Ripping Off a Customer 

This is one of those rare times that I feel the car dealer really was trying to help the plaintiff.

Sounds like this guy dropped his whole tax refund check at the dealership and regretted it.

In my JM voice...this is a contract's case and the plaintiff is outta gas.

It’s sounds like he was window shopping and got caught up in the idea of really buying a car when they started showing him some great cars. Than when he got home reality kicked in. He really had no business buying a car. SMH

I need to find them. They have amazing patience, grace, and all around customer service. He came back a year later and was still able to get a car. I think he just wanted the money more so than anything. Buyer’s remorse!

That dealership went above and beyond. For this man, especially a used car dealership. I'd buy a car from those people.

Losing $2,500 is better than taking the car you know you can’t afford and destroying your credit. It sucks but it is better.

I knew from the jump he was going to lose, dude why not read the contract before signing it. I’ve watched so many episodes on PC when people buy used cars, no mechanic there to check out the vehicle before handing over the cash & then regrets it & then wants their money back, & then people like the plaintiff who gives a deposit that’s clearly non refundable & then has buyers/rents remorse 🙄. It’s no way you waited a whole year later, Harvey was so rude to that lady for no reason, a lot of us skip his part because we don’t want to listen to him talk 😂

People need to use common sense READ and don't give your card if you're not sure

If the contract said No refunds on deposits. The Plaintiff signed the contract, but unfortunately did not read it before he signed it. He changed his mind after signing the contract.

I don't understand why he was being an idiot, surely going through with the purchase, having a car and simply re-selling it would be better than losing a $2500 deposit and having nothing at the end. This is the prime example of 'cutting off you nose to spite your face'. Up until he took it took court he still had the use of his $2500, now he has nothing to show for it...

What my question is, why did the plaintiff wait a whole year? What happened within that year to where he couldn't / didn't go and try to get another vehicle from them. Maybe he was in jail? But also especially each time he went back the owner said, hey I'll go ahead and still honor your down payment so come back and look at another car. But to wait a whole year with $2,500 still sitting in the dealer's pocket is crazy. Especially since he said he didn't have a whole lot of money to work with. So the only other explanation I can think of is that during that time he must have been locked up. Cause why else would working adult with a growing family give up $2,500 to a dealer for a car and never actually purchase one. He was approved for a loan and everything.

The headline on this wasn’t truthful. He wasn’t ripped off he changed his mind and couldn’t afford it

It seems that the plaintiff didn’t understand that there are fees when you buy a car. You pay the dealer or the DMV, but you are going to pay.

We went to a dealer got finance for a Honda pilot I honestly felt weird about it because of many factors but mainly because I was going to pay almost 19k for and 2015 Honda pilot something wasn’t adding up. We where asked to leave any type of down payment and they said it was refundable they asked for 1500 we left 500$ and we asked them to write refundable on the receipt. I lost the receipt somehow over night we called them the next morning told them we were not going to go through with it and they were very understanding and nice ITS ALL ABOUT COMMUNICATION we did mentioned it before we wanted to think about it and also that we wanted the best price to fit our income they knew first hand that we might or might not get it, we also left letting them know that if they didn’t hear from us to by a certain time to go ahead and relist it and they did. We later ended up buying one cash and I felt better about that purchase sometimes you have to wait for options before you get sold into something you can’t afford

I would have issues with my bank if they reversed the payment...

Family owned business. Plaintiff had a family too . $2500 is a lot to lose and yes he had buyer remorse the same day. Dealership should have just given his money back they lost and gained nothing that first day. They used the non refundable he signed legally to keep his money. Yes it took time but morally did the dealership do the right thing. Can they sleep at night knowing not only did they take from this guy but they took from his family too.

Why would he sue if they were going to give the full amount of credit? They did say it was good as long as needed so it's not unreasonable for him to think he has time (which can get away from you).

Commissioned sales is a hard occupation. People come in and waste hours of your time, then go home and change their mind. Meanwhile a real and actual customer ends up buying with someone else. I’m on the side of the dealer.

I am confident the car dealer was added stuff and the guy realized after signing was a bad deal . But sorry a 15 year old knows when you sign for the car and put down a deposit that is your car ! Time to read and decide if you want is before you sign !!!
