The issue is the targeted nature of this release. What was the response to his emails? There’s thousands of emails not being shown the light of day.

yep, money talks. does anybody really have any kind of faith in our legal system anymore? we can all see with our own eyes what is really going on. and not just with football. also why have the emails never been made public? all we have ever heard is every bodys assumption of what is in them. never the facts.

@@drunkwolf2477 More of the influence of the NFL: they control the emails, and "somehow" the damaging ones from Gruden were leaked to the press for publication. ALL of the OTHER emails are deemed, BY THE NFL, as "confidential" and not appropriate for release to the public, and by sending the case to arbitration, the Nevada SC made it impossible for the public to learn who in the League office conspired to "leak" the slanderous Gruden emails.

In modern times, large corporations no longer have to pay off another powerful entity. Large institutions incorporations tend to work with each other to maintain the status quo. They will only allow a disruption to the system if they think and or believe the threat will not burn everything down. All the court members have to do is just go into a back room and talk with each other about the what-if scenario

I've said "that girl is stacked" and "that guy looks like a conehead" .. in private, to a friend. I've never said anything about race. Gruden said someone's lips were big - a true statement. In private to a friend. And never mentioned race. People can comment on bizzare physical features and have no racial agenda.. Not good enough for political operatives who want to mire them and fire them for the sake of agenda.

That IS the point. A person inside the NFL or that the NFL hired to perform investigative work. Who was supposed to investigate confidentially .. Felt is necissary to Leak information to media outlets that was.. crass or in poor taste.. But not racist and cost someone a Multi million dollar job. While doing everthing they could to dress it up with racist lipstick. Gruden WAS NOT an NFL employee at the time of his email. This was a HIT job .. a purposeful smear .. And the person that did it won't see justice in "arbitration"

Makes no sense to make it go to arbitration. He was not an employee of the NFL when the emails were sent. This about the targeted nature of this investigation. In all honesty forced arbitration should be illegal.

Under no circumstances should anyone use someone’s emails period. 5th amendment applies here. No exceptions! What The NFL did was egregious and they should pay a shit ton fine. We have a right to our own thoughts and feelings no exceptions PERIOD!

@@melindaostergren8115 no it’s the constitution. The NFL hasn’t the legal authority to do this. It’s not unrealistic to expect people to adhere to the constitution. We’ve had a bunch of criminals in Washington for a very long time that have used the constitution for toilet paper and it’s time we find out who the patriots are and the traitors are once and for all. Vote them out and boot the rest out. If we don’t it will get worse and if it gets any worse it’ll look like the CCP is running the country. You have to stand up for your constitutional rights as well and not fake laws that congress or the president puts in place. I personally believe our government is a captured operation but we gotta keep trying to hold these crooks accountable. This goes higher than the NFL because they couldn’t have pulled this off without first permission inside the government and help from the same people. You can’t throw up your hands ya gotta say no no no. Is there a cost of course freedom isn’t free it does cost something. I’m standing up for Gruden not because I love the guy but because if I don’t will there be anyone to stand up for me and the rest of you if we say oh it’s no use you’re naive. @@dannyquilter8366 you can’t access emails legally without a court order. If you steal someone’s texts or emails without a court order you can be jailed. You can’t just Willy Nilly take someone’s emails or text. Get a court order if you can prove that someone was trying to break the law ex: if you have threatened someone’s life but you still need to convince a judge before you can get a court order sorry but we still have rights here. This is why it was anonymous because they knew they were clearly on shaky legal grounds.

This is a lot bigger issue than the Gruden thing. The person who had the emails "Blackmailed" the Raiders into firing Gruden and that person was obviously someone high up in the league office because only they had access to these files. The real issue is that the Gruden blackmail was public and whoever released those emails cud also be using them to blackmail people in private. It is possible that the NFL cud use that info or any other that they use their wide net to obtain to force people in the NFLPA to do what they want or force a certain owner to vote the way they want. No one even considers if these emails were used to "convince" Daniel Snyder to sell the Commanders. Companies constantly use dirty tactics to gain any advantage they can and it really looks like the Nevada supreme court ruled with the money not the law but even our Federal Supreme Court is a joke now. To be honest I have thought Gruden was a clown since that MNF football game where he hated on COlt Mccoy the whole night just to deflect from the fact his brother is a clown who got the starter alex smith hurt because the normal pass pro back smashed his side chick and got benched. Whats funny is I used to watch college cuz I thought they were better people than the NFL then I realized they are both horrible so I might as well watch the better product but ever since the Ben Rothlesburger thing I have known that the NFL is an evil company just like a lot of the rest. Tbh I think the whole gambling take is crazy cuz I doubt if it was Snyder or Goodell they wudnt want to bring any attention that they were responsible by making any bets, the only way that gambling cud be involved is if the person who had the info wasnt part of the league and if that was the case the NFL wud be a lot more interested in finding out who "really did it"

This case is not over. Grudens team will appeal to not go thru arbitration cuz Goodell is the case & jury here literally, the nfl will anticipate this will be heard by higher courts. Far from over!

I want this to go to open court. That being said, I believe that Dan Snyder leaked the emails. Jay Gruden was a former DC coach who testified against Snyder-- so Snyder decided to be petty and shifted the spotlight.

As a lawyer i cannot see any basis for this ruling …it’s very troubling…there has to be due process or the rule of law looses its centrality in society. Mike great analysis, what about a class action by fans as people of interest. That will force a hearing and remind the NFL what this is all about ….the fans without them the NFL is nothing. It matters that the game is fair and no team is unduly hampered in a season.

Roger Goodell has been in the NFL since 1987 and commissioner since 2006. That is 37 and 18 years respectively. There is the old joke about who is the most paid person in the NFL and everyone always picks a player but no one gets the right answer which is Goodell. Money and power can cause the best of us to become corrupt. Goodell could have an open settlement with Gruden and fired whoever leaked this but he will not. NFL owners only care about the profits and appearance of integrity yet a change of guard is always needed to counter potential corruption and shadiness. As for Gruden's emails, people fake alarm over things people say yet they say the same sh1t but that's another issue or worse. Nonetheless, I hope Gruden gets a reasonable settlement.

Two things: no, not everyone says awful, racist things in private. I don't know anyone who does that, and I certainly don't. I guess it's the company you keep. Second: Goodell is the punching bag for the owners. He keeps the heat off of them and that's why the owners pay him so well. Goodell is easy to dislike, and I dislike him, but whoever replaces him is going to fill the exact same role.

@@alfgwahigain5544 I was addressing people in general. Gruden's comments also included sexual, demeaning, and nudity. It is not only the company you keep when you have coworkers, customers, relatives, social media, contractors, overhearing strangers, or meeting new people at large social gatherings. As for replacing Goodell, my point is that being in a powerful position for too long can cause corruption, risk of losing objectivity, and favoritism. Yes, NFL owners control this but this is a risk that develops.

First of all, thank you for bringing this back into light. I’m with Gruden and hope he follows through. I thought this case was against the commanders owner. Toxic work environment and other complaints. The only thing that comes out is about John Gruden? I’ve always said the commissioner has way too much power! Does the commissioner have to answer to anyone other than the owners?

The panel of the NV Supreme Court really twisted and tortured this process. I'd like to know if Gruden's attorneys raised the fundamental unfairness of having a totally biased "arbitrator". Arbitration is a quasi-judicial process and it violates Due Process to have a party (e.g. defendant) also be the arbitrator/judge. That's like having Elon Musk as the arbitrator in a lawsuit against Tesla. I haven't read enough of SCOTUS arbitration decisions, but I'd have to think there is some FLOOR beneath which Due Process in arbitrations cannot fall.

I think the core point is whether the motive for removing Gruden was to protect the integrity of the game, which seems plausible. Notwithstanding, I think this is a great video.

You know, I had totally forgotten about this case. And it was very interesting to hear the breakdown. I'm not a huge fan of Gruden, but *man* would it be interesting to see everything out in the open. I'd be very curious to see what kind of dirt lies in all those emails. And thank you!! This was well worth the watch!

While I think Gruden deserved to be fired and Im glad the emails were leaked, I still think he should get his chance in court.

The NFL is a very powerful entity and they feel like they can do whatever they want. In this case they went way to far, ruining a man's career and reputation. We all know those emails have other people that would be cancelled also. This was a personal attack on Gruden and the Raiders. This needs to see OPEN COURT.

This needs to go to court so we can see how dirty the NFL is. Most Corporations are doing the same thing to push out whoever they deem undesirable or not conforming to their ideology.

He should appeal to scotus or re-file in federal court if the case isn’t barred by the SOL. You want federal judges hearing this case and not state court located in a state heavily influenced by an NFL team

Got what he deserved? I get you’re not trying to piss off the people who would be upset about you defending gruden but the people he was talking to didn’t file a complaint about the language being offensive and everyone who knows gruden say he’s one of the nicest dudes they ever met. Locker room talk isn’t always clean but that’s the way you conduct yourself among friends. If an outside observer ever read one of your private group chats with your best friends and they took offense to it would you get what you deserved if you lost everything because something you said 13 years ago in a private message with people who clearly have mutual respect for each other was leaked at your job?

The fact that the NFL has its own constitution; should give most a hard pause to stop and think, why? It would appear as though the NFL Constitution reigns supreme over the US Constitution when it comes to litigation with this decision from the NV Supreme Court. Florio did a brilliant job in breaking down the political partisanship aspects of the various courts.
