On this episode of We the People, Jeffrey Rosen has a special conversation with Judge J. Michael Luttig on his views on former President Trump’s indictment and the role Luttig played in defusing the fallout of the January 6 events at the U.S. Capitol.
A panel of libertarian and conservative scholars-J. Joel Alicea of The Catholic University of America Columbus School of Law, Anastasia Boden of the Cato Institute, and Sherif Girgis of Notre Dame Law School-conduct an in-depth comparative look at the different strands of originalism as a constitutional methodology. They also explore originalism’s modern history and application by current members of the Roberts Court through the examples of recent cases, and how originalism intersects with textualism and other interpretive approaches. Jeffrey Rosen, president and CEO of the National Constitution Center, moderates.

I agree that we are floundering in ignorance. At what point did our educational system stop teaching Civcs, or as it was some times called, Social Studies? I remember in grade school and Jr high, learning all these things about how Democracy functions. In the 8th grade, we studied the Constitution for a whole year.,paragraph by paragraph. We had to print each paragraph on an index card and keep a “recipe box” file. Many students complained to their parents and many parents complained to the Principal. The Principal came to our classroom and confronted the teacher about her “cruel” methods, how our young hands were being cramped with all that printing. No Joke, it really happened. Our teacher just stood with her arms crossed ,stared him down, and refused to change her method of teaching the Constituion. that was in 1958. She was not well liked by some, but was a good teacher., Judge Luttig is right,!! On our Report Cards in those days, at the bottom was a line in bold type “Education is the Bulwark of Democracy” My sons also learned Civics in school during the ‘70s and 80’s Trump has said he likes the “poorly educated” , and there are millions of them. Maybe they will become educated about the Rule of Law, through the reponse of the FBI arresting those who make threats to the Courts, Judges, Juries, Witnesses, and Elected officials.

As it stands he is correct the 2020 election was rigged and there is proof beyond a reasonable doubt. You cannot believe that because you fail to look at the evidence. *You do NOT grasp mens rea.* In criminal law, mens rea is the mental state of a defendant who is accused of committing a crime. In common law jurisdictions, most crimes require proof both of mens rea and actus reus before the defendant can be found guilty. Translated from Latin, actus reus means “guilty act;” and mens rea means “guilty mind.” Now, why are those two phrases so important in the criminal law? The answer is because those two phrases describe the two basic elements the government needs to prove in order to convict a person of a crime. *Now I will tell you this, they cannot find Trump guilty of knowing the 2020 election was not rigged because there is nothing that Trump believes more than that it was rigged.* He believes it was rigged because it was rigged!!! \\][//

He has been stating exactly what I have thought as for the several years. It's refreshing. I am a Mayflower Pilgrim, British Colony, French Colony, Daughter of the American Revolution, LGBTQIA citizen and military Veteran. I vote Democrat except once when I voted for McCain for POTUS. Some years ago, I read a book written about my Colonial English Ancestors. I never thought I had anything in common with those ancestors. I am also Cherokee and Filipino. I grew up with racism in my face. It's been at my back for a few decades because I am also a natural born Californian. So when I read, paraphrasing, that every generation of my ancestors had a common ethic, a moral mind. Reading on in a book written in 1800s, my Great Great Grandmother listed in the last printed generation of that book, I was astounded. The author, an ancestor, was right. I had this same ethic and moral mind he described. Judge Luttig is hitting the core of my own American Soul. He just hits the nail on the head. I fought against my own extended family across this nation for LGBTQIA rights. It's my birthright. It's a birthright of both Freedom of Speech and Religion and an Unenumetated Right of US Constitution. But No Citizen has a Right to Wage War Against the US Government.

I had a conversation with a lady who just happened to be a former tv news anchor in our area and I mentioned to her that the US Constitution is essentially our rule book and she replied "I like that, our rulebook". Yes the crux of the deal is that many people do not understand that the Constitution is indeed our rulebook. We the people can exercise our right to vote to ensure that we follow the rulebook.

There probably is such a person. But the parties (both) will have none of it. The leadership of both parties are so overwhelmed by power, they are corrupted by greed. The Judge is right we have no one to lead us away from this political mess that has now become personal. Now is the time to move away from Trump & Biden

He compares our current situation to the Civil War and I can see that. The growing demagogues trying to rip apart the foundations of America dont have the unified support of "the confederacy of states" that existed back then. However, we have to be aware of this as we try to navigate away from this entire horrific event. WE THE PEOPLE need to get active in our local and state elections, in order to elect politicians that can help us heal the wounds of modern society.

In my opinion, Adam Schiff is a leader similar enough to Alexander Hamilton that could lead this country out of the current situation. Also Senator, Whitehead is capable I believe. Great conversation by Judge Luttig who has the wisdom and analytic judgement and would be a great candidate to lead the country from the precipice of collapse.

I love this country and to see what has become of the Republican Party makes me want to cry. I know it's not 100% Donald Trumps fault but since he took office in 2016 it's felt like impending doom but it's not impending anymore it's just doom and gloom...I only pray that when he's found guilty in the courts for his crimes he will go to prison for the rest of his life for what he has done! He has brainwashed half of my family, I can't hardly talk to my brother, my sweet aunt Sharline has lost her mind and I'm just dumbfounded by the fact that I am not alone. There are so many people in my exact position. I just want to wake up from this nightmare and it all be over, I long for the days when I didn't worry about our democracy and didn't have to worry about people trying to destroy it. ...there are too many crazy people in the Republican Party. Isn't there some way to just shut them down? Stop them from what they are doing...destroying us!

9:18 Bringing charges against #45 is half the battle, not more important than a finding of guilt when, in many examples of #45's own words, he knew what he was doing. If the Constitution cannot be defended legally, it cannot be defended at all. An acquittal would say, yeah, we have a Constitution and it has lots of nice ideas, but we don't have to follow it. Edit: Rosen finally gets to this point at 48:00 in quoting Lincoln, but it's especially crucial in understanding #45, the 91standing charges against him, and his continuing popularity.

I am a lifelong MV Democrat and I took no pleasure in the Trump indictments. I felt very sad. Judge Luddig is the only conservative that I have heard speak that I really like. I thank him for his wise input and he is kind of cute too.

I disagree. I believe DeSantis abides by the Rule of Law and the Constitution. He has made hints at Trump's issues without coming right out and attacking him because he knows how volatile MAGA is.

I believe we do have people out there with insight, moral rectitude and courage and some of us have heard them but the den of thieves and those of ill will have overcome the channels of communication at the moment. I blame bthe corporate cable "news" media for formenting the division in our country when corporate cable networks made the switch in the late 90s from actual news to 24 hour political opinion programming. For expample the "MS" in MSNBC was an acronym for Mircrosoft NBC which was a joint venture between the two companies about a year before channel drift turned MSNBC and CNN from news networks to political opinion programming networks. Microsoft has LONG since abandoned that partnership so WHY is the network stil allowed to use that acronym when they should rebrand itself to something like "PNBC" (PoliticsNBC)? These networks obviously attract an audience who's very identity is tied up into their political beliefs and for those on the bright it is motivating them to commit acts of violence in order get what they want.

In my opinion the criticisms against the conservative majority SCOTUS (two justices corruptly seated) are justified. The weak excuses given to overturn Roe v Wade and to take power away from the EPA to enforce its own regulations go too far. And now there's the removal of affirmative action and as a woman if not for affirmative action I would have certainly lost opportunities in the corporate world that were otherwise unattainable. Thankfully Harper v Moore was put down. We were a hare's breath away from having majority state legislatures determine the outcome of future elections which would have made voting moot. It was too close for comfort. All of this pales in comparison to Politico's reporting on the financial machinations of certain SCOTUS justices and their refusal to follow simple, basic rules of ethics and accountability that are applied to all other judges.

The “non-partisan” claim, er, doesn’t stack up when 4 candidates, not 2, were registered on the Presidential Ballot in all 50 states in 2020, but I see no videos on the others, at least recently. I would love to see you discuss the constitutionality of gerrymander laws that overwhelmingly favor two parties when there is always more than those two on the ballot in all 50.
