Railfan Harassment!

I was minding my own business chasing trains on the UPRR Cuero Subdivision with my boy on May 17, 2020. We stopped at the crossing on Old Cuero Road near Yoakum, Texas to get a south bound coal train passing the defect detector at MP 68.8, as I have done many times before in the past. After standing out in the heat with my boy for about 30 minutes or so, I decided to park in a nice shady spot on the side of the road. While setting up my camera in the bed of my truck, to shoot over top of any vehicles that might obstruct a ground level shot, I was approached by the residents of the house that I had parked nearest. As my camera will show at the end of the video, I wasn't on thier property, and I never filmed thier residence or their persons, except the wife (who looked more like a wet dog than a lady) who was at the time standing on public property and had no reasonable expectation of privacy. This is EVERY second of footage I filmed at this location on this date, and other than the addition of the intro and subtitles, it has NOT been altered in any other way. No footage was left out, except for the last 20-30 seconds of the encounter (which wasn't filmed), when thier big ass dog walked away from my truck and I saw an opening to break down my camera and try for a different location with less stupid ass motherfuckers present. Was I in the wrong? The local sheriff's office doesn't think so, and neither do I.
Side note: I don't recommend you conduct yourself in this manner when out railfanning and approached by unreasonable persons, but if you do MAKE SURE YOU ARE IN THE RIGHT!

The Karen's natural habitat usually consists of retail stores and fast food places. They can stealthy appear out of nowhere hunting their prey. However, in other public places there are no managers to prey upon. This and the result of wondering out of their natural habitat leads to confusion and they become hyper aware of their surroundings. One theory is that it triggers a hormonal reaction and they become aggressive. Researchers have been experimenting with decoys such as inflatable fast food restaurants that can be placed at a safe distance from everyone else to lure them away but it's still in early development. If you're in a park, it is recommended you set up a decoy barbecue at least 100 yards away to distract them. Tune in to the Discovery Channel this weekend for a special hosted by David Attenborough.

I had an encounter with a sheriff's deputy in the early 1980s when I pulled off the highway to wait for a train coming down from Donner Summit in the Sierra Nevada range of California. He pulled in behind me, got out of his car and immediately asked me what I was doing. I told him I was waiting for a train. Long silence. The then asked me if I had a gun. I told him yes, in my car. Long silence. Confused by straight-up honesty, not knowing what to say next, he then told me if he caught me shooting at any of the insulators on the telephone poles, he'd arrest me. Then he stomped off to his patrol car, got in and drove away.
@mopar_dude9227
@mopar_dude9227 3 года назад
First, in all states, it is illegal to stop on the side of a highway unless you are broken down. That would be why he stopped. As for the gun issue, they were probably having problems with someone shooting the insulators on the power lines. I knew a few idiots when I was young that thought it was a fun thing to do. And for the long silence, he was probably trying to figure out why any person would stop to watch a train go by.

Sadly, there are railfans (probably less than 10% )who disregard so much when railfanning. I saw a teenager once while watching a live stream, use a FLASHLIGHT to add lighting and shined it on the cab as they went by. I eventually called the cops in that area (they thought I was kidding, seeing I'm 250 miles away from the location but showed up and actually did something!) . I try to always be courteous, not be in a place to concern the crew, or be rude to anyone, and have even asked before if I was OK where i was.. I'm sorry you had to go through this but good on you for showing the do and don'ts! Keep up the good work on your vids! I used to live by BNSF's Fallbridge subdivision in Washougal, WA. One night, I was taking photos of a BN train at the 6th street crossing in Washougal. After the train passed, I got confronted by two women who had a young girl with them. One of the women asked me if I was taking pictures of the train. I said yes, and the women walked away. But they came back and started doing things like pretending to take photos of me and my little pickup that I was sitting in. They pretended to write my license plate number down, and just generally acted like I'd done something wrong. Kept watching me. I didn't understand why they were doing that, but I eventually got it off my mind. It was later when I got the photos back, and I saw that they were in the pictures with the train in the background. A few weeks later, I found out that the house I'd been parked next to had been used for a meth lab. These women must have thought I was with the police, or a neighborhood watch and was taking photos to turn them into the police. Stupid. I'd never seen these women before in my life, did not know anything about them or that house. But, honestly, they would not have had to worry about my being there taking train photos if they had not been doing things that are illegal.

Goodness me, I hate when people are like that. I’ve never experienced it myself, but I know what situations like these are ridiculous as seen here. Railfans are just minding they own business enjoying documenting trains, and people come to disturb them for whatever dumbass reason like this. As you stated, as long as the railfan KNOWS they’re in the right, they’re ok.

I've seen videos where the public has been attacked and threatened by railroad employees from the opposite side of the road from where the tracks are, just for videotaping trains. And they call the railroad bull out, or the county sheriff, and get people ran off the public road, which we pay taxes on, because of it. Why can't railroad people understand there are actual railroad enthusiasts out here?

Apparently, not all Railroads are alike. I am a Retired BNSF employee, and this is BNSF's policy: "BNSF appreciates its railfan photographers and thanks them for their interest in BNSF and its trains. For safety reasons, BNSF can't grant access to its property for photography purposes. Photography of BNSF operations must be done from a safe location outside of railroad property. Encounters between BNSF police and photographers are generally casual in nature and not documented unless there is a criminal violation or circumstance that would warrant further law enforcement action or enforcement. BNSF Police reinforce guidance on this issue to officers in the field so that continues to be common practice. We value the support the rail community provides to our officers and rely on their continuing understanding that the intent of any contact by police is part an effort to further the safety of our railway and the communities where we operate." If you have a bad interaction with a BNSF Employee and you are not on property, turn them into the nearest Trainmaster.

If you park in front of someone’s house, it’s technically not public property. The homeowner is responsible for mowing that, not the city or municipality. If I mow it, it’s mine. I live across the street from a church. They have limited parking and often park at the edge of my yard. I allow it as long as they don’t block my driveway. I still don’t like it but I just let it go. That’s probably the case for most rail fans. The homeowner is accommodating and friendly. But they don’t have to be.
@TexasSpecial91
@TexasSpecial91 6 месяцев назад
Incorrect sir. Just because you mow it doesn't mean you own it. Where I was parked was across the drainage from their property along the side of the road. It was public, not private property. That's the law in Texas.
@gregrowe1168
@gregrowe1168 6 месяцев назад
Ok, not exactly what I thought you did. I assumed you parked on the shoulder at the edge of their property. My apologies.
@TexasSpecial91
@TexasSpecial91 6 месяцев назад
@gregrowe1168 either way, under Texas Law, roughly 25' off public roadway on either side is considered public right of way. Ditch or no Ditch. What you were saying MAY in fact be the case....depending upon where you live.
@Fantazier1
@Fantazier1 4 месяца назад
Better check your county records @greggrowe1168. Most properties along side a road will have an easement where the public is allowed. I know my property does. I have a culvert/ditch in my yard. I maintain the grass in the culvert/ditch but the township maintains the culvert/ditch. As an example, the Township replaced the drainage pipe in my driveway because it is within the easement. Free of Charge by the way.

I had my boy with me on this chase and the location before this, we’d spent about 45 minutes in the sun waiting for the train to pass. Where we were parked in the video, we were under the shade of a tree. That’s why I parked on that side of the road

That crazy lady ruined some perfectly good audio. You were in the right clearly, because you were on public property. Don't think that there are laws stating that you cannot film on public property. Unless of course someone asks not to be recorded, which clearly this Karen did not want. However, in the state of New Hampshire (where I live) you have the right to record someone without consent if you feel threatened. But seeing as this video was posted, the police probably didn't care, and realized that you were all set
@ralfie8801
@ralfie8801 Год назад
If you’re on public property and you can see it with your eyes, in these United States we live in, you can also video it, no matter what anybody says. You don’t need their permission to video them if they’re in a public area. If they mess with you, have them arrested for assault.

lmao the same shit happened to me in Romania, except that i was at a railway station and someone who pretended to be a ”security guard” (even tho he didnt legitimize himself in front of me) told me im not allowed to film the station cause its ”state owned property”. and to add to the ridiculousness, the stationmaster sided with this dubious person and even wanted to talk to my dad on the phone. so really, i feel the pain. it would be the cherry on the cake if someone unironically told me ”why cant you enjoy this hobby from home?”.

I would get a little worried especially if there were kids swimming near by. Lack of communication and understanding from both side would be at play here.
