This isn't a trial! The same rules and processes do not apply. The attorneys are presenting information for the judges to decide if a 15 year old can be sentenced to life. He already pled guilty but a Miller hearing is pre sentence when the prosecutor wants to go against the Supreme Court ruling that teens can't be given life sentences.

I understand why defense attorneys have a job-but for them to even question her is beyond me! Do they want to traumatize her further? She was shot! Why even do that to her?!?!?

Exactly it's unclear why the defense would question her whatsoever. It's very clear what Ethan did, it's very clear she is a victim. The defense attorney might as well ask someone walking down the street how they would feel as a parent with a kid like ethan. This witness is not there to talk about that.

Heart breaking for Molly right now. Disgusting behaviour from the defence attorney, she doesnt, and shouldnt give a s**t about HIS rehabilitation. He tried to murder her, she must be absolutely terrified sitting there with him a few feet away. She did so good, such a brave woman.

Because she was a moron quite frankly. None of the other lawyers waffled on or treated witnesses like her. I was disgusted too. She did it at another time to a policeman who was an evidence tech and started asking him questions about child abuse.

During this whole thing I knew I couldn’t stand that one defense lady. I’m not one to judge defense attorneys bc I understand that they have a job and need to do it well , but that lady is sick. Even the look on the other defense lady’s face was very telling and I think she was just wishing for it to be over. Anytime a victim is on the stand I have noticed she doesn’t cross examine them.

My god… the way that the lawyer asked those questions….. I just have to save to the victim on the stand, I am so sorry that this person subjected you to some of these questions and how she did it was so uncompassionate…. I wish I could give her a hug

Why are the defense attorneys asking questions from witnesses who are not experts in the field. Ask them about their specific reason for being there. This witness had one role and one thing to talk about, being shot. If you want to know about mandatory reporting and those factors bring in an untraumatized expert... like any other teacher or maybe one who actually knows this kid. Heartless person. That will not endear the jury towards this kid. Unless they're trying to ensure an appeal later on for incompetent counsel.

a defense attorney might want to ask a teacher in a school in which a student went mad, shooting up the place, whether teachers ordinarily are expected to report signs of that student going mad, whether or not they taught that particular student, to show the jury (or the audience) that (a) had the teachers who did have contact with him don anything about it, the shooting might have been prevented, and that therefore (b) the school teachers are just as at fault for being stupid or ignorant as his parents, because teachers are "in loco parentis" when a minor is under their supervision. It was interesting that this teacher reacted badly to being asked impersonal questions, perhaps because she feels guilt by association that the school had done nothing, or perhaps because she feels guilt for having lived when others died, or perhaps, more simply, because she doesn't feel guilt, because for her, it's all about her..

Wow. Awaiting the parents trial. More alleged details of them are coming out here through defense questioning. I watched the appeal hearing for the parents and prior neglect at a younger age was not brought up.

This judge is great, the lady prosecutor seems a genuinely caring lady infact all the prosecution do like it obviously genuinely affects them to see the victims essentially re-victimised by the defense to the point of pleading and tears. I like that the lady prosecutor went to get the victim from the stand and left with her from the court room classy caring and powerful move. This hearing although awful to hear and bare witness too, but a great example of prosecution and judicial work.

The line of questioning by the defense is not gaining sympathy for their client, if anything it comes across as insensitive to a victim. No questions about what happened or interaction with the defendant just hypotheticals.

This hearing is to determine how harsh the sentence for the admitted killer should be given that he was a juvenile at the time of the shootings. His defense is advocating for life with possibly parole. Prosecutors are advocating for life without any parole. Prosecutors win this thank God! No parole. This guy cannot be rehabilitated.

I cannot imagine receiving a call from my husband that he had been shot and that he was unsafe and alone. I don’t know that I wouldn’t have done the exact same thing. He likely went into shock as she did- he was powerless doing what he thought would keep her safe. I’m sure he regrets how he handled it too. 😕

Difficult to Fathom what on Earth this defense lawyer is thinking asking these irrelevant, ridiculous questions of this witness. Asking what she would have done as a parent with a kid like Ethan? What the hell does that have to do with anything??She is a victim and a witness to the event. Please put this clueless, slow-talking "attorney" in another room, give her some fruit loops and put on some simple-minded TV for her to stare at.

Her cross examination questions are terrible and not appropriatly constructed for the victim. All she had to do was ask if she knew the defendant or applied services to him in yes or no questions. If no for both then move on. Hard pressing specifics including proressional background afterward is uncalled for and henious to a PTSD victim.

This is a prime example of why defense attorney's in high profile cases usually get a lot of hate. We all know that everyone is entitled to due process. And that defense attorneys are just doing their job but the way some of them act is infuriating. They seem to take on their client's villain role.

I truly believe his mom never loved him. The lack of affection and care from anyone as an infant is so damaging! I really don’t understand when someone doesn’t want a child so badly that they don’t give them up for adoption. I believe his parents informed him daily that he wasn’t wanted and was a burden while they spent $1500-2000 on their horses monthly. Clearly love is a huge component to the well being of our race. Listening to the details he was so messed up from the lack of love in his life and mostly his infant years; he wanted others (the bird) to feel the pain he endured and could do nothing to protect himself. Obviously the pain he felt as an infant doesn’t appear to be physical. But the lack of touch and comfort must be crippling! The children he took out his anger and jealousy on at least have peace and love in Heaven. My love goes out to the families who have lost due to this tragedy and are still suffering. ❤❤😔

Michigan doesn't have the death penalty. Also, something people aren't aware of, is prisoners with death sentences are given far more privileges than regular prisoners. Death penalty inmates cost tax payers MORE than regular inmates, because of the services they're offered. Even the trials cost more! There are 11 death penalty states that haven't executed anyone in at least 10 years. (California last did one in Jan 2006!) The company that was making one of the ingredients of the lethal injection cocktail stopped making the ingredient as a personal stand against lethal injection. They try to keep them calm and almost baby them compared to other inmates, because it's stressful being on death row. Sometimes they're on death row for 10 years or more. -They're allowed legal material and can challenge (appeal) their sentence multiple times. -They get a private cell -They can have personal items and pictures - They get private time outside. -They can have items most other inmates cannot -- access to music, entertainment, etc Putting someone on death row isn't an instant death. Imagine if you were put on death row and knew you were innocent? You have the chance and time to appeal it. The sentences can also be pardoned by state and government officials.

Michigan has no death penalty but if he raised a gun at cops he should already be dead and saved us the money. Life without parole is expensive but worth it in this case.

I feel sorry for the teacher being a victim and being badgered by the defense. However, as a retired Michigan teacher I am shocked that she does not know how mandatory reporting works. That is a failure of the school and their staff training.

That’s a pretty harsh judgement to make on her whole school and staff training. She was shaken and unprepared for those types of questions (because they shouldn’t have been asked of her as a victim). She even struggled to answer what age middle schoolers are. I’m sure she could answer the questions easily in a regular setting.

@@replyhazy I realize she was under stress and I am not blaming her for her lack of knowledge. I'm saying as a teacher the response to having a child report abuse is ingrained in me because our district brought it up at least once every year. Even after being retired for 5 years I can still tell you it is form 3200. Simple answer is "report it to the administrator and discuss if report needs to be filed".

All these shooting! we only had one school shooting here in canada back in the late 80's we have such tough laws for anyone to own a gun! come on America get more tougher gun law! you are a great country! ok that is a bit pushing it but come on! rip to the victims I cannot imagine the pain of their families.

Everyone seems concerned about the witness, but unfortunately even children have to testify about terrible things they were victim too, and in this case - she is also a Mandated Reporter - she has a Duty to Report neglect, and the culture to do that or 'have to think about it' is relevant

No it s not. She was there to testify about her experience being a victim. Mandatory reporters are only required to report certain types of more serious abuse. It was disgusting and unethical to start treating her like an expert education witness at this hearing. She is a traumatised victim staring at the person who tried to kill her. It was professional misconduct in my opinion. If the defence wanted the answers she sought about mandatory reporting and how abusive the shooters parents clearly were, she should have brought another more appropriate witness in to adduce that evidence.
