When 28 year old Ashley Fallis was rushed to the hospital in the early morning hours of New Years Day, 2012, her family had no doubts as to who had put her there.
Only Ashley's husband, Tom, had been in the room with her when she was struck by a single gunshot. Only Tom, with his temper and controlling nature would have pulled the trigger. But where Ashley's family saw no doubt, law enforcement found plenty.

hello!! i’m actually one of the daughters. i normally don’t comment on things like this however i’m going through the comments and I feel very appreciative to how sympathetic everyone is being. normally when I see things about my parents its very hateful towards my dad. i didn’t even realize people still thought about my family and this case. it definitely feels a little odd i wont lie! i just wanted to let everyone know we are doing well! we are no contact with my moms parents (probably for obvious reasons lol). my dad is my best friend and it’s nice to finally see not everyone is against him anymore.

I think it's easy for people to not realise that family and friends who are impacted by these stories may actually read their comments here one day, so I am glad that you're finding at least some support from our little community. My wife and I put a lot of work into telling these stories respectfully and I am always happy to hear from those involved that we've told their story well. I am so glad that you’re doing well. All that I could think of after hearing this story was what a tragedy it was and I hoped that the survivors were doing ok.

I like that he told their children that she had an accident. Hearing that your mom killed herself at that age would completely destroy their formative years. They're just too young to comprehend things like that.

My mom killed herself, but my dad always said she died from epilepsy.. I accidentally found out when I was 15, because I found her death certificate.. 15 is not at all a good time to find that out... I spent many years angry and confused.. I felt like I wasn't good enough to live for.. I was only 3 at the time, so I have no memories of her.. I'm 58 now, and it took me until my early 50's to realize it was not my fault.. She missed out on 3 amazing grandchildren and 2 beautiful great grandchildren.. Each time that my children turned 3, I would look at their faces and wonder how she could do that.. I've finally forgiven her and I am thankful for all that I have 😊

I too thought it was my fault and how could my daddy look at me and my 7 year old brother and do such a thing..now that I'm 39 years of age with children of my own and struggling with anxiety and depression I now understand he didn't do that to us, he just didn't see another solution in that moment. I pray that your lifted up by your babies like I am. If it wasn't for your mom and my dad we wouldn't have our beautiful children. They were lost but we know where we're going. 💛

imagine being in a dysfunctional relationship, with mental illness, cheating, joblessness, and 3 children, thinking its a good idea to have more kids. People are crazy, and have no idea how their terrible decisions affect their children

My own family has a history of suicide…the mom not being able to say yes to the question asking if her family has a history of mental illness when 2 members have passed from suicide…how can you believe anything she says when she won’t even concede a family history of mental illness?

Because of his reaction, I totally believe in his innocence. His 911 call, his adamant demands to test his hands for GSR, his grief at hearing of her passing... He seems legit to me. Poor guy. Whole thing is tragic. Lesson here- NEVER talk to police without a lawyer, guilty or innocent.

I have lost alot of faith in the psychiatric /psychology professions. Mostly because they apoear to think theyre infallible. I look at their founders. Freud Jung etc. Its a very questionable science open to numerous errors.

That detective that was interviewing him is not that great at her job. She was verbally aggressive towards someone who is clearly already agitated and volatile.

40 witnesses, 400 hours of gunshot forensics etc. Such a waste of resources. They should've been able to establish the truth faster. As for the interview its only aimed at 1 objective, as if their mind is already made up.

Kind of reminded me of when I was in kindergarten, and the teacher would tell a pupil something in their ear, and that pupil/student had to pass it to the next person, and so on and so forth down the line, and what ended up being stated out loud by the final person was nowhere near what the teacher had told the first student to begin with. Anyhow, don't know that that's really relevant to what you had stated or not, but that 16-year-old was under the influence at the time, so that kind of explains her part. I have no idea how Nick could have heard Tom telling his parents what he supposedly did while Tom was inside on the phone w/them with, presumably, the doors closed being wintertime in CO. And that detective -- was it? --- well, no wonder he ended up getting canned. None of them were credible.

Also, like, we know witness testimony is often unreliable, even if it’s unintentionally so. So I was thinking like you about the 16-year-old late at night on NYE! Critical thinking!! Also, I’m sad for those grieving parents… but blaming their daughter’s mental illness entirely on another person? Is that how she lost her job too? I hope those children are okay.

@@freespiritchristina Yeah, it was mentioned she lost her job as the respiratory (I believe it was) therapist due to being aggressive. Doesn't seem like the two would even go hand in hand. EDIT: She was actually let go due to insubordination but was deemed aggressive as well. I was going through part of the video again. Sorry for the initial mix-up.

He killed her , no doubt in my mind , just him asking to check for GSR is telling and I've actually seen that before when a cop shot and killed his wife , no doubt at all he killed her , maybe he really didn't want her dead but he did kill her.

When you brainwash people to believe in invisible deities and supernatural entities, reduce their education systems down to mere babysitting facilities, and bombard them with media opinions and speculations packaged as "facts", you effectively destroy much of their ability to apply rational critical thinking in any scenario. Unreliable witnesses are probably the rule rather than the exception.

On the other hand, if you think a guy just shot his wife in the head, and she's in the hospital fighting for her life, would you let him near her? The cops really had no choice if they truly thought he might be guilty. Let him go to the hospital and maybe finish the job? It's tragic, yes, but I understand their position as well.

This case is ridiculous or rather the charges against this man. Witnesses lying on the stand, especially the police officer. No GSR on him and it being on her and the scratches not having any DNA transfer should have been enough. If not, the history of suicide by firearm due to mental illness combined with the doctor shopping should have been a large enough kicker. Great presentation as usual!

@@loveforeignaccents You did miss something. The weed issue is highlighted more in other content related to this case. Husband didn’t want wife doing illegal drugs, at least partially because it would put his job at risk. Mother has the nerve to say “don’t use the F word, there are children in the house,” and then encourages the mother of some of those children to use a substance that can cause psychosis (knowing full well she is on prescription drugs, and using alcohol, and has access to a gun, with a family history of suicide?!) Maybe the husband was controlling, maybe he killed his wife, but those in-laws were playing with fire, because they like to get high with their children? I can imagine them really wishing the husband had committed murder to reduce the shame they might feel if they realized their daughter needed parents not stoner buddies.

Prosecutor said he wrestled for the gun and it went off killing her. Then where's the GSR? Why did she have GSR on her hands and not him? I swear you people have shoe sized IQ. Tom had a terrible few yrs. Jobless for a bit, kid w/medical issues, cheating wife, watch wife off herself, get charged, and go to trial for it. Seems the wife had alot of emotional and mental issues along the way. He probably has PTSD now

As soon as he asked where the GSR was during interrogation, I was stunned that they hadn't bagged his hands by that point. From the little we saw of the interrogation, the detective interrogating him was horrible. It is sad that the marriage was full of infidelity, mental health issues, financial problems and yet they wanted to add more children to this? Their marriage was as big a mess as the case was. I can only hope that the children are doing alright, terrible they are facing life without their mother.

My suspicion is that her parents knew about her mental health issues and pressured her into the tube tying for her own stability. She started to have phantom pregnancies, lifting her husbands hopes for more kids.

@@oliviatree I too wondered about phantom pregnancies, it seemed none were verified by a physician, which would be my first stop, especially if I was understanding I could not have a baby. Such a sad situation all the way around.

@@loveforeignaccents I understand that. However if the assumption was, and she likely would have been told by her physician that the chances of her becoming pregnant were far lower with the surgery, then that would be enough to have me back to that physician if I thought I was pregnant.

@@dellahicks7231 Maybe the doc appointment was on the books, but she ended up losing the baby before then. Also it was stated this was her third pregnancy/miscarriage in nine months, so definitely not her first time becoming pregnant after having that procedure.

@@geraldstewart2556 I could see how she would hold the gun to her head with both. One on the trigger the other aiming the muzzle. That kid didn’t sit right with me. Something off about his testimony. This is one you make a decision and just pray to God you’re not letting a murderer walk free. I did go not guilty though.

I think the jury got this one right. No GSR on Tom's hands (and GSR present on both of Ashley's hands), plus no DNA from her on his scratches, speaks louder than all the conflicting witnesses. Also I love the music video at the end! ❤

I think he drove her to her death. The arguing and everything else going on after the party could have led her to kill herself. He’s also lying that there was no argument. And making a comment about which neighbor heard the argument.

@@patricknegro5071these neighbors wasn't very reliable tho. there were only three neighbors claimed to hear their argument, the lady didn't dare to repeat again under oath, the guy was drunk and his girlfriend heard different thing from him, they conflicted themselves. and the cop who claimed to hear him said "I killed my wife" was 100% lying because Tom himself even said his wife was still breathing when under interrogation, so there was zero chance he would say he killed his wife earlier because he knew she was still alive when the medic came, that's why I knew that cop made it up. none of these witnesses were reliable tbh. it's understandable when he asked "which neighbor" because the neighbor just made it up, it would make him feel like they resented him with a lie and he would definitely wanted to confront the one who said it, that's normal reaction when you hear false accusations/rumors about you tho, especially he's also a quick-tempered person

I think the female police investigator was completely out of line in her questioning in attidltude and content. Confirms the advice criminal lawyers give. Never talk to the police. Certainly, not without a very good lawyer present.

The flashlight clinched it for me; they apparently rushed to judgment. The 17yo witness vacationed with them afterward …fishy eye witnesses…. Tom called 911 immediately; he did seem devastated upon learning she died. I think his concern about Ashley smoking when she’s off her anti-anxiety meds is legit. I hope the families find peace. Don’t even get me started on gun safety.

Even before the re-opening of the case, I thought him innocent. How they managed to get the case to court on no GSR found on him but on the account of a 17 year old who had been drinking, is absurd - we all know eye witness accounts are never reliable. Glad the correct verdict was reached-at least in my opinion.

Exactly what I thought. What a waste of taxpayers' money. After watching so many interrogations of guilty people, I was leaning toward innocent within the first few moments of his. If he is guilty, he's amazing at getting away with it. Not one bit of evidence that I heard pointed to anything other than suicide. I feel for the family and their grief, it is hard to accept sometimes, but with the family's history of mental illness and suicide I find it to be the more probable solution.

One of the more serious side effects of withdrawl from seroquel or clomazopam is suicide. Withdrawl and miscarriage sounds plausible to me.

@@oliviatree Well, we know she had taken at least one at-home pregnancy test, which turned out positive... I would think those are pretty accurate, although I would have taken two just to be sure after having had a tubal ligation. And it was stated she indeed had three miscarriages, and that her tubal ligation was basically a failure because it didn't completely take successfully. Even if it had, one could still get pregnant, albeit rare.

What an awful mess. I don't believe that her husband killed her. The mother seems to be sick with her idea of what happened & she's not going to change her mind. At least the kids can see both sides of the family. Well done, Kevin, again!!

Okay, if my child has mental issues, cheating on her husband, loss her job, a botched tied tubes surgery, PLUS seeing multiple health care specialists…I would be doubtful of her husband taking her life!! As a parent, you know something ain’t right with your child regardless of how much the tell you! Her parents need to be sued for their harassment of the SIL. I didn’t hear that they were trying to help her with disabled son…did y’all? I mean from all accounts she could have been seeing all those health care specialists to deal with them!!!

I remember watching this case a few years ago and doubted him murdering her. I also want to address the dangers psychiatric medicines. It was mentioned that she was on clozapine and Seroquel. Anyone can react adversely to such medicines and ESPECIALLY if they are suddenly stopped.

Yes! I’m surprised there wasn’t more emphasis on that. Stopping psych meds, ESPECIALLY suddenly stopping them, is very dangerous. It can cause severe adverse reactions. There are thousands upon thousands of testimonials of people online, withdrawing from their psych meds. These symptoms can persist for YEARS!

2011, body cams wasn't even used until after the BLM riots in Ferguson late summer 2014. It was 2016 when it started becoming more widespread. What is body cam going to do anyways against witnesses? Witness can lie. People don't have photographic memory, the human brain remember things in pieces, and the mind fill in the blanks. Driving in your own neighborhood, you wouldn't even notice a new stop sign because the way memory works. It's in pieces so it'll skip a new sign. It's why you zone out when you're driving long roads that you frequently drive. It's the total opposite driving in a new city, our brain gets overwhelmed driving in a new city by taking in new images.

If the cop, who said the hubby yelled that he shot his wife, had been wearing a bodycam, there might be video evidence to support that or clarify that he wasn't actually yelling that. Witnesses can lie, or they may just be mistaken. That's what bodycams can do.

Those psychiatric medications she was on at how many times the dose have side effects - including suicidal ideation. And she stopped them cold turkey when she found out she was pregnant. And - if I understood it correctly - she was going to go outside and smoke pot with her parents, so how often did she do this and was she taking any other drugs? And what kind of meds and drugs are her parents on? There was no DNA under her fingernails. There was gun residue on her hands and not his. And this is a small snippet of the information from 40 people, but I just don't see how he could have been guilty.

Yeah, it seems like maybe a two hour training course, very simple, could cover the basics of what to do at a crime scene, at least the most important things like, bagging the hands in a gunshot situation. As much as the cops were horrible at the investigation… the dude was so innocent it’s as if he was a child. Gsr aside… they claimed she was fighting him off but nothing under her fingernails. All they had was that he was upset because the parents wouldn’t take a hint and leave when it was time. Which I would be mad too and tell them to leave. Even after death they keep over stepping in that man’s life.

Wow, what a heartbreaking and complex case. It's so tragic to see the aftermath of such a deeply troubled marriage. The twists and turns in this story kept me on the edge of my seat, and it's a reminder that reality can be far stranger than fiction. My heart goes out to Ashley's family, and I hope they find some measure of peace and closure despite the outcome of the trial. Kudos to the investigative team for shedding light on this deeply troubling case.

I would have believed he had shot her because of his history of volatility and anger and the fact that her anxiety and mood swings could have been a result of domestic violence, however his anger at being accused is usually the response of an innocent person, and the forensics seem to back him up

Actually,​@Chellz801 how innocent vs guilty people respond to accusations is a hugely studied factor. Once the person's baseline behaviour is understood, the verbal and non-verbal language they use in their denial can be very useful data. Not in a court of law, but in social sciences.

Most innocent people WILL express disbelief, surprise and anger when they’re falsely accused. They’ll also DENY the accusation. Anger is a normal reaction when you feel threatened. When you’re wrongly accused, it’s a direct attack of your character… it’ll evoke a strong response. This person is right.

The detective in the interrogation should be *fired* agitating the husband, the witnesses _at best_ “misremembering” or outright lying and parents who cannot accept that their *mentally ill* daughter committed suicide because she went off her meds is just a mess all around. That poor husband being interrogated instead of at the hospital by his wife’s side is just heartbreaking.

It seems most likely that she killed herself. She was off her medication, which could have really altered her mindset. The gun residue was on her hands. Her DNA was not on her husband. The neighbors' testimonies were very unreliable. It is a massive stretch to assume that law enforcement officers would put themselves on the line for a perfect stranger just because he held the same job. That just doesn't happen. It's very common for grieving family members to put the blame elsewhere even when the evidence is clear. I'm relieved that the jury made an appropriate decision.

1978 I saw my nextdoor neighbour punching his wife against the garage. She was my art teacher in my school.....I remember every detail 46 yrs later.

This happened on a new years eve. Everybody was drunk stoned whatever. Nightmare to investigate. And this trainwreck couple? Hard to say who were the most intoxicated.

Yes it did. There’s usually something off about the 911 calls made by the guilty. Plus, his denials in the initial interrogation were forceful and non wavering. These aren’t always signs of innocence (some people are very good actors), but people who feel a strong need to explain away things in interrogations create a lot of red flags. He wasn’t doing that at all. Also, when he broke down after hearing that she died, that seemed very genuine too.

That’s theatre… I found my wife of 38 years seemingly lifeless body after suicide attempt. It was overwhelming but you keep it together because being hysterical delays help. That’s poor acting

Due to childhood trauma and a drama queen mother, I am also very calm in a crisis, but my sister gets hysterical. That man was hurting. I am sorry for your traumatic experience, there are no winners when mental health issues are involved.

I thought the opposite, that it sounded so fake. I don't think we can go by it either way, as people react differently under the same circumstances. I think the jury got it right, and it was a terrible tragedy all around for everyone.

Really it’s an OK song. But rap music is so simplistic. I think any moron can produce it. Really it’s an impressive music style. It’s more like talking in rhymes, children easily can do it. I’m a country music fan and most of country music is exactly the same way, so simplistic, sometimes even worse than rap

As a medic myself it appears that American Psychiatrists are pill mills. Just as an example who gives clonazepam long term for anxiety.

Please don't denigrate those who have mental issues. Having struggled for decades with mental illness, it is always a struggle when I have to refill my meds. I would much rather not have to take them, but the one time I was taken off of them, I was prepared to murder or take my own life. I realized then the incredible benefit medication was in my life. I've seen myself on both sides, and am ashamed of the HELL I've put my family through. Please don't judge others when you know NOTHING about dealing with mental illness.
