I’ve watched both women being questioned and the bias is unbelievable. After losing her husband & unborn child, Kristian was asked if the child was her husbands and if her husband was an illegal immigrant. Shana, the woman who killed Kristians family, was told happy birthday, asked about her childhood, and offered a glass of water. It may have been her defendant asking questions in this video, but still my heart hurts for Kristian
That's exactly why, it's the defense questioning her so he is being soft, trying to humanize her as much as possible to have jury sympathize. This is sickening she started by admitting guilt but then started blaming everyone else for HER "worst" mistake!

Alot of this was the the attorney defending her against the picture the prosecutor painted about her. He was painting her as an accused drug dealer, a drug user, and now a drink driver who killed two people. Had he not questioned her about this the jury would have not considered probation. I'll admit playing the victim is pathetic. However, the prosecutor was bringing up her past charges she wasn't convicted on. Which should have been thrown out. I don't know what this woman is really like . But both attorneys are just doing there job. One to get a solid conviction with lots of time, and one to get the least amount of time and probation. No doubt she was lying about Alot. Lots of fake tears, heavy breathing, trying to cry. She looks down every time she lies.

I don't feel an ounce of sympathy for this women.... I had a shitty childhood but im not out drinking and driving. She may not have meant to kill anyone. But she made the choice to drink and she made the choice to get behind the wheel. And that choice lead to the death of two innocent people.
Everybody has their own path in life. Just because you didn't drink & drive does not mean her life should be just like yours. Some people are weak and timid, some people are stronger than horses.
That is why commercials are made about drinking and driving even cellphones as well to prevent accidents from happening but do they obey obvious she didn't sadly lifes were taken and that is what she's going to live with I pray for both families may they find peace within themselves
I feel sympathy for her. I don't believe she's a bad person. Yes, of course the decision she made was dumb and it cost the life of a man and his unborn baby and left his young woman , wife and soon to be mother qurg an unbearable heartbreak. I feel bad for both.
I saw my ex boyfriend laying in a casket covered in cuts, bruises + swollen. He looked nothing like himself but his parents had an open casket to show us all what happened if you drink & drive. He was a mile away from home. At 29 years old I can say I’ve NEVER even had one drink & drove. It’s one thing that I will never do and won’t ever allow anyone close to me to do either.

If any of my children did something like this, they would not be bailed out and I would expect them to face the consequences of their actions. Imagine being Kristian’s or Fabian’s parent and hearing the possibility of this woman getting probation. You would likely be furious.

14 years is the maximum sentence for the crime so if white privileged had any impact on this case she would’ve gotten a lesser sentence not the maximum.

I'm seeing a lot of comments about her being asked about her childhood. It's the duty of a forensic criminologist to compile a pre-sentence report that basically informs the judge and court about the accused as an individual. I've only been to a handful of lectures bc of this Corona outbreak but my view on this is that this is what they would usually do. They need to identify the aggravating factors (worsen the sentence) and mitigating factors (lessen the sentence) to fully come to a final verdict
I feel like she should not be able to go out on just probation so easily. Because people will think it's okay to commit crimes by being intoxicated or under the influence and that's where I believe the system is corrupt.
No matter what happens to this woman in her life she should never be allowed to drive anywhere again. There is nothing that she can say or do that will be enough to make it up to the wife and mother who survived.

I made sure I did everything in my power to be nothing like the bad in my childhood. No excuses. She knew what she was doing when se got behind the wheel.

Glambert Gomez THC should be acceptable for anyone to use that needs it. Don’t drink or be under the influence of anything and drive because it could lead to a terrible accident. But let’s not blame and demonize THC when it helps a lot of people with anxiety and depression. I personally don’t use THC but I see the benefits it has provided people around me. Not saying this has anything to do with this woman’s case, I think she should be in jail forever for what she did, childhood and drug issues aside, she should pay.

@@shann5331 I was gonna say, I used cannabis for a while when I was on my period.. or had a headache, or nausea or anxiety (I had bf's who smoked regularly so very easy access even tho I'm not a smoker myself) so it doesn't even need to be prescribed or some chronic illness to feel the benefits.. cannabis should be taken out of the "drug" conversation and SUGAR/coffee/cigarettes should be considered instead

Wow! This female is crazy. Zero remorse for her actions! She killed a man and unborn baby. Many of us had the same type of terrible childhood...yet we don’t do drugs or drink and drive. My father was also verbally, physically and emotionally abusive but I’ve never used that as an excuse for anything. I also suffer depression, PTSD and anxiety...again, she’s not the only one that has problems. Why is it everyone’s fault except her own? We are all responsible for our actions...take responsibility. Stop making up excuses! You are a pathetic human being (if you can be labeled one). That poor girl Kristian will never get her husband or baby back. Why should she (defendant) get to enjoy life? UPDATE ON KRISTIAN... Her last name is no longer Guerrero, it is now Cardova. She has since remarried and had one child, a son named Thiago. She is thriving, and of course, still smiling. As a friend of the family, I ask that you DO NOT try to look her up on social media, DO NOT instant message her, leave Kristian be as she is, she is happy, she is doing well in life, and of course the death of her first husband and first son are forever engrained in her mind, but her new marriage to Mr. Cardova, and her new son Thiago are her current reality. Leave Kristian be and please do not Google search her. She asks that everyone who isn't close family or friend, anyone who doesn't know her personally, not to bother her nor message her at all. She does not want to be harassed, nor to relive that fateful morning she suffered the loss of her child and Fabian. Just leave her alone and let her live her life as is. Thank you.

He's presenting mitigating circumstances to try to get her a lighter sentence. It's pretty much all he had left to work with since she already pled guilty.

She knew drugs were in the house. She had a choice to not live there. She did drugs, drugs that were in the house she lived in, that made those same drugs hers.

I noticed a few times during certain questions, she would act upset & like she was about to cry while speaking. But would never shed a tear, & as soon as she was done giving her answer; she would be absolutely fine. I think she feels bad for what happened, & i dont think she thought it would happen to her. I feel bad for both parties. What the victim went through losing her unborn first child and her husband is unfathomable. I can't imagine what she went through. As a recovering addict, I feel bad for Ms. Elliott. Addiction is an insidious horrific disease. She obviously didn't intend to kill anyone. Yes, did she make the wrong choice to drive? Absolutely. Alot of people have driven under the influence. Yes, she made comments in the past towards the victims that seemed callous and unsympathetic. I chalk that up to immaturity as she is what? 21? I do feel like she is TRULY remorseful. In the video, when she was wasted, she even showed geniune concern, and remorse. I have driven drunk before and by the grace of God, I have not hurt anyone or got in a car accident. This is just a heinous crime and situation. Again, as I said before, I feel bad for both parties. Obviously, my sympathy is strongest for the victim and get deceased husband and unborn child. But it does not deter me from being sympathetic as well towards Ms. Elliott. I think it's sad when people are condemning her as it is obvious this wasn't premeditated murder but a horrible choice she has made. Remember, she is a 21 year old college student. We can all relate to bad choices we have made in our past especially around that age. I am not saying she doesnt deserve her sentence. She definitely does as she needs to suffer the consequences of her horrific actions. But she does deserve forgiveness.
Drinking and driving I’m sure everyone has done it. But her doing drugs wasn’t going to lead her nowhere. This should be a wake up call. Or maybe it will stay dark for her and she’ll think there’s nothing for her

I think every school in this country from Jr High, high school Thru college should make every student watch this trial and have a test on it. 🤔 The profound impact that this trial will have on students is beyond immeasurable, compared to what is shown today. The amount of lives that could potentially be saved is real because this is a real story and that is what kids can relate to. I wish I was on that jury and I made that defendant go around this country from school to school, telling her story of the worst mistakes she’s ever made in her life and how it killed a husband and his unborn child.

Baloney. I'v been in courtroom numerous times and learned to recognizes liars. Her demeaner on the stand speaks volumes; we know exactly what this person is going through "emotionally and mentally" - she is a liar, and everything she says is a lie. Kristian, despite what she has gone through, expressed wonderful insight into this "murderer"'s so-called apology. But worry naught - the murderer will be out of prison in five years and return to drinking/drugs while driving and living the life of tubing/college.

BTW..In this particular case, the sentence given in 2018 was 7 years in prison for each of the victims which will run consecutively. If she serves the full fourteen years she will be let out with no other provisions. Her earliest parole hearing is sometime this year, but it’s not likely she’ll make parole on the first attempt. Even if she makes parole eventually, she will have a ten year probation. Your five year prediction is already debunked.
