As a product developer my supreme interest is in US and China. It covers from one third to half of the global potential market. I suggest invent right to focus on China along with US. Not just the protection but the pitching to potential Chinese licensees as well.

The Chinese intellectual protection for foreigner is very week. This would be a great video topic indeed.

So if you file a PPA, wait the 364 days, then file a PCT for an extra 18months, you could technically have a 22 year and 18month patent(if your patent is granted)??

Thanks for those advice. It was really helpful. I really do have a question too. Is it possible for someone to gain patent in a different country which was already applied for provisional patent in another country without PCT application? What if I gained patent (not about provisional) in my applied country and could someone just copy my application to gain patent on a different country? Sorry in advance if my question sound weird. Thanks in advance 👍

The only way the planet can have more than one patent (for a specific invention) in more than one country is if it's from the same inventor. So, no, nobody can cut n paste your application and file it in another country to get a patent. Hope it helping. Alex, former InventRight student.

They missed the one part that if you disclose the idea publicly once you file a US provisional, you could lose all rights to obtain a foreign patent.

Lets say for instance I want to patent something in the USA and the examiner does an search, do they only search in USA or world wide. If someone already has a patent in lets say France but has no PCT or they haven't filed in USA does this mean my patent will or won't be granted in the USA. If for some reason I'm not granted the patent then it will be possible to still manufacture and sell the product in all the other countries where the original patent inventor didn't register in without having any legal ramifications.

Great video and channel gentleman. I have a product that was invented years ago by my friends late father. They produced this product and went on to sell them and occasionally still sell the odd one now and again. I approached my friend and asked if I can make a version of it and he has given me the go ahead.They have no patent protection filed only a trademark on its name that is out of date. I have changed and improved the design including the name, shape and material it's made from. It is unique in its design and solves a real world problem and I cant find anything like it anywhere. Would this be something I could file a patent PPA on ? If yes ,should I file the PPA before approaching a company who help to launch inventors designs.

If the improvements are far enough from the already disclosed idea/invention AND it's not in the prior art as well.. Sure you can file a PPA and approaching companies. Just try to avoid "company who help/promote/launch inventors designs", instead, contact directly potential licensee or company that already produce similar products. Step one: read the Stephen Key's book: One simple Idea. You will save a lot of money ressources and time.

I sincerely appreciate you taking the time to give advice I will definitely get Stephens book. I have this on the back burner at the moment as I am busy launching a new business but I will be back at it in the new year, thanks again.
