I asked them to better define the area, they refused, I asked to redline, they said it was non-negotiable, so I told them I wouldn't be moving forward with onboarding. My non compete agreement starts with: "the employee" and I'm on a 1099....step 1. Unenforceable because I'm not an employee. Bye felicia.

Ok let me give you my rundown... I am a pest control guy a d was fired on March 11th right before the lockdowns. And lost my unemployment because my old boss is a good actor as well as lier. So went 8months without work and finally found work a couple months ago at another pest control company in my small town. 10,000 POP But last month my old boss showed up at my work and went in yelling and wanting them to fire me cause they have a non compete agreement. My boss says to kick rocks. Today I got a certified letter. A seise and desist order with a settlement offer and more shit to sign. Oh and only 6mo left on the 3 year agreement to boot.

I signed a non compete agreement but it includes language about setting up a similar business within 1 mile of the current business and something about taking their clients. Is that a legal part of a non compete? Neither of these things involve trade secrets or being a superstar in the company..
