The Supreme Court on 17 October refused to grant legal recognition to same-sex marriages in the country in its verdict. In a unanimous decision by the five-judge constitution bench, the bench said that there was no fundamental right to marry.
The top court said it has referred the decision regarding legislation of same-sex marriage to Parliament. Nonetheless, among the panel of judges, Chief Justice of India DY Chandrachud and Justice Sanjay Kishan Kaul advocated for the recognition of same-sex partnerships. The five-judge bench passed a 3:2 verdict against adoption rights for the LGBTQIA community. While Chief Justice DY Chandrachud and Justice Sanjay Kishan Kaul asserted that queer couples should be given adoption rights, Justices Ravindra Bhat, Hima Kohli, and PS Narasimha disagreed.
