Case Laws You Need To Know:
Terry v. Ohio, 392 US 1(1968) - An officer can briefly detain a person, based upon reasonable suspicion of criminal activity, long enough to dispel the suspicion or to allow it to rise to the level of probable cause for an arrest. The officer is also permitted to do a limited "frisk" search of the person without a warrant. Before the officer can frisk search the subject, he must:
+ Have articulable facts that the person could be armed with a weapon.
+ Limit the search to pat searching the outer garments of the suspect to feel for objects that might be weapons.
+ Only reach inside the clothing after feeling such objects.
Tennessee v. Garner, 471 U.S. 1 (1985) - The use of deadly force to stop a fleeing felon is not justified unless it is necessary to prevent the escape, and it complies with the following requirements. The officer has to have probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others.
Carroll v. U.S., 267 U.S. 132 (1925) - Police may conduct a warrantless search of a vehicle stopped on traffic if there is probable cause to believe that the vehicle contains contraband or evidence.
Whren v. U.S., 517 US 806 (1996) - Through the late 1980's and into the 1990's courts were embracing the idea that an officer's subjective reasons for making a traffic stop should be considered when ruling on the validity of seizures. If the court finds that an officer's subjective reasons for making the stop was for anything other than the initial traffic offense, and that reason lacks probable cause or reasonable suspicion, the court would dismiss the charges. The U.S. Supreme Court finally addressed these types of rulings in the Whren case. The court ruled that the objective not subjective reasons for making traffic stops should be considered. An officer's intent or motivation to make a traffic stop is not relevant to the Fourth Amendment standard of "reasonableness".
Graham v Connor
The U.S. Supreme Court determined that each instance of the use of force must be judged in light of what a reasonable officer would do in each particular situation. At least three factors must be taken into consideration.
1. The severity of the crime
2. Is the suspect an immediate threat to the police officer or the public
3. Is the suspect actively resisting or evading arrest
+ Responsible for setting the “objective reasonableness” standard.
Mapp v. Ohio
Dollree Mapp’s home in Cleveland, Ohio was forcefully entered by police officers who believed that a suspected bomber was inside the house. While searching her home, officers found pornographic books.
Later, Mapp was prosecuted under an Ohio statute for knowing possession of lewd and lascivious material. She was convicted even though the prosecution was unable to produce a valid search warrant.
The majority held that all evidence obtained unconstitutionally, without a search warrant, is inadmissible in state criminal prosecutions.
Miranda v Arizona
Ever heard of your miranda rights? You have the right to remain silent?
Yeah, comes from this case. Important stuff.
Arizona v Gant
Gant was pulled over and arrested for driving while license suspended.
After being cuffed and secured in the back of a cop car, officers searched his car and found a gun and drugs. Gant moved to have the evidence suppressed as the result of an improper search.
The Arizona court convicted Gant and he petitioned to the Supreme Court claiming the search violated his Fourth Amendment rights.
Upon review, the United States Supreme Court held that the police may search a vehicle only if the arrested person is within reaching distance of the passenger compartment at the time of the search or reasonable belief that crime-related evidence is present in the vehicle exists.

I'm confident that this will be covered in a later video, but if I could pass along one nugget of knowledge about the police academy, it's to get in shape right now. We did PT every morning from 0600 to 0730 and we ran 3 miles on the first day of the academy. There's no building up to it or starting easy at the academy, you are expected to come in shape. Every academy that I know of including mine, gives you a list of recommended physical fitness standards a few months before you actually attend, do not sleep on those.

Great video, and extremely useful information! I'm a retiring military veteran who's considering a career in law enforcement, and though this video only refreshed my knowledge, it's invaluable to younger people who aren't too familiar with our government and laws. I started my degree in Criminal Justice as a Recruiter and finished it eight years later as a Drill Sergeant, and one of the most memorable classes was Ethics and Discretion in CRJ. Some cops develop a superiority complex. They have the power of arrest, are authorized to carry a firearm even in state that make it difficult for a common citizen, and consider themselves the thin line between criminals and lawful society. If you're a member of the latter, crossing paths with an unethical or dishonest officer might result in you receiving the label of criminal. Similarly, some cops develop an "above the law" mentality, such as the Miami officer recklessly driving his patrol car when he was late to work, only to be pulled over by a Florida Highway Patrol officer, or down here in Baton Rouge a while back, an off-duty Baton Rouge officer who was pulled over by another BRPD officer. The latter was heading home in his marked vehicle and was passed by a pickup at dangerous speeds, so after a short while he initiated a traffic stop, despite being out of jurisdiction. I picture the Academy to be a few things: Boring but most important: criminal law, procedure, departmental policies, etc. Fun and potentially life saving, but stuff we should all hope to never use: firearms familiarization/marksmanship, weapons retention and unarmed defense, less lethal, compliance, crowd control, etc. Just plain fun, but not something that will be used often: evasive and pursuit driving measures. I'll go back to watching Police Academy 4 now.

Love it! Would be curious about information around weapons, such as concealed versus open carry, what to keep in mind when carrying concealed and what you can carry concealed versus not and also use of deadly force

How did you find the academic portion. Is it as challenging as people say?
@joshuac7
@joshuac7 Год назад
@@danielkatz1139 Keep in mind everyone learns, studies, and tests differently. What makes it difficult for most is the drinking from a firehose aspect of things. Given prior training and experience, I’m pretty used to that style of program so it hasn’t been very difficult for me personally, but it is definitely more challenging than I expected. Absolutely doable though!

Recent graduate of the police academy and everything you said in this video was spot on! We did 2 weeks of DT instruction and then 4 weeks of class work/ dui instruction and 1 week of driving and shooting and 2 weeks of scenarios. We also had a pre academy that covered the general basics of constitution and pre law enforcement stuff. Would love to see where you go with this series next!

as someone who just got done with the academy: Here in Florida I only had questions about executive branch and legislative branch, no other constitutional questions, and that was on my tests within the academy. Now My state exam was from the whole book, the wordage is straight from the book.

Remember when this guy used to make all his videos from behind the wheel of his charger. (To be honest the charger is why I listened to him.) As I begin the process of becoming a law enforcement officer, I think this series will be a much appreciated asset in the tool bag, and I thank you sir.

Just in time - I was hired back in 2019 but was diagnosed with Hodgkins Lymphoma - it was a stubborn thing but I just finished my final treatment and should be finally going to the Ontario Police College in either January/May - not exactly an American police academy but should be able to take away some good tips from here!
