Maybe you can consider the adding the exchange w/ socal approach, pilot's "attempts" to contact tower and calibrated ADSB to include more context.

What the hell was this pilot thinking? You don't address the tower as "Buddy" or "Johnny". FAA regs clearly state that you must use "Ace", "Slick" or "Champ".

When I was flying my first cross-country solo from KBKV to KFMY, I picked up flight following in Tampa, and the controller directed me to stay outside the Bravo along the coast, which I acknowledged and tried to do. At one point, though, I slipped in a little bit, and I got a call that I was inside the Bravo airspace. You know what I told that controller, bustin' my balls for being just a little tiny bit inside the Bravo? I said, "Oh, very sorry about that, turning to 210" (or whatever vector got me out quickly). You know what she said instead of, "I have a phone number for you?" She just said, "no worries!" Amazing what a little civility and humility can do for you.

Yeah I really don't think this pilot would have had any real issues if he wasn't a dick about it. Some people don't know when to stop digging the hole. Even beyond the antagonistic nature of the tone and reply, it also communicated a perceived lack of importance in the rules, something that would certainly make any air traffic controller, someone whom is enforcing those rules in order to keep people alive its worth noting, get their hackles up.

Yep. Pilot was in the wrong 100% but would rather barge into the Delta and then cop an attitude about it. We all see where that got him. I’d love to hear the phone audio.

if the first words out of that controllers mouth was not crying ONLY over being in D-AS but immediate instructions to the pilot they were in D-AS with no contact AND a vector/direction on how to evac it safely, in this case a go around? The whole incident might have been avoided possibly? "inbound to land" tbh last thing I want to hear is a controller 'only' crying at me but actual instructions.

This is my home drome. Tower personnel have been great and usually very accommodating. Not sure what's up with this pilot, but his attitude did him no favors.

@@martintheiss4038 Brainstorm this on your own for a bit. What could go wrong with one plane in the airspace not talking to tower? And not just hovering around the edge...but entering the pattern without established comms and instructions.

@@dmstevens87 This would be the instructor. He is the one directing her to fly, or commanding, which may change the way flights are logged. She would be interviewed by investigators if action was taken. This could lead to even more trouble for the instructor.

0:30 "I DON'T CARE if it's 10 calls..." is what ATC said. Prior to that, the pilot said, "We were handed off from Socal and you were prioritizing people on the ground, and that was our 5th call." Basically, the pilot is stating that they were trying to call and ATC wasn't responding, so they continued on their track inbound for the airport. ATC's point is that regardless of the tower being busy, they shouldn't have entered the Class D without first establishing comms with the tower.

By regulation this is absolutely correct. Set up a hold at a safe location outside of the delta until they respond. If need be, contact SoCal and inform them that attempts to contact tower have been unsuccessful, and see if they can call up tower and resolve the issue. But DO NOT enter the delta until two way communications have been established. A cold call with a response absent a "remain clear" instruction is all that is needed.

Unanswered calls that require an answer are considered as not transmitted in aviation. Thats part of why we have readbacks as well. So if you call and he doesnt answer you might as well treat it as if you had been on wrong frequency or if you didnt press your radio button or whatever. It's irrelevant.

I actually wrote to the FAA chief counsel a while back about a similar hypothetical in which Center didn’t hand a pilot off to Approach before they entered Class C, and whether that would still be a violation on the pilot’s part. Their answer was yes, it’s your job to talk to the right facility, even if the prior controller doesn’t transfer you in time-but they also added that ATC’s actions could be a mitigating factor when assessing any penalty. I didn’t enquirer as to whether being a smart ass with the controller would help at all…

My hypothetical was prompted by a situation where I was receiving flight following and then Center announced just outside the Class C that they couldn’t get me a hand off and dumped me literally tens of seconds from the boundary of the airspace. I had to crank it round to avoid entering, and luckily I had GPS so I knew exactly where the border was located. Now, this guy obviously got a lot closer and ended up on downwind, so it’s not quite the same, but failed hand offs can sometimes put pilots in tight corners with few good options.

@@MikeGranby In my experience, if you're with an ARTCC on flight following/practicing approaches, they'll have you squawk a code. The tower I operate out of is pretty understanding with late switches, so long as you're not just squawking VFR, as then they already know you're intending to come in and land. But it never hurts to prompt center with a "would you like me to contact tower now?" as you're approaching the airspace.

What would be the case if the pilot was to switch to the appropriate frequency, but due to being stepped on, or some situation such as an emergency in progress, the pilot was unable to get a word in to the controller. Should the pilot adjust their heading to stay out of that airspace until they've established contact? Or should they stay on their present heading, into the airspace with which they haven't talked to the controller yet?

I know this pilot and he’s keeping GA alive at KFUL. The amount of money he brings to the airport they should give him priority over everyone… millions of dollars a year. He’s the kind of guy that loses his sandals when running to put out planes on fire… I’ve seen it. Everyone has bad days and this controller was on a power trip. Getting a handoff at Fullerton from SLI he’s already in FUL airspace (it’s not charted but their airspace overlaps.) The controller was in the wrong here but the pilots attitude didn’t help.

When calling the tower - unless he calls you "by name" (tail number) - you are not cleared into "his" airspace - even if the tower says "aircraft calling - stand by" - you have not been called "by name" - thus you are to remain clear. That's what I was taught anyway - and that would not even fly (forgive the pun) in class Bravo Airspace. Many of the airports around the Phx., AZ area are very busy - and it simply may take more than 5 tries - and sometimes radio traffic is so busy - people are continuously "stepping on you" (radio traffic wise)....

@@pilotdane1 bravo is different you need explicit permission and same thing with a class Charlie. Delta's you just need two way radio comms. I actually had to tell someone remain outside the delta last. The 7110.65 has specific phraseology for it for that reason. But for anything else that's a good rule of thumb and probably a good rule to use in general.

During a training flight I errantly crossed into L.A. class B. ATC sternly told me NOT to enter further. After I got my sh&t back together I fixed the issue. He was stern, but the error was mine and I accepted that. It got no worse from there. A little humility and respect saved the day for me. 👍🏾

Normally, depending on staffing, the controller involved won't be the controller on the phone. That's usually a supervisor or controller-in-charge.

one thing I've learned in my pilot training: if you mess up and tower calls you out, NEVER get defensive. When tower says he's "trying to smooth it out" I'm willing to bet there's a reasonable chance the pilot would get away with a stern talking-to if he's respectful and is ready to work with the tower. If you get defensive like that you're just digging yourself into a deeper hole.

Yeah, let me just get aggressive with the controller of the airspace I just busted on purpose, that will work out well. I don’t understand some people’s logic. Never expect to be cleared into an airspace, always have a back-up plan. This is student pilot level knowledge, any pilot should never treat a controller that way.

So I’m not a pilot just (maybe some day when the money is available) an aviation enthusiast so I watch and read a ton of aviation related content. It seems to me that the smallest plane flying private pilots license guys are always the most entitled.

@@bleedthebeat1 Honestly, not always. I’ve met guys with 100hrs as well as guys who stopped counting after 15,000, in either case were entitled “pilots” and guys who were extremely humble. I would say that the humble make it in this industry above all, which is wonderful to see. But unfortunately (or fortunately for the entertainment value), the entitled mainly show up on this channel.

@@thereissomecoolstuff We don’t know the previous interactions but I have been denied three times by a D airspace for entry in one flight and remained outside nonetheless. It is illegal to not do so, unless it is an emergency. So under those circumstances, (requesting and being denied or ignored), yes I think the pilot is in the wrong. Why do you disagree?

"You were prioritizing planes on the ground ahead of us..." Clearly that was ONLY because the controller, who has knowledge of the situation on the field that you couldn't possibly possess, was unaware of how incredibly important you are, Mr. CFI. When I was learning, a lot of the time there was one controller to manage both twr and gnd freqs, and you heard the gnd calls on the twr freq because of that. I was always impressed at the ability of the controller to herd the cats safely and efficiently. I heartily agree with those comments about the student needing to seek out a new CFI. This one is too self-important to put the needs of the student first, which is exactly where the needs of a paying student should be positioned. If I was the controller, I might be tempted to place a call to the flight school that employed this guy.

When approach control gives you a very late hand-off to tower, be prepared to do 360's if the tower doesn't answer quickly. Better yet, be pro-active with approach, "Airport in sight" or "May I switch to tower now". Get 'er done early to avoid this situation. When you're flying 3 miles per minute, one little delay can ruin your day.

This is not the case in the U.S., rules strictly say that communication with ATC must be established. Approach and Center are also ATC. For example, you talked to approach and squawking, or you are IFR, sometimes handed over to tower on a very short final. This is not comfortable / standard and results in late clearance to land (and tower holding other traffic), but happens from day to day (and not a violation).

Each person must establish two-way radio communications with the ATC facility (including foreign ATC in the case of foreign airspace designated in the United States) providing air traffic services prior to entering that airspace and thereafter maintain those communications while within that airspace. "...providing air traffic control services prior to entering THAT airspace." Pretty sure that means TOWER.

Here is something for discussion amongst us and the CFI's in the group wit there PPL students - OK so doing a little investigation and assuming this is the flight from 9/29 -- doesn't look like this was a "instructional" flight but a trip to the beach to look at the surf. According to FlightAware, he was pretty low the entire time, often below 1000 AGL over populated areas - that's another issue unto itself - he left FUL flew to the beach through Los Alamito's DELTA, came back through Los Al's DELTA and into FUL DELTA. Now here is the problem that doesn't occur too often, except when controlled airports are right next to each other, but Los Als DELTA and FUL's DELAT bump up against each other along with LGB, so if there is no handoff from Los Al to FUL there is really no place for the guy to go EXCEPT to climb ABOVE the DELTA at 2,500 feet or to exit the DELTA to the southeast, but the you have the Mickey Mouse TFR to fly through. Looking at the ATIS for that time frame, he could have climbed to 2,500 and held waiting clearence.

There are a bunch of other deltas in close proximity to my home airport, plus a bravo shelf overlying all of them, they're all clearly marked on the sectional. It behooves every pilot to do a little planning in complex airspace, there's no excuse for not doing so.

I once ever so slightly clipped class B out of Gillespie. I asked for a transponder code on the ground and was denied. Upon takeoff, I asked again and was denied. I’m VFR only and was going eastbound and their were low clouds against the mountains. I called Approach several times and got no answer. Later, I was told to call a number. Nothing became of it, but next time I will be prepared. I will circle above Gillespie in their airspace until I get what I need. That way I will be legal and the tower will be motivated to help. It was a no win situation. And the controllers have no idea of some of the impossible situations they sometimes put pilots in.

Used to fly through FUL airspace all the time. They were contract controllers then but never had any problems. It’s busy airspace with a lot of flight instructions going on so you gotta stay on your toes. Learned to fly out of LGB so most airspace doesn’t even faze me.

I was a student pilot when I had failure on one of my radios, I couldn't listen to the KMYF's ATIS, then suddenly I realized that I was at the border of the Delta, I made a 360 towards KSEE. When I contacted twr, she reminded me about 2way comm, I explained what happened, and saw my 360, and gave me clearance to land. No phone number to copy, punks.

Maybe he's smarter than all of us and it somehow makes sense that: If a controller is really busy with others, that logically must mean that it's really safe airspace to bust into unannounced... The thought process of some people... I think I understand his point, he thought that since he was forced to wait out and just couldn't get clearance before, somehow he should be allowed to proceed because 'it's not his fault'. But he obviously made a big error in judgment, thinking this is all about his convenience and that everyone is there to serve his not having to possibly wait outside Delta as long as others are attended to first. I'm wondering, if TWR would've been busy for longer would the pilot have just landed and radioed in later while taxiing, complaining that "I couldn't call in earlier because you were too busy with others, it's your fault!"

I am not a pilot. But he said he was handed off into that airspace by the controller in adjacent airspace. How can he be sure that it is OK to do 360's in the prior airspace? Should he go back to their frequency and say "unable to establish communication with next airspace, can I do some 360's in your airspace for a bit?" And other commenters are saying the adjacent airspace he was exiting is also class d. I don't know. It seems to me that the pilot was put in an impossible position, transitioning from one class D to another, and the class D he was entering was not responsive. I can see how if you were entering delta airspace from less restricted airspace it makes sense to do 360's. But (according to comments) that is not what happened here.

@@mckenziekeith7434 The controllers all have the airspace boundaries on their scopes, and the center controller knows communications need to be established prior to entry into the Class D (tower) airspace. An airplane holding just outside the Class D would not pose a problem for the center controller, and depending on exactly when the handoff occurred, there may not be time for that request. The proper procedure would be to enter the hold and then advise center what is happening so that they could coordinate with the tower controller if necessary. It's interesting to note that if this same scenario played out but with Class B airspace, the pilot would have likely acted differently. For some reason people don't respect Class D rules as much.

The CFI may of been Phillip Stocks. He is a very aggressive CFI that yells at his students, shames them. I am a low hour student pilot at Fullerton and I had this CFI and it was terrible. He yelled at me and even yelled at the tower one time. The flight school fired him.

Most comments here assume that the pilot has broken a reg. Before jumping to that conclusion, I would want to discuss the language in CFR 91.129 (c) (1) for arrival or through flights in class D airspace. It states "Each person must establish two-way radio communication with the ATC facility providing air traffic services prior to entering that airspace"... etc. If the approach controller (prior to the tower) handling the aircraft waited until N733ZY was in the D before transferring frequencies, they would have been an ATC facility providing air traffic services in that airspace. Even though the tower hadn't had time to reach out, N733ZY was always available for two-way communication, and they had it prior to entering to satisfy the reg. That could be why they entered the downwind as that's what they were asked to fly.

One could be forgiven for coming up with conspiracy theory-esque explanations ... E.g. the Earth passed through some sort of cometary debris field or something earlier in the year, and that material entered the atmosphere and then the drinking water supply, and somehow this has affected the ability of private pilots to stay out of restricted airspace unless cleared otherwise. It's as good an explanation as any other at this time.

Odds are he is working clearance, ground, and local by himself, tying the frequencies up so the inbound couldn't make the initial call. I will agree that the pilot should had hung out just outside of the Class D vs. just driving in and maybe saying I've been trying to call but you had the frequency tied up.

Yeah, the captions on this channel are often quite inaccurate. Sometimes it doesn't make a huge amount of difference (I recall one where a pilot who was returning to an airport said they needed time to "run some checks" and it was captioned as "burn some gas"), but sometimes, it completely changes the meaning, just like this one.

I'm not a pilot, but I think an airspace violation is against federal aviation regulations, and is then the air traffic controller's decision to report the violation to the FAA, depending on the severity of the violation... I'd imagine something like a minor error on the part of the pilot is probably not something the ATC would automatically have to report, but since the pilot came off as ignorant or arrogant, the ATC probably had no intention of letting the guy off with just a warning...

The pilot clearly stated that he had been trying and that the controller appeared to be busy with ground. Besides that you CAN enter class D airspace in some instances, I live and operate inside class D airspace and we have multiple entry points that are radio gratis, of course it is always good form to call in however I have had the exact scenario and the opposite reaction from tower!

To the people saying it doesn’t matter if approach/center didn’t hand you over, it does. My home airport is a Delta and sometimes SL Approach gets busy and doesn’t toss me over before the FAF. You politely tell them you’re closing in on the airspace, they clear you to talk to tower, it is really a 10 second interaction you’re responsible to do…

It is actually hard to tell who is a fault from just this audio. If that pilot had been given a code by socal and was not just 1200 VFR, they had established 2 way by the correct authority, because SoCal does have the authority to enter you into airspaces, then it could have been the controller who was actually at fault. You don't always talk to the tower when going through an airspace. We really need to know if this plane was squawking with an assigned code and was on flight following or if they had been approved to enter by socal. Either way the second pilot who talks handled it the exact wrong way. Even if a tower ignores you for 10 minutes, you gotta stay clear until they acknowledge you. And never get rude first. That being said I have had controllers be rude with me when they screwed up and I made sure to say that they screwed up so that it was on the recording if anyone, ie the FAA, went backed and listened. But I've only ever had that happen twice. For the vast majority controllers are your friends and are very reasonable.

It seemed like the controller was the belligerent one, if I were the pilot, I would send this recording to the FAA to report the controller. The response to "...what would like like us to do now?" should not be "I'd like you not to be aggressive...". The pilot on the radio definitely did not sound aggressive, only the controller had that tone. I've dealt with controllers handling both ground and tower before who were also pretty aggressive in their tone, definitely should not get promoted to Class "B" if that's how they handle things under stress.

Things could have gone better if the instructor was nicer when explaining his mistake. But ultimately 5th call or 50th you keep circling outside the delta until two comms are established

It also could have gone better if the instructor wasn't an absolute douchebag completely controlled by his huge ego. Nevermind the fact that a CFI who doesn't understand that you cannot enter class D without a clearance should not be teaching anyone because he (apparently) doesn't have the understanding of the subject in his own mind to be prepared or qualified to teach another.

@@KiithnarasAshaa If you are starting to approach the point where running out of fuel is in your near future because a tower wont respond to let you into their airspace it is time to go ANYWHERE else. It's not like this guy had just re-entered the atmosphere in the Space Shuttle and just had to land there. He was VFR. If you cannot establish two-way comms with a tower, you have to stay out. "Officer, I ran that red light because I was low on fuel" doesn't cut it in a car or in an airplane. ;)

@@KiithnarasAshaa You don't squawk 7600 unless you lose comms. He didn't lose his comms. He lost his calm. And if you do actually lose your radios while VFR the first thing to do is to go to an uncontrolled field if you can. Also, if you lose comms and squawk 7600 that still doesn't give you permission to straight-up bust class D like you own it. You need to look for light gun signals and act like you care about fitting into traffic and act like you care about doing the right thing. The CFI's egomania would have interfered with this because the guy thinks he is #1.

pilots unless they declare an emergency should not be instructing the ATC about runway situations. Emergencies happen, yes, but not as a means to handle a possible deviation of the basic rules of airmen.

If my understanding is correct, ATCs have lists of flights in their airspace and have to manage them so that they are at safe distances. Distances are more than just physical distances since a flying aircraft causes a turbulence in the air, which can interfere with the balancing forces which pilots need maintain to control their aircrafts safely. To ensure safe distances, landing aircrafts have to "queue" to land. Interrupting the queue without informing ATCs is just like throwing a spanner into their system.

The key complaint here is that the pilots crashed into a low altitude zone of exclusion that is meant to create a space of air which is designated as "airport control only" and the ATC is saying that there was no positive communication before the entry which indicated the ATC confirmed that the designated airspace was in a state of preparedness for another aircraft to fly in and set up to land. Think of it as a parking lot that has a certain limit of vehicles that can enter and this plane decided to enter the parking lot without verifying that enough spaces were clear in order to safely park up.

Snarky pilot. Being frustrated is not an excuse to bust airspace. His only play: “i declared an emergency, due to fuel exhaustion. You were too busy yammering to receive my emergency declaration, but it is an emergency nonetheless, and I am covered by 91.3b. “ A lot of guys mistakenly believe some ATC person must acknowledge your declaration of emergency. That line of reasoning doesn’t hold up. Similarly, I’ve cancelled IFR in the blind, switching to 1200 and landing at an uncontrolled field, when ATC was too jammed up to clear me for visual. Even if nobody heard it fall, a tree that falls in the forest still falls, and stays down. I did, however contact FSS after landing and have them verify that ATC had my IFR plan closed.

I think both the pilot and controller are at fault here. The pilot was wrong in not getting clearance, and the controller is being too sensitive. An ATC professional should disregard "a tone" of voice, just like a police officer should when giving out a traffic ticket. Save the lecture for the phone call later. It doesn't help any situation and just causes escalation.

My aircrafts alternator failed at dusk leaving me with no lights or radio seconds before entering a class D. I was low on fuel so I considered it an emergency and visually cleared the airspace and entered a downwind looking for a green light from the tower. Full pattern , no lights. No other aircraft in the pattern so I safely landed. An official truck pulled up with a “ phone number”. When I called youd’ve thought I’d insulted the tower guys mother the way he spoke to me. After I explained I my electrical system had failed he still insisted I “ should’ve landed somewhere else”. I told him I had a five thousand foot runway 6 miles in front of my sick airplane With no traffic, somewhere else would not be wise aaand where were my light signals? I think he realized any report would have included “ never received light signals” so the matter was dropped.

Yup. For the better or worse - Mid-air collisions of any kind usually result in total loss of both aircraft regardless of their size difference (A C-172 hitting a B-747 can easily take the latter out of the sky with it), so at least that doesn't happen, to the best of my knowledge.

Seems there might be more to the story than first appears. It certainly doesn’t smell right. Tower: “Cessna 3ZY, you can’t come into the Delta airspace unless you’re talking to me.” CFI? In N733ZY: “Hey we were handed off from SoCal(?) and you’ve been prioritizing people on the ground so we have … that was our fifth call.” The regulations are not entirely clear that the tower was correct. From 14 CFR 91.129 “Operations in Class D Airspace”: “(c) Communications. Each person operating an aircraft in Class D airspace must meet the fol­lowing two-­way radio communications requirements: (1) Arrival or through flight. Each person must establish two­way radio communications with the ATC facility (including foreign ATC in the case of foreign airspace designated in the United States) *providing air traffic services prior to entering that airspace* and thereafter maintain those communications while within that airspace.” It seems like N733ZY was communicating with air traffic services (SoCall approach), if not Fullerton Tower. This usually isn’t a problem Tower most likely was given the handoff from SoCal approach, although it may be a turf war between the two facilities bled over into projecting it onto this training flight. I sympathize with the instructor, and while not entirely agreeing with his ‘aggressive tone’ (seriously, Fullerton Tower?) I’ve been there. Seeming occurrence: 3ZY was handed off from SoCal approach to Fullerton tower while en route to Fullerton. When switching freqs , 3ZY made five position reports to Fullerton Tower while continuing the VFR arrival, waiting for Tower to respond. If THAT’s how it went down, then Tower-while maybe factually correct-may actually be in the wrong here, and ironically is the actual aggressive tone violator. If the CFI exaggerated or flat-out lied then he should get every butthurt the FAA is going to send his way.

by the letter of the FARs. It doesn't matter if that pilot made 30 calls. You can't enter class D airspace without positive two way communication being established. The pilot was in the wrong. Busting airspace and then being a jerk about it won't fix the problem but it will get you a trip to the FSDO.

@@davidlambert3892 Everything major airport has a cone that extends up and out to around 10,000 ft. This is highly controlled airspace that aircraft are not allowed to enter unless they have permission from ATC and follow instructions. Breaching this airspace will get you reported to the FAA.

@@davidlambert3892 Bravo (Class B) is the airspace immediately around very large commercial airports. It's the most tightly controlled airspace that pilots will encounter with frequency, besides TFR's (temporary flight restrictions). Class B has very tight control and very stiff response for violation, because accidents in Class B result in headlines and hundreds of deaths.
