Lousy Limo'ing 

The Judge doesn’t understand that some purchases are subject to processing time. It may be charged today and not clear for up to 72 hours. That doesn’t make the plaintiff a liar. 🙄

I definitely disagree with JM on this case. A McDonald’s charge doesn’t even go through the same day. Smh

It’s crazy how loud and wrong the judge was about the credit card posting date. I worked at a bank and it wasn’t abnormal to see a charge on one day as pending and then posts on another day especially if a purchase was made over the weekend.

Is Milian that ignorant of how banks work? Transactions after 5pm(Eastern) don't post until the next day and anything on the weekend doesn't post until Monday. This show took place Saturday 4-5-14 so it was absolutely paid that night but the date it posts in her account is 4-7. Plaintiff should have won this case. The gact that they even tried her card seems like a deliberate attempt to double dip.

Judge is wrong on some of this....I worked in banking for 19 years. When a company gets an approval from a customer account...it is approved to pay but the limo company can't take the money themselves....the approved withdrawal is done by the Federal Reserve and given to the company that got the approval on the card....so, basically when the balance reflected the money subtracted... that means they are paid. The 1-3 day lag on posting/withdrawing it is because it has to go through federal reserve. (If it was not done this way then that business would have access to that customer's account and that's not legal and vice versa if it was done this way she would have information on that limo companies account)

Sorry JM, I mega disagree with you on this one. Knowing the law but not knowing how banks work isn't working in your favor.

The judge got really loud about a detail and was wrong about all of it this time. I can't believe a grown woman, who talks about shopping often, would say she caught someone in a lie because she doesn't understand that purchases (especially on weekends) go through a few days after being charged.

How could she go through law school and not know about how banks work. I felt so sorry for the lady. I charge stuff on my card all the time and it doesn’t show up on my bank statement till a couple of days later. I wouldn’t go to people’s court her judgements are definitely wishy washey. I guess depending on how she feels that day.

I work at the bank. charges take at least 24 hours to process. That is common knowledge.

I'm really starting to believe Judge M has a bias against Black Women. This is not the 1st case, that she was out to lunch with her facts on a case involving a Black Woman. However, the Plantiff knew she was suppose to pay cash upfront, and should have requested a discount for the dents & scratches, paid upfront when the Driver arrived. The Plantiff submitted proof that the Limo Driver said the car was a lemon. If you work hard to pay for a Girl's Night Out & Limo, you deserve a nice Limo!!! In a previous case Judge M told a Black Woman whose Natural hair style was damaged, to just buy a wig. I wish Judge M would try to learn more about Black Culture or get off the bench.

What about them breaking the contract? They left them stranded and still got paid in full. And, your debit/credit cards can very well show pending or hold and it shows as if the charge was deducted... And a few hours to 24 hours later it reflects the transaction going through or not. And your transaction history will not reflect the pending or hold indicators once the transaction is finalized. The judge needs to do more research on that.

This was so hard to watch. I just don't understand how JM didn't understand how banking works. UGH!!!!! Hopefully she looks back and has learned something...my goodness!

Wait what? I'm so confused. So they don't go back to pick them up because of a misunderstanding and she gets $100 back? Poor plaintiff, it seems that she too was thrown off by Judge Millian's reaction toward the payment processing time. It seemed as if she was being truthful, I think the judges forget that most of us don't come to court every day!

Definitely disagree with this, the bank was authorizing her card for the 471 and it cleared whenever it did that's not her fault. Why would she see a pending charge and still go pay cash nah they need to wait for it to clear because they were the ones that was trying to charge her card in the first place

sorry but i have to disagree with the judy on this one. the reason being some credit cards and debit cards will mark a transaction as pending and sometimes the put the date it clears as the date it was paid. I only know this because i got into it with a utility company when they charged late fees even tho i submitted my payment on the due date and the bank had it pending and marked it paid to days later. the only thing that saved me was having the email reciept with the date paid.

The owner of the limo service or manager should have been in court with that driver. I felt bad for the guy he was so nervous he couldn't even stand still.😦

It sounds like the limo company put a hold on the plaintiff’s debit card that they planned to remove once they got their cash and when the plaintiff refused to hand over the cash they let the charge go through. This is why you don’t put your card down to “hold” anything unless you intend for that card to be your payment method for that transaction. These companies are determined to get their money from you one way or another.

Weekend charges don't post for the same date. From the info given this outing was the weekend so the charge won't show until Mondays business day. Plaintiff should have won more!!!

She said she had a limit of $50 which explains why the charges didn’t go through initially. Then she said the bank called her and she approved the charges. If the card was approved when the business tried to run it, then the business wouldn’t have continued to ask her for cash. Pending charges drop off all the time. It’s just a hold or pending charge until the charge is posted by the business via the merchant service provider. With that said, there’s a difference between approved/pending charges and declined charges. These charges were declined initially. If the charges were approved and posted, then she should be able to show that instead of emails about them attempting to charge her. It’s funny she mentioned the driver not asking her for cash up front too. I’d imagine that’s atypical for that type of business to take a cash payment from someone they don’t have a standing relationship with. It just seems like an opening to get burned after providing services. I’d imagine the driver may not have asked for cash at the beginning of the ride because he didn’t want to embarrass her in front of her friends as well. Whenever I’ve used a limo or car service I’ve paid upfront before seeing the vehicle. It’s not a taxi cab. Even with Uber/Lyft you pay upfront. A $500 limo ride doesn’t result in $2000 worth of damages either. She thinks the limo should pay for her concert tickets and $1400 for aggravation? 😂 Why not add pain and suffering? 😂 I wouldn’t send my nicest limo for a cash payer I wasn’t familiar with either. $500 seems cheap for a limo from 4:00 pm to 11:00 pm as well. Also, they got a ride from her house, to a restaurant, and to the concert venue. Anyone that can print out an email can just as easily print out a bank or credit card statement. Again, Its simple to prove that a charge posted. She didn’t have the proof she needed.

Think the plaintiff should have gotten back around half of the cost of the ride, so 250 or so. But her suing for 2000, with 1400 being just because is just greedy.

I agree with all the comments Judge M is wrong on this one she gets a little too ignorant at times with her attitude when she feels she is right; just because she is a judge doesn’t mean she can disrespect people. I would never come come to her court room. No ma’am!!

Before she makes a ruling Judge M. should learn about the banking rules. I have been in the banking industry for 15+ years and the plaintiff was correct the money shows pending (will be taken out of her balance) if it's over the weekend it will show as pending then will post on the following Monday. So that is what happened.

How does the judge not know how process time if works?

Credit Cards are different than debit cards some charges do take 72 hours to go through.

Hold up. Why does Milian keep pressing her about showing evidence, but then she asked the defendant and he ADMITS they received the payment. Why shouldn't she get at least half back when they didn't pick them up from the concert. If the issue was that they held funds until she paid cash, they should have explained that as soon as she paid cash, they would release the hold. She was concerned about double paying. Am I missing something?

I have a car payment that posted on Friday, but wasn't actually taken out til today. I understand what the plaintiff is saying.

Even though the limo company had this woman’s credit card she should’ve paid the cash and got a receipt from the driver. And the credit card charge could have been reversed/contested even if it did go through.

Why the hell would you see a limo in such horrible condition and still take it?

kinda feel bad for the plaintiff...I have multiple charges that clear days after the charge went through and reflect as such on my phone and paper statements... the only way I would be able to prove it is that I have text and email alerts set up for all my spending... but if she only has alerts for attempts then she's unfortunately SOL... that's a shame

Good! These people try to be over the top for a cheap concert. Trying to show out in a limo….typical! Go to a concert like normal people. I’m glad she only got $100. Even though it takes time to process a payment all the way through, it will still show pending at least right away. I think she was trying to look like she paid and contact the bank to reverse the charge.

I've had purchases pend for so long they fell off and had to be charged again (my credit union allows 7 days before they release the hold). Just because it hasn't posted doesn't mean it hasn't been charged to my account. There is a hold on that money that can be processed at any point. The judge is confusing pending and posting. Just because it took some time to post doesn't mean she wasn't charged. I certainly wouldn't have paid in cash after getting a charge alert. They charged her card for the money. No double dipping.

I agree with the Plaintiff, however, I don't think it was wise to try to collect for the concert tickets and aggravation. I would've asked for 50% back and settled.

Why didn’t she pay before being picked up? Then she would have had the limo guaranteed for the evening. I charged something today over the phone that won’t be delivered until Monday. As soon as I hung up, I checked my account. There was the charge with the word “pending” next to it, and my actual balance and my available balance were also listed. The difference between those two was the amount of the charge. What is so hard about that?? By Monday, the charge will have gone through and the balances will be the same. I think she wanted a free limo ride, but I would have been real ticked if he had driven off and left me stranded. I would have still paid for the limo, but he would have missed out on a tip. 20% for 471 dollars would be $94.20, rounded up to $100. Treat people who you hire for a service well, then you won’t end up in People’s Court! 😂👍🏻

JM may not understand this, but us Americans with average sized bank account and income know the anxiety of logging into your bank account to check and see what payments have gone through and how much money we have left haha

Judge milian got it wrong so wrong this time all the time I have money that comes out of my account on the day they attempt and it shows pending and then it goes to posted couple days later. She was so wrong on that one she doesn't understand that it can post one day but it was actually charged two days before

The bank thing is 100% NOT TRUE! The ledger sometimes show it as pending it then it’ll have the date the transaction posted and it’ll move to the next day. This has happened many times.

I can appreciate that different people handle nervousness in different ways. But swaying back & forth is quite annoying when the camera has to follow you.

For an important event, I would have paid for it with a cc, several days to a week in advance. "Did the cc go through tonight or do I need to pay cash" confusion could have easily been avoided.

Please be careful dealing with limo companies. The limo crash in Scharie Ny killed all 20 passengers because the car wasn’t maintained properly.

As a former teller. They probably charge her Friday and it didn't show because Saturday and Sunday does not count as business days. It does not matter is open on Saturdays. I want to know if JM ever found out she was wrong and correct things

I agree with the verdict. If the contract was for her to pay CASH💲 💵 for the service, then the driver should have been given the money upon arrival. If there was a problem with the service, then handle it with the company for some portion of a refund. If I'm paying cash then I don't provide credit card information.

She would have been better off prepaying for limo service to avoid interruption of limo service for rest of night. It would have been the same difference of ending up on PC, if limo company didn't deliver on obligation for the night or dented limo.

This judge is ridiculous. The limo got full payment and performed half the service. At the minimum she should have gotten half her ride back and the 100 for dents.

Charges stay pending for a day or two. It happens every time they charge your card as credit instead of debit.

Only $100.00. ? The radio didn't work, and she had to pay to get her group home. At a minimum $250.00. I thought you paid for a limo before they pick you up? 🤔

I KNOW you have ordered stuff online, have used a debit card or credit card so you KNOW DANG well that the payment DOESN'T post until the next day!!! The purchase will say pending until it clears but the money does come out of your account then and there. Judge Milian, Judge Milian you know that's wrong!!

The plaintiff, if she had online banking should have been able to prove that the payment went through on the same day

The judge should enlighten herself about somethings you can't be right all the time and you can't know everything

The charge did not go through THAT NIGHT. And that matters because that is what the plaintiff kept insisting! All plaintiff had to do was tell her bank, ‘No, don’t pay it; I’m paying cash.’ Because that was the deal.

Not disagreeing with anyone here because I know how most banks work but just wanted to say that it really does depend on the bank. My bank dates charges for when the purchases are actually made not when they clear regardless of how long they are pending. Personally I think the plaintiff or even the judge should have contacted the bank to find out whether they list payments based on the date of purchase or when the payment cleared. Would have been best for the plaintiff to have contacted them because then she could have brought in an email from them about this purchase specifically saying that the 7th was just the date it cleared if that was the case.

Especially on the weekends! It might not show processed until Tuesday or Wednesday. But the merchant's side still should say approved right away.

This was probably on the weekend. A lot of times banks change there processing time over the weekend.

I use limo services all the time and never had any problems...Only one overcharge and the limo company immediately credited my account.

Yup. Everyone’s agreeing that JM was wrong about the credit card charge. Anyone who uses a CC knows theirs the charge pending. It never goes completed the transaction the day of. So Plantiff was correct. It was charged on the 5th and posted on the 7th. Especially if it was a Saturday since banks don’t count Sunday as a business day, it’s always the following Monday.

PS- Judge didn’t call her a “liar” straight-up the way Mathis would have!! But still, the judge sounded confused & her questioning was all over the place! BUT Plaintiff did NOT have evidence of her card already being processed, which I would have asked for too as a judge! AND she still won, right!! Then she complained cuz she wanted to also win the $$ for her entire evening!! Lol!! Are u kidding me?? Really? If it was that bad?, where are the other folks that were with her? Surely their night was also ruined right?? Or is it cause she’s the one that probably “cheaped” out (like a lot of us do when we want to save a little$), but you get what you pay for & my guess is (just by the looks of the Defendant), his car co., isn’t exactly “first-class or top-notch”, so it couldn’t have been that important to her OR she wouldn’t have hired “Limos-r-us” for the night! True?? (This is always the golden rule- you get what you pay for!) 😂

The plaintiff was being ridiculous. She doesn't understand how this all works. The limo company required she put her card on file to secure the contract until she pays cash at the end. In her head, she didn't realize that meant they were going to put an authorization (a hold) on her account for funds. Businesses do this in case the customer ends up trying to stiff them on the cash. They would have released the hold once she paid the cash. This happens every single day in the business I work in too. There's no point to ask for a card to secure the contract if you're not going to put a hold on it. She saw them attempting to authorize her card and didn't allow the authorization. Instead, she argued with the driver, and didn't allow authorization until AFTER they told her they were not to go pick her up. The limo company was in the right to later convert the authorization into payment since they had already provided service and she broke the contract with her payment shenanigans. Their mistake was sending out the limo without having already gotten the authorization on her card first. That's just asking for trouble.

Every time I use my credit card, bank card or whatever, the charge shows up immediately. That's how it works.

The guy, Defendant, drove me crazy swaying back & forth. He made me dizzy.

A BAD JUDGEMENT! Judge, don't you understand that banks often only post payments Monday to Friday??? Of COURSE she paid that night. It makes ZERO sense that she would pay them after being abandoned!!!

Hopefully by now if they still in business they should have at least upgraded cars or close to it…
