My former emoloyer, a large company with £500 million turnover, sent me a formal trespass letter from one of their branches after i resigned. They state that the police will be asked to remove me.... I haven't broken the bad news to them yet 😂

Trespass is being on land or property without the owners permission, so they are not just walking around, they are trespassing (and an open gate is not an invite either).

Keep in mind that, in most cases, trespass is not a criminal offence, though legal action can be taken both for and against trespassers, depending on certain circumstances of the transgression.

​@tonyb1223 there are implied rights of access, like when you go shopping on the High Street you don't need every stores permission to enter- the right of access is implied. You don't need to ask property owners permission to put takeaway leaflets through people's doors, an unlocked gate (and lack of signage) is an implied right of access. But it can be revoked, which is property owners right of course. And if you have a property you want to be private, you can lock your gate to remove the implied right of access, or do it verbally or with signage.

@@tonyb1223 well if going down this route , there is NO SUCH THING AS TRESPASS. you have to be trespassing with intent or similar, yo ucannto be done for jus ta trespassing.. now looking for a way into the building i.e reception is not trespassing, plus there needs to be a sign t osay keep out or private property etc. and with such large gates being left open then it would seem t oanyone with half a brain that yo ucould walk in and go to reception or try and find reception etc.... and its a civil matter and no judge in teh land would of said this man is guilty of trespassing with intent of anything.

Trespass is a LAW in the UK, to trespass all you need to do is enter that property or land with no prior invitation, that means a reception at a private business is not an invite to enter unless they have specifically requested that you be there, either in writing or verbally. As for the requirement for signs, nope, again you got that wrong, there is no legal requirement to place any signs up for trespass, not one. Below is an extract from one of many solicitors who deal with trespass, they all basically say the same thing. Trespass is the wrong (known as a tort in legal terminology) of illegally entering another person's property. In some cases, the act of entering the property may have been lawful if permission was given originally, but subsequently become trespass if that permission ends or is withdrawn. The word trespass covers much more than people usually realise. All land in the UK belongs to someone. It also protects NA if any of them did decide to sue privately for trespass. He leaves when asked, he only hangs around when they're engaging him in conversation, they're only on camera if they choose to be. He is polite, doesn't damage anything (except their ego) so they would never win if they did try it on in court.

Nope, the reception is there for visitors who are booked in on site, or for those given an implied right of access like a postman or delivery, just walking on to a site is actual trespass as they have no permission from the owner, that is the difference.

@@tonyb1223 If the gates are open, I am quite entitled to walk to the reception to make enquiries ie Job availability, making deliveries etc. unless it is clearly stated on a notice otherwise.

@@stevebird7265 I have already covered deliveries, jobs are dealt with by HR, not the reception so you won't be allowed on for that, they will point you to their website and tell you to leave their property as you are trespassing, it is that simple (and if you have figured out that for the last 30 years, jobs have been posted on the internet by companies, there is NO need to go to their reception, or enter their property), and you are not entitled to enter if their gates are open, it doesn't work that way, it's like saying a burglar can enter your property because you left the window open and have no other consequences from it.
