The plaintiff says her careless neighbor started a fire and burning debris damaged her car. She claims he backed out of his promise to cover the cost of fixing it, so she’s suing the landlord. The defendant says there was no damage and claims the plaintiff is just looking for a free paint job.

You can always see the reason people should never be a landlord anywhere in the Northeast US. The tenants are always looking to sue the Landlord and not pay rent. You can see from the "on the Street" people answers...it's always the landlord.. that is the reason why there is a housing shortage. We sold all our properties. the judges always rule in favor of the tenant and the landlord is helpless. NY, NJ, CT, MA, RI, DE, VT, ME, NH, PA, DC, CA, WA, OR, CO, - stay away from being a landlord anywhere near these states.

This is happening thousands of times a day.. and in NY, the tenants always win. We had a relative living in our 2 family home in NYC, we lived there with them for 25 years. the rent was never raised.. still $250 a month. same unit next door, $1,900. We wanted to sell and gave the relative 1 YEAR to find a new place. They refused to leave. 3 YEARS in court to get them out. NYC judge kept giving them another 3 months to move. Then the Judge blamed us for creating the problem by never raising the rent..So that the tenant budgeted $250 a month, and now WE CREATED the problem.. BTW: the relative/ tenant didn't pay rent for the entire 3 years. That's what liberal Judges have done to America. The entire housing system in about to collapse - since it is Imposible to be a Landlord anywhere in the Northeast US or west coast.

There are property insurance policies that would incur little to no premium increase for a claim like this. God bless

If she had USAA auto insurance she should have absolutely filed a claim. They are the insurance company that advocates best for their clients.

If USAA finds any fault with the landlords they will go after them for repayment.

The one who started the fire is the one she should go after and renters insurance should cover it .She waited 2 years after to file court case. Anything could of caused those marks .

she should have put in a claim with the apartment insurance company. they would have investigated this claim. Or her insurance company who would have gone after the owners

The land lord was giving her money literally out of the goodness of his heart - not because he has a responsibility. It was gift at any amount. You can't sue and demand gift giving. I'm honestly sad for her that she doesnt seem to get it. She lashed out at someone trying to help her. Cant sue the fire department because they were just doing their job. Sue the man who started the fire - if he even has any money left. Other people and the city I am sure are coming after him. Or file a claim on your own insurance. She doesnt want to file a claim for the same reason the land lord decided not to. Neither want their insurance to go up.

When someone commits a crime like arson... You have to go after THAT person. Landlords are not responsible for the criminal actions of other tenants.

The title is wrong it should be "Good Tenant". In the end the public still wants the landlord to pay when they should be blaming the bad neighbor.

My witness was present, and she doesn’t say anything about being previously told. Seems like she was barely telling the home owner about the other incidents. But how the heck would you know the guy caused another fire but the owner didn’t

Tenant caused the fire, and insurance for the building would have covered, because that is what insurance is for. Landlord doesn't have to make a claim if he doesn't want to, everyone else affected by it, can, and should.

I am glad the defendant won b/c I don't think the plaintiff had that much damage. I thought the $400 the father originally offered was probably fair. Having said all that, I don't know what the Judge is talking about that you don't go threw the landlord and should have went after the neighbor. I have lived in apartments/townhouses my whole adult life and never have had this be the case. At every place Ive lived you are told to go threw the landlord not your neighbors.

I don't know much about cars but does the $3400 seem reasonable because that figure seems insane for very minor damage.

It's been 2 years since it happened. Why wouldn't she have went through her car insurance way back then if there was actual damage and then went after the person who is actually responsible for the the damage. The land lord is not responsible for her car. It's crazy how her pictures show stuff and his doesn't. I think her pictures are before the car was cleaned off.
