Oh dear, sir. You were had there I’m afraid. The same law that allows people to wander anywhere is Scotland (called the right to roam), by consequence instead of design allows people to fly their drones. This is with the exception of any place with an airspace restriction, forestry commission land (though I’m not sure how there is a separate rule) or anywhere that is within a 50m bubble of a vehicle, vessel, structure or pedestrian. Please fly responsibly! We want to keep these relaxed rules for everyone to enjoy. Follow the drone code! Nice video! Glad you enjoyed your stay here!

Just for your information. Unless this "Alistair" is it? Can provide business licenses pertaining to charging people to use drones in the property. Then this is called extortion. Which is illegal.

Alistair happens to be the Justice of the peace for the local area (if you don't know what that means look it up) he is also the estate Manager for the Glenfinnan estate, under UK wide drone laws you need to landowners permission to fly drones. (Yes I'm aware that once you hit 100ft nobody owns the airspace) but until you reach that 100ft you are flying on private property. There's also the fact that there is a grade 1 listed building on the estate. And yes soliciting money is illegal but asking for a donation isn't. Oh did I also mention the area is a sea level training ground for the RAF meaning it's a frequently used airspace? Please READ up on the laws before you go around calling folks cunts...you're just making an embarrassment of yourself.

@ Liam Douglas, i think you're talking pish mate. nobody owns any airspace, folk can own land and no trespassing laws in Scotland, so you can fly whatever the fuck you like.

kelv bundy, There are in fact trespassing Laws in Scotland....yes through the right of assess code folk are allowed to enter most areas ON FOOT. Due to the land being owned by a private estate the owners do have power when it comes to drone flying albeit very little. As for the owners of the airspace the Glenfinnan estate are legally the owners of the immediate airspace above and around the property this classified into two fields......The Lower Stratum and Upper Stratum, the upper stratum being between 500 - 1000ft above the property. All of this information is available on the public domain.....If you are a drone operator yourself this is information that you SHOULD know. Or take a CAA course to learn the legalities of drone flying in the UK.

Hello, I have no idea why you where changed to fly your drone I am scottish, you can fly a drone anywhere in Scotland with no fees ? The man who charged you had no rights to take money due to the Scottish highlands being owned by the public there isnt any private property in the highlands apart from farm land but your location where your at is free ? And also he put the sign up the only people who can put signs up are the Scottish government offical or the local council people like him give scotland a bad reputation!

You should have reported this as extortion,the CAA own the airspace but he could refuse for you to take off and land on his property,but there is no way you should have to pay

Hi all. Big Stoozer here. I have a RU-vid channel called Big Stoozer MTB. I have been an avid mountain biker for over 35 years and fly my drone all over Scotland. I can say with complete confidence that Alistair well and truly conned you and had absolutely no right in law to stop you flying your drone. He most certainly had no right to charge you. I will tell you why. 1. There is no written law in Scotland or the UK permitting him to do so. No person making comments below has quoted any legislation that allows him because it most certainly does not exist. 2. Your drone is simply a flying camera. It is no different to your camera phone. The only difference is that it allows you to take aerial photos and videos of our country's wonderful landscape. The only objection he could make is if you flew your drone over his private property (dwelling house) and decided to film his private activities without his authority. Even then it would be a civil dispute and he would have to employ a lawyer to stop you. It would most certainly not be a police matter. I'll try to explain this in another way. Would it be reasonable for him to stop you taking a video with your camera phone on a mountain 2000 feet above sea level on the estate. No, because he has no right to do so in law. Your drone is just a camera that gives you a different view point. 3. Now this point makes me smile. So if it was against the law for you to fly your drone what right does he have in law to charge you £10 to break the law? Think about it. 😂😊😂 4. I understand why you paid him the £10. You were on holiday in our beautiful country and did not want a confrontation. To be fair to Alistair you gave him his ill gotten gain voluntarily. Great channel by the way. This 'no drone flying' posted by this shady character calling himself Alistair has got, 'cash-in on the unsuspecting tourists coming' written all over it. Suffice to say beyond question that it's people like Alistair that are a sharp protruding thorn on the Scottish tourist board sadly, pardon the pun! Once one is demanding money then it's no longer a matter over private land nor entirely that of an environmental one but extremely likely that of a Police matter! This individual calling himself 'Alistair' has just committed an 'illegal offence' and that is he has been caught on camera by yourself using the land in order to extort money from your good self which we are all saddened to learn. Yes he very much indeed has committed an 'illegal offence' and he well and truly knows it which is a crime that on this occasion is not punishable under Scots law but that of common law in Scotland just in the same way as it could be considered as a serious felony in all states if you were faced with the same situation back in America! I do hope that this rather unfortunate experience hasn't in any way dampened your spirits in your visit to Scotland from this 'actor' using the charm offensive tactic to "hustle" your £10 from you my friend!

I am soooo looking forward to going up to Scotland :) aim is to climb Ben Nevis and fly a drone :) Really enjoyed the video! Amazing scenery!!

Me and my friend encountered this Alistair bloke. He threatened to shoot the drone down and claimed we flew over private property (which we didn't as the flight data showed other wise). He was very threatening and needs to be stopped. Anyway, good video though.

Nice vid Ted. Think you got ripped off by the game-keeper though. I know of no law that allows them to charge to fly a drone.

It is private property so you need to ask for permission to fly.

It might be classed as 'private property' by the game keeper. Did he give you a receipt for the money you paid? Nope - thats suspect. Also have a look at this - the Scots trespass law was superceeded by the piece of law. Have a look at the link form the Scottish Government - paragraphs 4.7 and 4.8. The Forestry Commission in Scotland don't allow drones due to it contravening with access code (peace and quiet). You can ask for permission but the guy should not have charged you.

Hi Ted. Was up in Glenfinnan for a week and spoke to Alistair. A donation to fly your drone should be paid at the visitors centre. He clearly took money from you which is illegal mate.

Unless the land is private property where you want to launch your drone from, there is nothing anyone can do about it and no one owns the airspace other than CAA in UK. As long as you take off from public land, you can still fly over private property except restricted areas such as Military, prisons etc. You got fleeced (robbed of money). Nice footage though.

I flew there drone without letting anyone ripped me. If I would wanna ripped people of, I would do exactly same thing. Just put sign on famous place as it was mine and wait for someone to catch. I think it’s better to use the brain first and then look for the rules especially on the places where you don’t interrupt anyone.

He cannot enforce this legally, he doesn't own the air. So long as you're not flying from the site itself (if its private property) and you don't fly closer than 50m to anything/anyone (or 150m if it is a congested area) then you can legally.

You are free to film or photograph anything that is in the public domain, this is common law. If however, the place where you are filming or photographing is private property where access is by permission, then unless specifically allowed, filming or photographing is not allowed unless permitted. Filming and photographing outside the private property is allowed under common law.

It's not the Harry Potter bridge . It's the Glenfinnan Viaduct designed and built by Sir Alfred McAlpine and it is the world's first Concrete structure . So take yer buzzy little gadget Buddy Holly and do one before you bring down one of our fighter jets .

Alistair should know better then being a Justice of the peace there is no law of trespassing in Scotland there is the law of criminal damage but the landowner has to prove criminal damage and it would be a civil case so Liam pass it on to the highway robber known as Alistair he is breaking the law by extortion . a military training ground does not mean drones cannot be flown all military aircraft when flying low level are aware other than them can be flown in the same area at the same time there is no exclusion zone, now if i had been a bombing range then it would be different so please if your going to preach get your facts right Per Ardua
