A Florida woman was arrested for giving a set of car keys to her intoxicated friend. Nine minutes later, that friend crashed and killed a man on I-4, deputies say.
Polk County Sheriff Grady Judd said this was the first time in the history of the sheriff's office that they've brought this charge on this set of circumstances.
"[English] directly contributed to the death of our victim by allowing Ms. Bruno to have those keys and to drive away from the Wawa station despite the fact she was intoxicated, she was smashed, she was ripped, she was drunk, she was everything you could think of," the sheriff said. "[Bruno] was not just intoxicated, she was rip-roaring drunk. She was a 0.207 on the breathalyzer that night, hours after the crash."

@@updownstate That is a under statement. By law many would have been arrested on the spot for public intoxication and the vehicle would have been towed. In some states if the person had keys in there position they would have been charged with a DUI, and that may very well been why she dropped the keys in the bathroom knowing very well that she drove the car to the covenant store and by having the keys would have been a automatic arrest at that point. Still the officers are at fault for this and the store is at fault twice. One for giving the keys over and two for knowingly giving the keys over two a person that does not own the vehicle and that person not being insured for that vehicle. I have one close to this, I put a guy in jail for DWI *twice in the same night.* I was an Austin Police officer and arrested a man one night for DWI. At that time our impound lot was closed and the city had no contract with a towing company so our orders were to park the vehicle legally somewhere and lock it up. I put it in a vacant, paved parking lot. After booking the man into jail I went back to where the car was and parked across the street to finish my report. To my surprise the man I had arrested showed up as a passenger in his lawyer’s car. The lawyer gave him the keys and the drunk proceeded to drive away. I called another officer over to follow the guy and make his own field observations about his driving. He arrested the guy a second time for DWI. I didn’t want to personally arrest him twice because his attorney might allege harassment. There is a process in Austin called the _Hobby Rule._ A drunk driver doesn’t have to spend the night in jail, he can be released to his attorney immediately. This is because one time Lieutenant Governor Bill Hobby was arrested in Austin for DWI and his powerful attorney convinced the shift captain to turn him loose. That set a precedent in just Austin, no other city in Texas. This drunk’s attorney was not prosecuted. I lost my first wife when a drunk driver hit her head-on on the highway. So many people lose a loved one this way and they feel helpless. At least I could do something about it, I arrested every drunk driver I could find and never lost a case.

Yes the bartender can be charged in Texas. My mom and aunt were bartenders in the 80s and 90s in Texas. They both was cursed many times for not overselling to drunk's..... And many of times would take the keys from them and not let them have their key's until the next day. Most of the time they would be told thanks so much for not letting them drive. I think that it is a good law try to stop over serving.

Two different questions with two answers. The public intox arrest in Florida requires someone to be a victim of a disturbance. Meaning someone willing to go to court later which is usually difficult to find. (I dont want to press charges I just want it documented is a common phrase) Secondly the Dui charge requires the person be in the car with the keys. She was out of the car and separated from the keys. They did not drop the ball. They operated with the constraints of the statutes. The two adults that dropped the ball are the two under arrest.

What surprises me is the fact that in the two bars where she got drunk, those serving her alcohol must have seen what was happening to her and apparently kept on serving her regardless. Here in France, and I'm sure it must be the case in other countries, they would be just criminally liable as her friend and perhaps even more so. Any barman or barmaid will know instinctively if a customer is drunk or not, either because they obviously know how much alcohol they've served her or by her behaviour. So she is drunk in Wawa and her car is outside and she don’t het a DWI? The cops should of arrested her and this would of never happened.

So I’m confused…she drove to the Wawa drunk. Was witnessed drunk by everyone. The police didn’t think to arrest her for DUI based on that alone?

Isn't "intoxicated in public" a thing too?

@@williamedwards4151 In some places yes. But not every city has such laws and some do not enforce them if they do. Where I live the cops wont bother you for being drunk outside unless you are causing a problem.

I think it’s cuz she technically wasn’t behind the wheel so they can’t arrest her for dui maybe

English was arrested on Wednesday in Hillsborough County. The Polk County Sheriff's Office said her criminal history includes four felonies for driving on a suspended license (habitual offender), child abuse, fraud and grand theft.

First place, my heart goes out to the family, second of all the blame after the fact falls soully on the officers that should of arrested her for public intoxication, the blame should be fully on the Sheriff for not fully training his deputies, and then trying blame someone who was fully intoxicated.

The last bar they were in should also be held accountable.

Not really because people personally buy liquor from stores and who is limiting them ?

What about the BARTENDERS who served her ??
@nunya2954
@nunya2954 2 года назад
What about them? They didn't make her get in a car and drive. Another thing, it would have to be PROVEN that they were the only place she drank that day to get that drunk. She could have started drinking at home, at a friends, in her car, in someone else's car. So just STOP IT. It's also called ADULTING, ADULTS are responsible for controlling all aspects of their lives, that includes drinking alcoholic beverages, smoking, over-eating and all other aspect of LIFE. You need to grow up yourself if you think bartenders need to be accountable for other adults actions. Another thing, Bartenders don't OWN BREATHALALIZERS, AND accusing or making false allegations on someone's sobriety is unlawful and detaining someone is also unlawful, you can't hold someone against their will and if you do and they are NOT intoxicated, they can sue you for false imprisonment.
