America's sorriest Police Department is not capable of policing their own bro. That is why the Department of Justice has been babysitting them for the past ten years. I fully expect federal charges to materialize over this. Patience grasshopper.
Fun fact - when those charges get dropped they can still be seen on a thorough background check. Your record needs to be EXPUNGED. I know someone that lost a full ride scholarship over something like this.
Police union are strong, i live in san Antonio and this one cop gave a homeless person a hotdog bun with dog poop in it. He was fired then reinstated by an arbitrator. He was fired agin for another incident and again was reinstated. He was finally fired a 3rd time and lost his final arbitration…
The poop police man was “officer: MATTHEW LUCKHURST”, u can look him up. This scumbag decided it was a good idea to poop in the ladies room, not flush then smear nutella all over the stall. At the downtown bike patrol substation. He also gave a homeless man a poop sandwich, which included bread and dog poop in a styrofoam box… he got out of that one cause he said his intentions was for the homeless man to dispose of it…
Never submit to field sobriety tests. They aren't being used to dispel their suspicion and they cannot help you out. Stick with only what is minimally required of you, no more, no less.
Exactly. Police departments earn incentives for DWI arrests. Not convictions, but arrests. The field sobriety tests are optional. Also, think about this. It is 100% legal for the police to lie to you.
@@eddie6898 FST's are used to build probable cause to arrest you in the first place, so if that's their plan, they are going to do it either way. Find any criminal defense lawyer and they universally agree - don't do the field sobriety tests, because they can only hurt you. In fact, if you refuse to take them and they can't build the probable cause, it's possible they won't have enough to arrest you at all. Remember what I said about doing the minimum requirements? "Under New Mexico's Implied Consent Act, people driving in the state agree to be subjected to a breath or blood test" So that's all they can legally require you to do. Now then, if you refuse to do that, there can be other consequences, such as having your license suspended or revoked for a period of time,. If you really were drinking, a refusal may wind up with lesser consequences than what you might otherwise get if they can prove you were DUI, but that's a complex situation you should communicate with a lawyer on directly should you ever face such a situation. I rarely drink as it is, and have never got behind the wheel in an inebriated state. The best thing is to never drink and drive, but the next best thing is to know your rights and legal obligations.
You're going to be arrested anyway. Why make it harder on yourself. They have to get a warrant for any specimen removal. Say nothing but be polite. . Site fifth. Get the lawyer to defend you in court. @@eddie6898
36 cases assigned to this lawyer and police officer alone in the last 6 yrs. Lemmmeeeeeee see...90percent of those 36 cases ended in dismissals... Sooooo... that's 32 cases(dismissals) @$8,500 each is $272,000 that went SOMEWHERE!!!
Bribing the judges and DA most likely. From what I experienced in Jasper County Missouri, the prominent attorneys charge excessive fees in order to get bribes paid to the other officials involved in the bogus arrests (cops, judges, etc)
@@FarckewVerimucc That officer was making some SERIOUS under-the-table cash. Imagine what that lawyer was making. Especially as he likely had MULTIPLE officers on his payroll. Dayum! 😬😬😬
Corruption in all police departments are from the very top to the bottom. Not just a few here and there. They only recruit those that can run with the pack, thats what the psychological evaluation is for.
Exactly. And the police corruption is only in place with judicial power. I found this to be a fact in Jasper County Missouri with it's DAs, sheriffs and police in conspiracy with the judges throughout Missouri. And cook county Illinois is the same.
Because they are getting incentives for arrests, not convictions. One of the officers involved with this was receiving awards from MADD for number of arrests, not convictions. Imagine being proud of that!@@Just..Me..
Honestly, with all the problems APD has had for decades, it's an obvious cultural problem. All of upper management needs to be fired and replaced. Completely cleaning house is the only way. Any company in the world worth it's salt would do the same with a problem location.
Just the statistics should have alerted the chain of command that something was wrong with this officer. If you're getting the vast majority of your cases dismissed or not guilty verdicts, then you're either doing something horribly wrong and how your processing the cases, or you're arresting innocent people. I would think anything over 15 to 20% losses on your DUI cases would be a red flag. There should be a class action lawsuit against everybody involved.
Agree. I’m still trying to figure out how they didn’t know so many cops weren’t showing up to court. It’s literally their jobs. Clearly people were PROFITING from their extortion. Everyone involved needs to be facing prison time.
@karinaz8756 Oh, they will face prison, but they're cops, so they will do a plea deal and get something like 6 months probation and a $200 fine, instead of the 10 years behind bars they deserve.
Debasement. This young man was put through heck I’m so sorry for him, and the shame on the APD and the ABQ legal system is immense. I’m still struggling right now with our chief of police, ran a red light and severely injured an individual and seems to be not remorseful. And the mayor simply defends the chief.
In most states MADD (Mothers Against Drunk Drivers) hold contests with many police departments. They give prizes to officers for having the most DUI arrests. Not convictions, just arrests. So officers are incentivized to make DUI arrests. Blood tests usually take months to come back, and until they do sober drivers are having to spend thousands of dollars to defend themselves from false charges.
The reason MADD does this is because judges compel those convicted of DUI/DWI charges to make a "donation" (usually around $1000.00l to one of these organizations. These organizations in turn make huge donations to the departments with the highest number of DUI arrests. The whole thing is a huge scam. This is what is known as policing for profit.
My God, is there anything in Albuquerque that is not corrupt? Arresting good people and let the bad guys go. What ever happened to officer Sandy, charged with murder?
What in the world was that about his missing jewelry being held by this attorney who offered to get his dwi charge dismissed? My head exploded! And, they are confident enough to leave the evidence in a phone message????
The federal penalties for bribery of a public official includes a fine of up to three times the value of the bribe, and imprisonment for up to 15 years in a federal penitentiary. A conviction can also disqualify the individual from holding any office of honor, trust or profit under the United States.
I witnessed a home invasion there in May 2013 there was DNA evidence that case and the offenders were never caught because the witness who is me is mentally disabled and a former cannabis dealer and the albuquerque da under Karen Brandenburg did not see it as a case worth her time that evidence is in the police evidence when will it be processed and the case go forward!
There’s a reason Albuquerque is under FBI investigation, the whole department needs to be dismantled and rebuilt with civilian, real civilian, oversight.
The thought of outcomes being bought in our judicial systems is so disheartening and disturbing. It sucks to think there is, in reality, no level playing field. But it does sound good… 😑
I have NEVER heard of a cop refering a lawyer to someone he arrested! Isnt that a conflict of interest? Second turning over personal property to a defense lawyer breaks the chain of evidence, he could have very easily said when he got to the lawyers home/office that it wasn't there and had the cop charged with theft. It was part of their shakedown to get him to hire their lawyer. And anytime you go to court its a roll of the dice, no lawyer let alone a paralegal can guarantee an outcome.
A case with far less numbers and widespread corruption was settled in Loveland, CO for 400K. I can only image what this will cost the city when they find that dozens if not hundreds of DUI were false.
Just because they are cops, doesnt mean they are ethical or moral themselves. A defense attorney? Go figure. Really, how many sobriety tests does it take?
@@AmandaTexas Well they wouldn't, that's kinda the point. So what is left is what you get. Not exactly the cream of the crop. The best want to work with the best. The rest just exist.
you never take any test or blow into something unless you know you are under the limit. also obey all traffic laws check all lights headlights tail lights etc. before you drive. don't drink and drive, let someone else drive uber or cab. if you need an attorney find out who the former prosecutor was and if he is in private pratice he is your insider.
Dumb ahh attorney 😂😂😂 he guaranteed an outcome to keep off record but forgot to keep HIMSELF off the record saying some bs like that smh lol rookie mistake if you ask me
I'm 65. This crap isn't happening just with the police. I lost my ranch during the Caldor fire. I learned about disaster capitalism during this ordeal. The state stole 189 trees that I can earn $2000 or more per tree with my sawmill. $8500 is chump change. Other officials are making, in my case, someone stole close to 1/2 a million bucks, and that was just my property. When I see wildfires, now I see organised crime, the perfect crime where fires can be started by hired crack heads, if you will, or a single matched dropped results in "billionaires" being made. Don't believe me, google "Forbes: Wildfire Billionaires." Soon, these article will be taken down. There were more, but they are being removed.
Those officers who engaged in that bribery scheme, did not engage by themselves. What they did is with confidence in regards to the superiors looking the other way and not holding them accountable, that is why they did what they did!
200 cases dismissed. At 8500 a pop, that is 1,700,000.00!!!! Split between 5 cops, 1 internal affairs person, and a few others that are lawyers/paralegals. Even if you just split it evenly between 10 people, that is roughly 170,000.00 EACH!!!!! 😡🤬🤬🤬🤬🤬
Albuquerque has a lot of corrupt officers. This is the fourth story in two weeks with this department. Anyone who has tickets/charges here need to get a lawyer and have these officers looked into. Sounds like many suffered from these corrupt cops.
The reason you do not submit to a field sobriety….. listen to your Miranda rights. Anything you say or DO may be held against you …… if you’re told failure to submit will result in something, that’s the same tactic as in getting you to talk…. Refuse field sobriety’s!!!!!!!!!
😈 ~ Corruption and bad cops just became easier in Florida with the bill Ron DeSantis just signed. I don’t know about Texas where this is though. But Ron DeSantis just took away any power civilian review boards have in Florida to help hold cops accountable. The new law allows the boards to stay but they’re only able to investigate the policies of the police department, not how a cop or a group of cops obeys the policies. But that’s use this video as an example. I’m sure the policy about not taking payments to throw away cases was perfect. So the civilian review board can’t do anything else. Even if they see corruption after corruption, they can’t do anything about it because the policy is good, the cops just did not find a policy. So then it’s up to internal affairs to handle it. But according to the video it looks like the head of the internal affairs department was also corrupt. But Ron DeSantis will do anything and everything in order to cater to those people who are lining his pockets and his political sword and shield. He’s conservative, I get it. I would describe myself as a moderate that often leads conservative. Not asking him to sign bills that Democrats unnecessarily gonna be happy about. I’m asking him to do the right thing or at least not go out of his way to hurt communities so that way he can look like he’s tough on crime or going out of his way to hurt the civilian review boards because it’s some thing that the Democrats really push for. So it’s kind of like he wants to “own the Libs”. But that’s not the way you run government. At least you’re not supposed to do that.b
