The arbitration award of the International Arbitration Tribunal in 2016 is invalid and a complete joke. The so-called arbitration can only be initiated when both parties jointly request it. Arbitration is different from litigation. In 2016, the PRC and the ROC did not participate in the arbitration at all, did not provide evidence, and did not recognize the arbitration results at all. Moreover, the content of the arbitration is completely contrary to the facts, and Taiping Island is identified as a rocky reef. Taiping Island is the largest island in the Nansha Islands, with fresh water that can be directly drunk and huge trees, and even sheep, chickens, and residents. In summary, the 2016 arbitration is completely a piece of waste paper. The Philippines even paid the fees of both parties for this, which is ridiculous.
Enforcing it may lead to bloodshed and massacre. Question is are allies will aid us with their iron clad non sense. Our so called allies wanted to see first a proof (total massacre) before they act and that is if they will act.

We came into a staring contest, we blink and withdrew in 2012 and lost the territory, we go to arbitration and won. Now who’s going to enforce it…one question, is the arbitration even legal under UNCLOS, because when we ratify it, we choose voluntary arbitration in case of conflict and so is china.

Who's gonna enforce it? Most definitely the president of the country. But unfortunately he's the one who's been casting doubts on that legal document which in fact has been won by the nation in time of his full takeover in 2016. Now we've seen how he handles it like it's nothing, imagine how things might've changed if the arbitral decision was handed out earlier during the aquino admin's tenure 🤷🤷🤷
You and everybody can talk until you're blue in the face but the bottomline is bilateral agreement is the last resort. Why? 3 reasons. 1. China does not recognize theICC, the are not a member. 2. China didn't cooperate/participate in the Hague tribunal arbitration thus disqualifying the ruling as the requirements of an arbitration was not fulfilled in the first place. 3. More importantly, there is no international entity who has the jurisdiction to enforce the ruling. A court with no police power is useless.
The Arbitration Ruling can now be used as a basis to go to the next step - which is to encourage military buildup in the region. The ruling should pave the way to increase military maneuvers in the waterway among the military alliance partners. We now have a legal basis for any military objectives.
