You can settle both federal and private student loans. The key is that you have to have defaulted on your student loans BEFORE you can negotiate a settlement. Private student loans get better settlement offers then do federal student loan compromises.

If your are making some sort of payments monthly will the loan still go in default

Tate is right. Private student loans can be reduced, especially if they were made with over zealous claims about the value of a degree from a particular school. You may call the Private Student Loan Helpline 888-669-1064 to discuss if your private loan is a good candidate for a meaningful reduction and settlement.

My wife has a default on her student loan not me we were going to jointly filing taxes together can they still take out all of our refund . I'm the only one making the income.

Do you need to have your student loans in collections to negotiate a settlement?

Not necessarily in collections. But you have to be in default. With federal student loans, that automatically means your loans are in collections. With private student loans, you can be in default but your loans are still with the servicer.
