I personally really love how Cities Skylines 2 has been marketed. Obviously the game isn't out yet, so we don't know how accurate the info has been, but they've been releasing weekly videos highlighting features and doing deeper dives later in the week, where the devs give more info on how it all works. You get good info about what the game will be, and you can clearly see just how passionate the whole dev team is about it
They had to get people used to weekly updates so people would get used to the notices for weekly $5 dlc drops. And that’s not a “lol paradox dlc bad” take, it’s just extremely similar to how new mobile games market to condition players to the notifications
4:50 This is absolutely happening with press/review provided versions of products and games. Essentially there is a conflict of interest that you want to only be positive of the company if you want to be provided copies
There's generally poor literacy on what copyright is, and the powers it gives, but the copyright holder has unilateral powers to strike any offending content, and let's plays fall under that, there's just basically an unspoken agreement that game makers don't strike. playing a game isn't transformative enough to fall under fair use, game makers probably don't strike negative content because it'll be a little useless, just talk about it without any footage and the message still goes out with the extra negative press
There are protections again using it as a weapon. If they pick and choose who they strike, people being striked can use those they do not strike as evidence that they are being punitive and not doing it for blanket IP protection. They kind of have to be all or nothing with a blanket strike policy, which is why many of the Nintendo strikes cite modding as a specific TOS violation instead of just taking down all Nintendo videos.
Yeah the argument about "They could copystrike every streamer saying negative against it" is pretty ridiculous, first if they want to reduce backlash they wont do it by copystriking 100+ people cause there will be a million news about them copystriking 100+ streamers for saying negative things and every single big youtuber will make a video on it, that future will just never exist. People should give some slack to LN games, it is equivalent to you streaming a book or a manga or whatever, just it costing several orders of magnitud more and you needing to pay for a lot of wages, of course they wouldnt be happy with a lot of potential buyers enjoying it by watching someone else instead of playing it themselves.
For anyone who thought the discussion was interesting Jacob Geller has a video about the topic of game developers intentionally fronloading all the effort into the first 2-3 levels of a game and ignoring the rest called "Games that Save the Best for Last". It's very good.
4:49 the example that comes to mind for me is when Fortnite first came out and took over a lot of RU-vid and Twitch. Essentially, large and small content creators all - more or less - felt that they had to only say positive things and keep a smile up even when they hated the game and were not enjoying themselves. While this is not the developer holding anything over their heads, the job that these creators do force them to follow the herd into praising (or bashing on, depending on public opinion) new games as they come out in order to entice the most people to watch.
Are you sure about that? There's a reason why this is one of the most popular games of all time. It hit that BR wave at a perfect time, was marketed for both kids and adults, was pretty casual in the beginning before everybody figured out a meta and got good, some streamers and youtubers made their careers off of Fortnite. I personally dislike the game, tried it, thought it had a lot of elements I just hate, but when I see the scope of their in game events, and collabs with known brands and people... Dude, that game is (or was, I think it died a bit a while back) popping, it had the Minecraft effect; not everyone likes Minecraft, but Minecraft started a genre, was marketed to all audiences, and it doesn't matter that not everyone is playing it, enough people like it to the point where nobody has to lie about liking it. Not every game has to appeal to everyone, but if tens of millions of ppl like your game what does that matter.

A let's play is pretty damn transformative. You can think of it like a parody. I'm not legal expert but anything that has commentary should be fair use in my mind.
@@phoenixplasma1065Ernht, wrong, if we're going on a strict legal perspective, 99% of let's plays are in violation of copyright, because even if you're criticising something you can't just publish the entire thing, or even like half, that's why you don't see people uploading Harry potter with small critiques on the side, that's excessive. The reason all game companies bar Nintendo (believe me they tried Google the "Nintendo Creators Program") is because they know the backlash is worse than just letting people play
Mostly it's not safe. The copyright law we have in the US does have protections against selective copyright enforcement. If you pick who to strike and leave others intact, the person being striked can use the content they are not striking as evidence that the strike is punitive instead of designed to protect IP. If they start striking people they will have to strike everyone for either TOS violations or strike all content equally, unless they risk damaging their IP protections.
I know this has been a concern in the Hearthstone community. Every new expansions cycle, creators are invited to participate in early theorycraft streams and such. Some creators has been critizied for not speaking out negatively enough when the devs do something dumb, because they might not be invited to the next theorycraft. Idk if it actually happens but i heard people say it.
To be fair, they are legally allowed to strike people for playing games. So there is no slippery slope. Like with PewDiePie, they could've struck his videos had he not removed them. They are always allowed to exert their own rights... it doesn't matter if they're selective about when they choose to.
Gaming is basically politics. Make a bunch of false promises with no basis or evidence for how it will work. Fail to produce said promises every single time. People still eat up every single promise you proceed to make.
They can anyway, because any game company can contact any creator and say, "we're going to strike your videos of our game if you don't delete them." It's their right as the copyright owner. Most don't act on it for two reasons: bad press and less free marketing. But some companies benefit from acting on their rights, such as Nintendo.
