Something tells me she’s absolutely unbearable when working with attorneys . From watching the interrogation it seems she doesn’t even want to admit any guilt at all. Any defense that ends with her having to take any accountability at all is unacceptable to her. Her saying ‘ it wasn’t intentional ‘ is basically her trying to say she’s completely innocent of any charges that could result in prison time.

i mean, to be fair, admitting fault in an interrogation isn’t in the suspect’s best interest. It would make it worse/harder for her attorney if she accepted it “was her fault.”

@MrGST360 If memory serves me correctly Sarah admitted the day she called 911 after Jorge was dead, she admitted she zipped Jorge in the suitcase as thought they were playing an innocent game of Hide & Seek, never mentioning that Jorge was begging to be let out of the suitcase bc he couldn't breathe, but stating she got sleepy and went up to bed before Jorge could get himself out and come and find her. My question is after stating all that on a recorded statement they was also videoed before the detectives arrived at her house Sarah was speaking to the deputy sheriff which was also the first responder the whole thing was taped. They were the only 2 there who else could have done this other than Sarah? Why is there even a question to guilt or not guilty? If she pleads not guilty, but the video is shown that totally shows Sarah's very first statement isn't true what happens with that? That is exactly what has happened here she said one thing and something else happened and there is proof. I am confused on the difference in what you say in recorded statements and pleading guilty, not guilty in pretrial hearings?

@MrGST360: My impression is that she pretty much gets ghosted by the appointed attorneys. Six have been allowed to withdraw due to "irreconcilable differences," and it's clear this 7th attorney has only talked to her once. He's trying everything to get away from her and her god-forsaken case, because she has no defense and he knows he can't win.

she's guilty imo, but the thing about this is that even the guiltiest person can end up having a mistrial, or even be freed, if their lawyer messed up this badly. Look at Bill Cosby who walked free because the prosecution messed up despite his obvious guilt. It's why the judge in the Brook's case was so careful with all her warnings and she even helped him sometimes. She wanted to make sure the final ruling was rock-solid. I'm worried Sarah's case won't be because her lawyer is messing up. Yes, she's an awful person who did something absolutely terrible, but if you're a public defender for murder trials you need to understand you'll have terrible clients probably quite frequently.

@@timgreen1835 I almost agree with her, though, that she could be found NG or get less than 10 years with the right defense. She's definitely a weirdo and a drunk, and possibly aspergers-y given her demeanor, but this really seemed like a prank gone wrong. She was definitely being cruel to him, but I think she thought he was exaggerating when he said he couldn't breathe, and she thought that he would just be able to let himself out whenever he wanted to. Kind of a "9-1/2 weeks" sort of sadistic joke. Then she passed out from the drinking. To me the most appropriate sentence for someone like this would be supervised community service combined with a prison sentence, maybe five years. I don't think she's a risk to society or would do this again.
@timgreen1835
@timgreen1835 Год назад
@@nancyeaton731 Those FU's were very mean, purposeful, and vindictive as she obviously was trying to prove a point in punishing him, because that's exactly what she said she's doing. Also, which I don't believe too many people have thought of this, but the videos were made at around 11 PM, and she stated that she went to sleep at 12:30 AM. That's one and a half hours that he was in there literally begging for his life and suffocating, until she went to bed, when she tried to say that he was only in there for a few minutes. She lied so much. I would venture to say that Jorge was already dead when she went up to bed, Because he had already been suffocating in that suitcase for around an hour and a half. And the only explanation of how Jorge received all of those injuries, is Sarah pushing him down the stairs inside of that suitcase, which would've proved where his injuries came from (and the neighbors heard just that) And I do not think all the scratches on his back is from sex, but she was trying to brutalize him....and may have beat him with a baseball bat that was found close by. Personally, I do not think it's a stretch to have charged her with first-degree murder, and I wouldn't be surprised if she got life in prison, even with second-degree murder. She talked so much without an attorney, and I believe she talked her way right into a long prison sentence. I can't Think of one way that a defense attorney will help her. She can't use domestic violence, she Emphatically said that she was "not" drunk. And she went on and on about how they had one of the best days that they ever had before, but then she feels the need to zip Jorge in a suitcase, telling him to F off numerous times, killing him with him begging for her to let him out. When she went upstairs, hearing the man (that she said she loved) beg for his life and ignoring his pleas, that's intentional murder because she knew he was suffocating to death. There can't be any "woe is me" defense, And that's just a cop out when Sarah said that about Jorge. The videos clearly shows that the suitcase did not have a gap for him to unzip, plus, he was stuffed in that suitcase like a sardine, and I bet he couldn't even move his pinky finger, nonetheless his arms and hands to try to unzip himself. She kept saying unintentional… But if a drunk driver has a crash and kills somebody, they still get charged with murder, even though that was not their intention. Same situation with Sarah. Whatever defense her attorney comes up with, it will still be murder with intent and motive. She admits to zipping him in that suitcase, and she admitted that he would give him five minutes and they are to squirm around, but an hour and a half later, she goes to bed and to sleep. What woman in a serious relationship would not know that her man was not in bed with her during the night? Ok, I'm sorry this was so long, I'm disabled so I don't have much of anything else to do. Lol
@nancyeaton731
@nancyeaton731 Год назад
@@timgreen1835 hey don't apologize, those are all good points. I only make a counter argument because I had an abusive spouse I left a long time ago, but who would have done this to me, thinking it was funny and making me uncomfortable. Like I said, if you watch the move 9-1/2 weeks there are people who are sadistic for fun as a means of control. If she genuinely believed she was teaching him a lesson but had given him a way to get out, then her being drunk and passing out, and when, wouldn't really matter. He'd been abusive to her in the past so this could have been just her giving him what she'd received in the past. I don't think she should get off scot free and definitely deserves punishment, but I don't think she meant to kill or injure him or that it occurred to her that his death could even happen. When he said he couldn't breathe, the fact that he was still able to talk and yell her name could have made her think he was exaggerating. I'm just presenting a possible defense. She's definitely weird and not quite right in the head, but I don't think murder is the right charge here vs. manslaughter, and a lengthy punishment seems too excessive if it was just a drunken mistake and prank gone wrong.

She used this same tactic with the interrogating detectives.... Once they'd reached the end of their time together, she started demanding information about what to "plan on" or "work on", as a means to keep them talking. She keeps questioning people until she gets the answers she wants to hear, and I'm guessing that, for whatever reason, her attorney's conversation with her was long over.
@windywednesday4166
@windywednesday4166 Год назад
That's an interesting observation. Still, it doesn't explain the erratic behavior of her attorney.
@MacyMathildeMillicentMarceline
@@windywednesday4166 That's kind of what I'm leading into with that, yes, her attorney's actions may seem, superficially, unprofessional. But they may be a response to her giving few other options. For example, she may have crossed a line he warned her about, so he had to shut communication down. But, not being the kind to take no for an answer, she just kept pushing as though it had not happened, "What's next? What do I need to do now?" If she's already been told she will need to wait for a round of proceedings, there's nothing more to say to her, no matter how many times she asks, just like there was nothing more the detectives could say to her. I'm wondering if the lawyer's disappearance was to buy time for consultation, etc. But there have been so many attorneys before, the chances of this one just "coincidentally" behaving unusually seems unlikely.

If you watched her interrogation she swore on her sons life that she didn’t kill him and then they found video on her phone of him saying to her he can’t breathe in the suitcase and her saying well now you know how it feels when you cheat on me.

Wowza, Peter, this is *CRAZILY UNACCEPTABLE!* Her well-founded and well-documented frustrations jumped out of my screen and I felt it deeply. I cannot *even imagine* sitting in a cell this long with that minimal of contact. And yes, my immediate thought also was that he’s wanting to be fired. That’s pretty much crystal clear. Regardless, he should not be behaving this way, and I cannot believe this is been allowed to continue numerous months. Absurd! Unacceptable! Disrespectful of the judicial system! I mean, how can this even be? Can you tell I’m a tad upset? 😂 And yes, I’m afraid you’re right in that this whack attorney is gonna cause more delay. Unfortunately. Gee, thanks dude. Although she is presumed innocent and should be, it's worth noting the evidence against her clearly shows, regardless of a conviction, that her actions contributed directly to the death of Jorge. She also explicitly appears in the videos mocking a dying man. So I don't feel any empathy that she has been in jail so long. She could have at any point asserted speedy trial. Also, the family of the victim will never get to celebrate his birthdays with him now. I hope her attorney gets it together, so we don't have a colorable ineffective assistance of counsel claim.

Regarding the question (roughly 9:18) of whether a defendant should still have to go to trial even after admitting they've done it: my short rebuttal is "what about the possibility of a false confession?" Was the suspect coerced into giving that confession? Maybe when they confessed they were so out of it due to drugs or alcohol, they didn't know what was going on. Taking an admittedly extreme hypothetical - imagine a chronically depressed, bordering on suicidal, person or one with a terminal illness and only a few months or years left to live anyway taking the fall for a loved one facing a life sentence. I realize that mounting a defense after a person has confessed to a crime is more challenging, but there should still be an obligation for the prosecution to prove beyond a reasonable doubt.

I’m totally blind, and Apple’s screen reader doesn’t read everything on the screen. I know you can’t read everything out loud, but it really helps when you can. as far as Miss Boone goes, I agree with others. She is anything but likable, her letters are too wordy, and she is very probably guilty. However, she is entitled to fair counsel. I have to wonder, if this lawyer has so many other cases, how much time is he deliberately spending on them as compared with the amount of time he spending on her case?

If this has ever happened then what if anything can the prisoner get in retribution, if anything? Hope my question makes sense! I often wonder about ppl who spent time in jail (even years!) just to be released due to new evidence proving their innocent... their life was ruined... do they get compensation? Just curious!

Lindy Chamberlain was sentenced to life for the murder of her daughter. Hey Peter. I would love to have a conversation about what Society needs to do to better educate people when they're younger about how the law works and teaching your rights if you're ever in a position of being accused or suspected of a crime, if you witness a crime you know maybe it's a good idea to have knowledge of what to do and how to handle that, as well as what your role is as a juror and the importance of that. I know I have researched all this information I've watched shows I've followed the law but not everybody does and not everybody seems to be aware of how to handle certain things and I feel like that puts certain groups of people at a disadvantage that never get taught this information so I'd love for your perspective as a former you know criminal defense attorney to kind of go over what you feel like is missing in education because I think you should be taught all about that in Middle School and again in high school so that you're aware of the law and your rights as a citizen and your obligations as a citizen.

@rainydayrescue6160

Strictly as a reading comprehension exercise, I’m going with “people who don’t have access to robust civics education.” Therefore, “groups of people” would refer to those communities across the country that struggle to fund, meet and maintain quality performance metrics in their middle schools. It seems clear to me also that common knowledge regarding basic rights and lawfulness is becoming less common amongst the general public and poor understanding makes a person vulnerable to manipulation. (Example: Just look at all those super smart sovereign citizens who are so much smarter than the rest of us!) I see that Peter is involved and invested in providing accessible education to the public and developing young lawyers. I agree that there are important legal and civic topics that need to be addressed earlier and better in basic education, and these are important conversations to have.

Public defenders in my state barely speak to their clients as well. They hardly know their case. I remember I had to tell a public defender that they could just argue the fourth and fifth amendment and the client didn’t need to speak to anyone or allow them in her home. Because initially the public defender was trying to say that being noncompliant was a bad thing, she went up there and argued the fourth and fifth amendment and they closed the case because the mother did nothing wrong. She was initially trying to convince the client to speak with them and allow them in the home and to give them whatever they asked for which I thought was strange. In Sarah’s case, I’m not sure the attorney isn’t speaking to her at all. I believe that just like her interrogation, she’s the type of person that believes she can argue someone down until they finally give in. She thought she could convince those officers not to charge her if she just kept talking. I believe she wants to talk about irrelevant topics for long periods of time and nobody has time for that. She wants to be in total control of everything that’s happening and doesn’t even have an understanding of the law. I’m sure she believes she can get on that stand and convince all the jurors she’s innocent, as well. Not intentional means not guilty in her mind and she won’t accept anything less.
