Given the sensitivity of some of those documents, there is absolutely no way they would have "accidentally" wound up in MAL. They were removed specifically and intentionally and there is only one reason he would have those - to sell or rent access to their contents.
Trump didn't return them when NARA asked. After a few months of asking they went to DOJ for assistance. They subpoenaed him for the docs he only gave a couple. Then they found out he had more. DOJ asked again for the rest and Trump stonewalled them. Exasperated DOJ went in and got what was left (we hope).

I've been saying this for days... Those classified documents had to have been signed out by someone with clearance, moved to a secure location for Trump to view (possibly supervised) and then returned to the secure facility. There are only 3 scenarios which could have occurred: 1. The documents were never signed back in - this means whoever signed them out is likely to be charged with crimes as well as Trump, and whoever didn't report them missing will likely face charges, too. 2. The documents were never returned but custody documents were forged to give the impression they had been - again, at least 2 other people will face charges (the person who signed them out and the person responsible for receiving them). 3. Illegal duplicates of documents were made - again, whoever made those duplicates or was present while they were made will also face serious criminal charges. It's no wonder this is being treated as a counter-espionage investigation. There are numerous people facing legal exposure no matter what scenario played out here.

Imagine you’re a US aligned confidential informant ,residing in enemy territory, and you have to worry wether papers that contain your identity were stored in a golf course basement.
First of all, this was no accident. They refused obviously to return those documents since the FBI had to go in with a search warrant after they did not respond to a subpoena. So, some of these points are already mute. Second Trump's lawyers said in June they were all returned but they were not. So, obstruction is definitely on the list of charges here for sure. This comes down to common sense. Also, you can't just say I declassified documents because they are in your possession. There is a process for that and I'm pretty sure Trump didn't follow any process because in his mind he's supposed to be able to do anything he wants. A lot of these talking points are pretty lame and Trump's guilt is definitely on the top of the list versus these stupid scenarios they are making up.
The laws listed in the warrant have nothing to do with 'classified'. They seem to have known that Trump would lie about that and get the media focused on what isn't the issue. Stolen, destroyed and 'lost' documents are the issue.

Chain-of-custody is only as good as a responsible person properly completing the paperwork, unless the c-o-c has an automatic electronic recorder built in and is fixed to the document…which for paper, the tech does not exist. So a chain-of-custody is of highly questionable value to prove anything other than, maybe, improper record keeping.
