“Gabby is gone.” Could be argued both ways.. showing up in her van shortly after instead of starting a manhunt for her where you last saw her loses the argument. Vague words are a lawyers best friend, but actions are their nemesis.

The sad thing is that the Laundries, instead of driving to the police station with their son, seem to have allowed him to say good bye at that camping trip then go off and kill himself. And I think that the fact they found his body immediately shows they knew what he was going to do.

I suspect -- and I realize this is out there a bit -- that Brian's mother or father killed him in a rage on the camping trip, or persuaded him that he had to do this for "the family," and assisted him in doing so. They found his body immediately, but they also found it in a place that had been underwater for weeks until perhaps the day before. Yet he was found in some sort of recognizable condition, hadn't floated away, and the gun was still with him. There are a few possibilities as to how this could happen, but the least plausible was that he was sitting in warm Florida water for weeks after having shot himself, alone..

I think they helped him go on the run, but I can't imagine a parent allowing their child to go commit suicide. After all, they had hired an attorney and were prepared to do what they could to defend him. Even though they should have thought about it .... I don't think they knew or suspected that he would have killed himself. I think it's more likely that he told them some plan that he had, and they allowed him to go on with it. The entire situation had to be very shocking and traumatic.

I think there is alot more to this. I mean one night I'm watching RU-vid and run across law and crime of the cops pulling them over then a couple days later she went missing...the parents the camping shit and lateranage to find "remains" with a diary though..it survived..I just call bs on it that he did it and then killed himself. I mean it was nationwide even on political talk etc. But none where of fame so idk. Just don't add up.

I like your theory. But does anyone ever recall seeing him one time in Florida once returning besides one neighbor and never again since ? It’s always bugged me. I’d love to know how long he’d been in that swamp for. His s’cide ltr seemed written in first person then switches I really don’t know anymore. Nothing would surprise me with this

It’s so bad! It’s an emission of guilt and there is no way a parent would even ask why he returned with HER van asking for a lawyer and said it like that. You have to remember the mothers chilling note to Brian which to me confirms even more

Question.... If Gabby left Brian, she would not leave him her van, she would have taken it. He would be without a vehicle. So wouldn't "gone" mean she's no longer here and I'm in trouble? The Laundrie parents needs to repay money that was spent looking for Gabby in those 11 days that they knew she wasn't alive.

She went to the hotel and he drove the van on their night apart. ? She chose to go with him and what could they parents have done to change anything. They knew their daughter was with him and dating him. She was an adult. I think they are really looking for someone to blame. Sad very sad.

I spent the last few days sitting in Hospice with my Irish Twin brother, 10.5 mos older than me, holding his hand 24/7. At 7pm last night, he breathed his last breath. I texted my son "Uncle Tim is gone." It was not, however, followed by I need a lawyer. He knew exactly what I meant. So did the Laundries know what Brian was saying. Period! I don't understand why there aren't criminal charges against them & Bertolino.

They didn’t answer frantic calls and texts about at that time her parents thought both were missing or something bad happened. They had to know at that point. If not you think they would have been worried about their son and they were not because they knew. Didn’t they help him run? I thought his mom got burner phones and the chilling letter. That’s just the pieces out there.

The thing is, I'm pretty sure Brian's parents knew their son very well and knew his manner of speech and how he phrased things. So they'd know how he meant "She's gone.". Context being that they were out in the middle of the wilderness. "Gone" would not mean Gabby left on her own, walking away into the great unknown. Also, the parents were well-aware of how their son treated Gabby. So many points the prosecution could bring out to prove the parents absolutely knew what their son meant.

I agree with you. I was an emergency nurse x40 years. When informing family & friends of a death. We always said, "Your loved one has died". It may seem calloused but we all understand what "died" means. Not "passed away, gone, expired, gone to heaven, etc"🎄🎁🎄

Thank you for that clarity! 27+years ago my Dad passed of V-Fib and when my mom got to the hospital the doctor gave a little spiel and ended with "...and he has expired." My mom wasn't in the medical frield then, and she was the freshest widow on the block with 6 minor children to take care of on her own. She said "wait, are you saying that hes died?!" Of course, yes that was what they meant. But thats just stupid wording that confused my mom, and still required further explanation. It has become a "serious hottake" in our family for many situations.

@@SellyNue I'm so sorry about your Dad. As a student nurse. The first time the medical staff referred to a dead patient as "expired". My sense of humor. I thought they were referring to a parking meter.😅 Usually the doctor would inform the family-friends about a death. On those rare occasions when a nurse had to inform them. I never used "expired". I see why your Mom was confused. Have a good holiday.🎄🎁🎄

You never actually got past the ‘I’m very sorry’ before the family realised what you were telling them as they could put the context clues together - knowing it was life or death, seeing at minimum one doctor and one nurse coming into them, the solemn faces on us. Protocol in the nhs is that there must be a nurse and doctor notifying - the doctor states all the matter of fact details and after the family have asked all their questions leaves and the nurse remains with them asking them if they will call anyone for them or prompting them to call family to get a support network in place now, preparing them to see the body before either police collect it for post-mortem or it goes to the hospital morgue for funeral director to collect - preparing them to know all drips/tubes are still attached in a sudden death for pathologist to document all our interventions and know what came from our intervention and what came from possible cause of death or letting them know nurses are cleaning their relative and making them look nice for them to come in and spend time with them. Finally of course the typical British tray of tea and biscuits/sandwiches/toast to ensure they eat something and generally making sure they are looking after themselves and that they are safe. But your right after saying I’m very sorry, we did everything we could but they have died. Let them have a cry before offering to answer any questions they have - some what to know everything what happened/what we did/were they aware of what was happening etc the other person doesn’t want to know anything except that they didn’t suffer.

They had to admit to knowing something - it makes no sense that they knew nothing. But by saying he said she was “gone” it gives them an out. They can say they assumed he meant she had left him. And that they thought a lawyer would be a good idea in case her parents accused him of anything if she didn’t come home. We all know they knew the truth. But not sure it can be proven.

My best friend called me hysterical and said her granddaughter was gone. I asked if she had notified the police. The child had died and she was annoyed that I didn't know that immediately.

Nope you never speak to police without a lawyer. Police can twist or misrepresent things you say - plenty innocent people are jailed due to not having a lawyer from the start. I would never speak to police without a lawyer and have told my son to never speak to police without a lawyer

@@irishandscottish1829I agree I do not ever speak with the police or as little as possible- If anything happened to someone while I was camping with them though, accidental or self inflicted I would absolutely call park rangers or ems and etc because it could be at minimum “failure to rendure aid” or etc… if it was manslaughter or homicide… he had the opportunity to have a lawyer as he should and the parents let him abscond with the knowledge that he brought home her van, not her, and she was “gone”. And had the soulless audacity to not communicate with the parents…. I hope her family gets some kind of justice. If her killer’s family didn’t so likely KNOW about the incident I wouldn’t think they should be legally culpable… 😢

I'm sure he gave the parents the same bs story he gave the world in the note he left: that he "had" to somehow perform some mercy killing after she broke her ankle🙄(THE worst cover/fishing for manslaughter story I've heard in my life.) Abusers like him see themselves as the victims. He believed he was entitled to take her life because she somehow defied, annoyed, or refused him. The family will more often than not be an abuser's biggest enabler (besides society itself) protecting him from facing consequences, minimalizing his actions, justifying his calousness, insisting he's blameless. Even breaking the law for him. He learned that behavior somewhere...it's now obvious to the world exactly where it comes from. Raised to believe that no one else's pain matters apart from their own. That woman knew damn well what her son did. She blocked that mother looking for her daughter...she knew. And the grown ass lawyer knew it was wrong to conceal knowledge concealing the location of remains/whereabouts of an endangered, missing, deceased woman. This is civil court...it isn't as much about what you can prove as it is about what you *knew* was wrong but conciously decided to do anyway.

Replay crew!! The biggest QUESTION I've had with this entire Ms Becky thing is this: If she was against Murdaugh enough to taint the jury than why write the book? She'd HAVE to know that the judge and jury would be questioned & that it could cause a mistrial! It makes zero sense to me that she'd risk the verdict, her career, & potentially her freedom for a book.

You can make an argument all you want, there’s no need to request a lawyer if there wasn’t foul play. If she was simply missing, why did he not report it to the police himself? Why did he not contact her family to see if they heard from her? Why was her being missing not the primary concern and getting a lawyer was a concern? Why did he have her van in his possession? On top of that, his family acted as if they knew nothing so it 100% shows intentional infliction of emotional distress. They should definitely be charged with aiding and abetting. Take it to a jury and let them decide.

With all the questionable elements brought to light during the Murdaugh trial, I think the federal level would be a better investigation. I know nothing about the law but SC law enforcement has too many shady situations.

I’m dying to know what the SLED agents who weren’t involved, the other county members, the citizens in the area, family members, friends etc are all thinking. Like if I was in the middle of all this by chance I would have a hard time not speaking out. It’s just all crazy

I’m trying to change the way I think about someone hiring an attorney before being charged, especially the spouse or SO. In this day and age I don’t have as much trust in LE like I used to. Look at the Suzanne Morphew case, Brandon Dassey’s interrogation, and what’s happening in the Delphi case to name a few that cause me to question the tactics of overzealous LE. I think sometimes the innocent need as much, if not more, lawyer assistance. Thx Peter and LYK jurists. ✌️❤️🐾

Yes Peter, what does “gone” mean? Lost? Broke up? Left? Dead? So many things. And was it in the same sentence as him saying he needs a lawyer or a vague comment in the same call? Personally while not telling the Petitos is brutal, I think Bertalino thought he was choosing his words carefully by saying they “hope they are reunited” because that has nothing to do with life/death… just recovery/reunification. I don’t see how that meant to inflict pain, to me it shows that they didn’t want her body left alone somewhere forever…

They harboured him. I fully believe they knew where he was the entire time they were searching or at least an idea. I thought that BEFORE learning about this phone call. They are absolutely complicit but I don’t know if that leaves them culpable legally. I think Gabby’s parents deserved better and as a parent I understand wanting to protect your child but not if someone else’s child is missing. They should have turned him over to the authorities immediately for questioning and whatever else.

I agree Peter it feels like a new trial is in Order. Becky's access to the Courthouse should be revoked, if she is still emploed. Not sure if she is elected. If so she should be recalled by the citizens. Maybe a change of venue is in Order

We, the public, all speculated that the laundries knew he had unalived Gabby. They gave him time to run/escspe. I don’t think they expected him to take the cowards way out though IMO. But it doesn’t matter they are accomplices to Gabby’s homicide and they should be charged as such. They have no sympathy from me because they made the Petitos suffer 3 times over.

Peter... Didnt the judge say when civil suit filed that attorney client/priveledge was waived when they had him give the statement that they hoped they'd reunite? Also not only did they refuse go talk to petitio FAM they blocked them and his her van in garage...

Well, slap me and call me strange but, as a juror, if the only comment I got to hear was 'she's gone and I need a lawyer' I wouldn't instantly assume 'she' was dead. I might have thought, 'they've had a fight and she walked....maybe it got physical.' Now, it would be a different story once he came home in HER van.

I agree. Saying someone is “gone” doesn’t always mean deceased. We now know she was in fact deceased, but that term doesn’t have only one meaning.

Plus he contacted her family with her phone while she was dead AND he used her credit card on his way home with her van. If she just left she wouldn't leave her van, credit card and phone behind. If she was lost or abducted he would/should have called the police.

Are "recognizing" you will cause emotional harm and "intending" to cause emotional harm the same? I would think the Laundries knew their statement would cause harm (because they apparently knew previously that Gabbi was "gone"), but their intention was to cover up their son's involvement in a potential crime. Also, can't they be charged with harboring and other crimes based on this same statement?

Knowing what we know now, “she’s gone I need a lawyer” sounds very much like an admission of guilt… but if your son said that without elaborating, and you didn’t already know she was dead, I’m really not sure that’s what you would think it meant!

Gone in quotes feels like a distancing word to look less icky than dead or murdered. Whether he did it or not. As in "the last piece if cake is "gone"." Would be more pleasant in my telling than, " I wolfed down that last piece of cake."

Big Red actually quoted Sir Walter Scott from his play "Marmion" which quote continues...."Oh, what a tangled web we weave when first we practice to deceive". I wonder if AM knew of this quote and whether he knew that it speaks of how deceit creates problems upon problems until there is such a complex web that's hard to navigate. I wish Judge Newman had pursued AM's meaning at his sentencing. I do understand how that moment of sentencing drenched any exploration into the analysis of AM's comment. Thanks, Peter. 🙏

I agree that the phone call implies the Laundry’s knew all along. To me, they should have known when he showed up alone in Gabby’s van. I disagree that the statement made by the attorney implied Gabby was alive. When I heard it, I knew she was deceased by his choice of words. Specifically “(the search is) successful “ and “reunited.” Weird choice of words for a human being who is missing and presumed alive.

From reading Creighton Waters' filings my prediction is that the AG or someone on their behalf will do a "far reaching" investigation and then broom the case with a lot of verbal gymnastics. They may admit she "crossed the line" in a few ways but claim that it was not "outcome determinative". Unless you bring the feds in there will not be a fair effective handling of the case.

@@BlueDauntless My understanding is that the standard is whether there was "improper bias" or "prejudice". But, I'm not licensed in SC and I've never been down that road. This is a sad set of circumstances, I've tried jury trials and always found the court staff to be extremely professional.

We know she is dead, but at the time and as the parent, you would normally not think dead, As a parent, you would think she abandoned him. Why need a lawyer? Why did she leave? Maybe he was afraid she would be accusing him of all kinds of things. Did they ask further? We haven't been privy to that.

I don’t want to know what non-lawyer parents would do. I only want to know what parents who are lawyers and judges would do if their child rings with some ambiguous comments about a relationship breakup. I think perhaps most of them would believe innocent until proven guilty, not ask too many questions initially, and try to give your child the best chance at a defence by not saying anything at all publicly. Then let the legal system in time to reveal the facts. And I always thought the lawyers statement about the parents hoping the Petitos are reunited with Gabby soon did not indicate alive or dead. If the Petitos felt that it was giving false hope, I don’t think they can hold the Laundries responsible.

The state should charge the Laundries for obstruction of justice and pay for all the costs pertaining to Gabby's murder. All the searches, manpower etc. They knew exactly what their son did. They are all disgusting people. I am so sorry for Gabby's family.

I don't think the parents jumped to the conclusion that he ended her life, I don't think that would be the first assumption without insight 20/20, especially since she wasn't reported missing yet. I think he meant it that way, but if someone told me the same sentence without any further context, I would take it as 'she left', as in maybe there was an argument, and she left, maybe things got physical (like when they were separated by police) and that's why he needs a lawyer. However, I would for sure ask some follow questions as to what exactly happened. Once she was reported though, and her parents reached out, they should be putting 2 and 2 together.

As a parent hearing your child say his gf is "gone", your first thought isn't going to be that she is "dead". They were put in an impossible situation. My heart goes out to both these families, both their children are dead. I don't think the Petitos are going to feel any better by exacting vengeance.

"She's gone" is actually specific to me. He could've said "She's missing. Idk what to do". He said gone. And even after she was found roberta and chris still seemed so cold. They never reached out personally to the petitos or helped in any way.

No care for the wear and tear on these players bodies for the rest of their lives. Especially players who end up with devastating injuries! They have no union protection and no workers compensation. NOTHING! Even the ones who made it to pro that get injured should have workers compensation too. Anyway, they hire and pay these College Coaches MILLIONS and build Million dollar Stadiums, Gyms! I would love to know why College/University charged so much for EDUCATION!? When it was free or practically free before! And it p!zzes me off how these older and rich hypocrites conveniently forget that important fact! These are the same ppl who take every chance to disrespect the younger generations when they need help with student loan debt. When it was these BABY BOOMERS who F' D UP THE ECONOMY! And now the younger generation has to pay for it and suffer for their F ups. Now you have schools make BILLIONS off these students. Mostly for Degrees that's worthless! That students won't even be able to pay off for the rest of their lives! As you can see, I'm passionate about these courageous and brave students wanting to go for their dreams only to find out they are just dollar signs to these people.😒

She's gone, I need a lawyer: This generally means that something happened. It is possible that both parties got into a fight and exchanged punches or arguments. Maybe she was injured and she threatened to call the police. It doesn't necessarily mean that Brian told his parents that he killed Gabby. "She's gone" can also mean she's leaving her boyfriend for good. She is breaking up with her boyfriend permanently.

I have no doubt that Gabby's parents have felt extreme emotional distress at the hands of the Laundrie's, but I think the things they did were probably legal. The Laundrie's lawyer shouldn't have worded his statement the way he did, but I really don't feel like it was intentional infliction of emotional distress. I think the intent was to offer the Gabby's parents some comfort while also protecting Brian as much as they could. So, really the intent was the opposite of emotional distress. Ultimately, I think the most distress came from the Laundrie's giving them the cold shoulder when their daughter was missing and I don't blame them at all for that!

Even if the statement that she was gone possibly meant she left or was hurt by someone else waiting so long would not give her a chance to be found. I believe that is still intentional harm to the family.

Interesting point re bringing another prosecutor/investigator into the case (at 10:00 you discuss). They did such in Georgia with the Armaud Arbery case. Agree, this is probably the best idea (eventually, a prosecutor IIRC from the Atlanta area took on the Brunswick Arbery case on Georgia's coast)

He came home, alone, in her van. If Gabbie had left him, why would she leave her van and why would he need a lawyer ? The logical response to a son, who had a volatile relationship with a girl, calling his parents to say she was "gone" and he needed a lawyer, then drove up in HER car is "What do you mean she's gone ? Why do you have her car and why do you need a lawyer ? What did you do ?" . There's no way they didn't know.

Hi Peter. Sorry about FSU. Same thing happened to UCF a few years back. I’m originally from GA but transplanted to FL after college many years ago. Would have loved to see FSU v UGA. If it goes in front if the jury ; means they were lying to protect their son Brian at all costs. They even went to a camp site together with their daughter & son-in-law and we know now , he had said in a stmt she was gone & the pleas were ignored by the parents of Brian. They never told the truth, yes “we don’t have to tell you” so the argument will be a bad outcome one for Brian’s parents . Proper terms will mean money and legal fees and an apology and answering the questions the parents of Gabby

I think Laundrie wasn't ready to admit what he meant at that time. But yes, the attorney to me would have drilled down on "gone". But regardless the parents not sharing this information to Gabby's parents. Against the law? Even if not, it is a huge moral failing in my opinion. I think the parents didn't want to know at that time either.
