If there was so much damage why did the new tenant sign a lease to move in as soon as the plaintiff left?

I can’t stand when people rifle through their papers knowing full well they don’t have any evidence there.

Judge Judy knew the landlord was lying

In some states the landlord is in breach of the law if she doesn't do a walkthrough with the tenant. Because she didn't do a walkthrough she has no proof that she's not the one that left the cat there to poop all over in a ploy to keep the tenant's deposit.

Landlords really try to hold on to that deposit. Even though it’s supposed to go into a separate account and not be touched for anything.

The defendant is horrible. If there were so many damages NO ONE would be able to move in four days later. Horrid excuse for a woman and landlord.

Let that be a lesson to property owners who rent to tenants. When Tenant A moves out, do a walkthrough of the unit/ home to determine if there are any damages that can be taken out of the security deposit BEFORE Tenant B moves in. You don't wait until AFTER Tenant B moves into the unit to fix all of the damages and take it out of Tenant A's security deposit. That's robbery!

If it had all this cat urine (which SMELLLLLLLLS) and damage, what new tenant is going to see the place, rent it on the spot and move in? There is no way they would have done that on the smell alone. I don't think there was any major damage or smell. She may have had some small things, but was never given the chance to repair or clean up with such a speedy removal from the place. Plus, she rented it immediately and wasn't out any rent! It isn't like she spent months fixing up the place to re-rent. Defendant is a scammer.

The Defendant fails to understand that if the new person moved in so fast the "damage" could not have been that bad.

This reminds me of my first landlord. They had arranged things so that the new tenant was moving in literally the day after we moved out. So my wife and I carefully cleaned the apartment top to bottom, inside cabinets, scrubbing the toilet, the oven and fridge, mopped the floors, essentially making it move in ready. This was not really our responsibility, but we did it, partly because we REALLY needed our deposit back, and partly because we couldn't stand the though of someone else having to move into our mess. They had the nerve to say we would lose our deposit to pay for cleaning and because they got fined once because we didn't have a parking permit on our car, which was their responsibility to provide us in the first place and cost us a towing fee. We were so mad, we drove diredtly to their house that same night, and stayed on their doorstep until they relented and wrote a check for the deposit.

I love that Judge Judy doesn't leave a stone unturned with the cases before her, ruling fair and just.

I actually believe the Plaintiff gave the Defendant the money order without removing the "receipt" stub. The Defendant saw the stub was still attached and thought, "Now she has no proof she paid. I'll just say she never paid me at all".

You could see the defendant wasn't genuine, she was trying to get as much money out of her previous tenant and the story about the cat, didn't make sense from both sides?! 👍🤑

Well, Well, I wasn't expecting the case to play out that way. Once I heard she was asking for rent back after living there past the 1st I said to myself, that's not going to happen with JJ, lol. Wasn't your typical case.

I don't know if this is the case or not, but sometimes landlords agree with tenants to fix some things after them renting the place. But this should be written in the lease, or documented in any other way, so that it can be proved that the damage was there before the tenant moving in, and that the tenant rented the place with the promise of the damage being fixed, and not as is. The point is, the defendant doesn't have such an evidence.

This landlord failed to walk-thru and assess the property before she allowed a new tenant to sign the lease. If she had done her due diligence, and checked the house over, if the cat had made a mess she would have found it. Maybe there’s a way for the cat to get in and out of the basement. Cats are great at finding shelter. But landlord didn’t check her property so she cannot blame the plaintiff.

It's completely plausible that the new tenant that moved in after the plaintiff moved out began taking care of the cat and keeping it in the basement, leading to the "damage."

Judge Judy is very fair and sees right through the lies. How could there be damage when she rented it right away??

Judge Judy needs to be a landlord. Things don't happen that quick.

Once the landlord got caught in the huge lie about not getting October's rent, her claims about the cat and damage to the property could also be disbelieved She knew that the tenant had lost her money order stub, so figured she would never be able to prove she paid it, so invented that story, although not realizing it exposed her to a charge of fraud. A woman that conniving would of course invent a story about the cat. It is possible that there was some damage, but since it was not so bad a tenant could not move in, it counts as normal wear and tear. She is an untrustworthy landlord who likely scams all her tenants when they move out for every penny she can can get, making the tenants pay for maintenance that it is normal for the landlord to have to do. I feel sorry for the new tenant.

JJ doesn't forgive scammers. Why would you fix anything if the tenant has already moved in? Most landlords wouldn't care

If the defendant was trying to suggest that she was repairing and cleaning during the time the new tentant only had a few things there, she should have brought him to court

I normally don't like public housing tenants but I'm glad this plaintiff was able to prove her case. JJ must've been a good mood since she usually doesn't listen to public housing tenants

It always depends on the judge in rentals. We had a guy get evicted after 6 months, his dog ate half the brand new carpet. The judge ordered his deposit be given back because that's normal wear.

If you feed the animal then it belongs to you.

Stray cats are very tricky about being able to get in property and hide in basements etc. so it seems likely the plaintiff did leave the cat outside when she left and it found away back in. She admits to having the cat inside the house during her tenancy, but it seems like the damage the property owner is alleging occurred when the cat ended up in the basement.

As this is fairly recent, only a handful of years old, there's no excuse for tge defendant to not have photographic and/or video proof of the alleged damages. She put cement shoes on herself with the text message.

You've got to do a walk through and note damage at the time the premises are vacated. Otherwise you can get screwed.

There was no real time lapse between tenants. One moved out and another moved in days later. If there was damage to the apartment, the landlord would have to prove which tenant caused the damage. If she had clean up or repair bills dated prior to the new tenant moving in, that would be enough but the defendant had nothing.

Defendant commits fraud, gets caught in other lies, and expects JJ to believe her that a bunch of damage was done to the property that was so bad that she somehow immediately rented out the place again. Yeah, right lady.

No pictures of the basement that the cat damaged. And was there alone from October 11th to November 1st? That’s a long time for cat to be without food or water

How can there be $1,200 in damages . She would have to have taken a sledge hammer to a retaining wall. Landlord did not come out looking very good here. Tenant came out looking just dandy.

Every money order has a receipt attached to it the plaintiff shouldve kept that yellow receipt proving she paid ugh
