The plaintiff subleased a room in the defendants’ house, but she says the defendants were violent and locked her out of the home. The plaintiff was forced to stay in a hotel and is suing the defendants for the cost. The defendants claim the plaintiff wanted to move in with her Canadian boyfriend, and she owes them rent.

I'm sure if our country would lower the price of rent or have rent control as a means of aliviating high rental prices folks wouldn't resort to this type of thing--they'd have their own places. It's just that it has gotten so incredibly expensive to rent that some folks have no choice--I would NEVER do it. I'd rather work two-three jobs to be able to have my income in place--but this is what our government has done to its people. 😕 I certaintly agree with you, though.

I don't see how the plaintiff's "15-days notice and then we'll see," is legal. The defendant can't rent out the space for the second half of the month because the plaintiff might decide to stay. Payment is by the month, not by the day, week or fortnight.

The 15 days isn’t legal, she would have been still Ont he hook for the rest of the month. But when the defendant illegally locked her out before going to court, she lost all rights.

No landlord can change locks cut utilities or enter a tenet’s apartment without first filing the evection paperwork. Everyone has rights and as much as you want that person gone you can’t violate their rights.

The defendant could’ve won the case… if instead of locking her out when she came back told her she did not except the $300 as rent and she’s going to be starting the eviction process. 😩 but she wanted her out right then that second.

I rented rooms in a house in San Francisco. It's really expensive and older people rented rooms there too. The older tenants cleaned and were nicer than the younger lazy people.

Florida law favors the tenant in most cases and punishes landlord who go the self-help route for evictions. It's really cut and dry.

If what the defendant said about Russ is true, than the plaintiff is the loser in this. Hopefully it isn't true, but I really can't understand why anyone continues to stay in an abusive relationship.

Probably not "abusive" - Russ is probably just an a-hole douchebag, probably (more than likely) just aggressively alpha (strange for Canadians, I know... j/k, Canadians are some of the best ppl on Earth, BTW). They probably had a spat, plaintiff confided in the defendant, of course it's one-way so the truth is never told... I don't think the plaintiff was in any danger of being abused and if so, there's a handful of states and an international border between them so dropping the abusive scumbag would be a piece of cake. Plaintiff doesn't appear to be ignorant in that regard so there's clearly something "in the moment" when she talked to the def about it "that one time." RE: Def's fiance - how can someone be afraid of anyone who's making threats a handful of states and an international border away? C'mon!

Justice was served! Imagine if landlords could just change the locks on you while all your stuff in the house and you have no notice. Meanwhile they was so scared they didn’t set up an arrangement with the police, they didn’t try to get a restraining order, they didn’t even bare minimum tell the plaintiff Russ cannot come over they knew exactly what they were doing and now they owe that poor woman 2100! KARMA is real! They wasn’t scared of her boyfriend they just wanted her out because she only paid half the rent. Lol

"He said he was gonna 'come down and take care of it'. Got scared so I changed the locks." After having an angry conversation with someone who's a handful of states and an international border away. There's no need for any kind of protection from that - bruh's only connection in the states is probably the plaintiff and I highly doubt she would do anything to harm a flea on an animal. Talk about being scared of a whisp in a blue sky in fear of rain...

It’s not fair that she the older woman who was friends and confided about what a jerk her fiancé was would just put $300 when she owed $600. And such short notice! Augh. Ay yi yi. It’s why I bought a piece of land for cheap and dug a hole in the ground and that’s where I live undisturbed now

Actually not hearing noise after falling asleep isn't uncommon. I have keys to a friend's house. One time her lock stuck. I banged on the door, banged on the window to her bedroom. Made enough noise to bring her neighbors out, she didn't hear anything. Several times, I have let myself in, knocked on her bedroom door, made a ridiculous amount of noise & she has slept right through. I'm not sure if I fully envy that level of deep sleep. 😅

This was a bad ruling. You can genuinely tell they only locked her out that night because they were scared she did come back with her boyfriend. The very next day she was able contact them and make arrangements to get her stuff after they knew for sure they were safe. I can see if she was locked out forever but a couple hours to ensure safety after being threatened by a man they don’t know? Naw, I would appeal this

@@91PHS10it does. Subleasing is you’re leasing then turn around and lease it to someone else. So in a sublease you’re typically not the owner

@@TallywackerWench A sublease is when a tenant rents the property to someone else. If they owned the property, it wouldn't be a sublease. It would just be a lease. And they couldn't lock her out, which is why they had to pay her that amount of money for doing so.

You can’t lock them out for not paying rent. You have to follow the rules as a landlord. They could not go to tenant court if they were illegally subletting so they couldn’t go the legal route so they helped themselves and locked her out

She got all her stuff the next day. The only mistake here's changing the locks. They should have added a lock or a security latch so the door couldn't be opened without them knowing. Then she wouldn't have had a case.
