What just happened??? Despite going into June clear-eyed and well informed about the Supreme Court’s conservative supermajority, the number of huge cases before it, and the alarming stakes in so many of those cases…we are, nonetheless, shocked. The October 2023 term came to a shuddering end on Monday July 1st and Dahlia Lithwick, Mark Joseph Stern, Steve Vladeck and Mary Anne Franks are here to help parse some monumental decisions, some smaller cases with big ramifications, and what we can understand about the Justices who made those decisions for the rest of us, and the Justices who dissented.

The court’s ruling to give a corrupt executive an out by not considering motive feels very much like the out in the use of deadly force that you feared for your life. But at least for the murderer’s motive, if not the president is considered in a criminal case.

@TommyStahr Four years of trump and we had gas prices that were $1.83. Low inflation And there were no wars started under trump. Joe, we had high gas prices record high inflation in Afghanistan. Departure that killed 13 Marines and left billions of dollars worth of military equipment. Ukraine could have used Russia shooting down our unmanned drone. China flying a spy balloon over the united states and joe showering with his daughter when she was a teenager.

This may not be a fashionable opinion but I think this ruling also implies the immunity the justices feel they warrant over their ethics rules. They and they alone can make the rules and now with this immunity ruling we will be forever at the mercy of their interpretations over every incident that tries to bring an executive action under scrutiny. They are the true kings and queens. Without any input from the other branches they can write and rewrite rules whenever they want. Grid yourself for endless legal wrangling and just more stress for the average Americans who just want to live their lives with safety, privacy and freedom.

This ruling does not give them total immunity. If it's against the Constitution they still can be held accountable. Presidents have always had immunity. If not Obama would have been in prison for droning Americans in Afghanistan.

@@johnpelter Originalism? Nothing. That's just how all laws should be interpreted. Once you move away from that you're moving away from what the people intended at the time. But it's logical to assume that 9 people should never be left to those decisions. Most things need to go through legislature. Not just hoping a handful of rulers decide not to change precedent. Get things codified or stfu.

@@fedbia2003 If you actually believed this, the behavior of this Supreme Court would alarm you. SCOTUS has been all over the board with 'originalism'- using it to argue that privacy rights shouldn't exist, but discarding it in respect to newly instituted executive powers. The conservative justices are hypocrites making things up as they go- 'originalism' is simply a convenient argument when arguing against what they oppose. You do realize the new powers they've awarded the president never previously existed and are not enumerated in the Constitution- that in fact the Constitution suggests presidential power should be checked rather than unchecked. Right?
