The Supreme Court on 17 October refused to grant legal recognition to same-sex marriages in the country in its verdict. In a unanimous decision by the five-judge constitution bench, the bench said that there was no fundamental right to marry.
The top court said it has referred the decision regarding legislation of same-sex marriage to Parliament. Nonetheless, among the panel of judges, Chief Justice of India DY Chandrachud and Justice Sanjay Kishan Kaul advocated for the recognition of same-sex partnerships. The five-judge bench passed a 3:2 verdict against adoption rights for the LGBTQIA community. While Chief Justice DY Chandrachud and Justice Sanjay Kishan Kaul asserted that queer couples should be given adoption rights, Justices Ravindra Bhat, Hima Kohli, and PS Narasimha disagreed. Very sad to see the judgment. Now, it's going to the parliament, where our educated ministers will take the decision on it. Still, now, a lot of people refer LGBTQ+ community as an insult. It needs to change. That is a good step by Lallantop. We need to talk about this more so that this topic would not be alien anymore.

पत्रकारिता का धर्म है निरपेक्ष रिपोर्टिंग....उसमें पत्रकार का क्या नजरिया है वो नहीं बताया जाना चाहिए। "Lallantop मानता है की ये ...."...क्या व्यक्तिगत विचारों को आगे किया जा रहा है? ... मैं मानता हूं सामान्यतया सौरभ भाई निरपेक्ष दिखने का पूरा प्रयत्न करते हैं...लेकिन ऐसा लगता है की इस विषय पर कभी निरपेक्ष प्रतीत होने का भी प्रयास नहीं कर पाते...खुल कर समर्थन कर देते हैं। जहां तक समलैंगिक शादी की बात है... ( मुझे नहीं पता ये कोई विकार है या नहीं)... इस कानूनी मान्यता तभी मिल सकती है जब की या तो ये considerable वोट बैंक हो...या निहित उद्देश्यों वाले किसी का कोई मजबूत राजनैतिक दवाब हो ( जिसकी ज्यादा संभावना है)...अन्यथा मुश्किल ही दिखता है। मुझे नहीं लगता कि संसद ( असामान्य) मानवीय संवेदनाओं के आधार पर कुछ कुछ ऐसा करने की हिम्मत करेगी की जिससे की अन्य ( सामान्य) संवेदनाएं आहत हो।

बिल्कुल नही सच को सामने रखा जाना चाहिए पत्रकार का धर्म है कि वो रूढ़िवादियों की भाषा न बोलते हुए फैक्ट्स को सामने रखे और ये कोई पॉलिटिकल बात नही है जिसमे पक्ष और निष्पक्षता देखी जाए ये लोगों और समाज के जीवन से जुड़ा हुआ है क्युकी भारतीय संविधान सबको समानता और इज्जत के साथ जीने का हक देता है तो कुछ रूढ़िवादियों के विरोध के कारण इसे किसी से क्यों छीना जाना चाहिए

Adoption of kids by homosexual couples can't be supported, no matter how progressive we become, it makes kids vulnerable, adoption of female kid by male couple put them at sexual risk. It's also proven that kids need parents of both of genders for overall development and emotional absence of even one affects them, mother is extremely important for kids and no man can ever replace her, lastly who are we to decide to give some kids for adoption to heterosexual couples and some to homo, when everyone of us, if given a choice will choose parents that belongs to two different genders than same. Except right to adopt kids, every other right could/should be given to them.

The concept of marriage comes from religion for sure. But the state recognizes marriage legally to make things easier in legal matters, not to legitimize the self proclaimed authority of religions on the idea marriage. No one is asking religious groups to recognize such marriages. But the state can definitely recognize such marriages legally. But let’s be honest. Unfortunately it won’t happen anytime soon because many Hindus for no reason and most Muslims and Christians for theological reasons, won’t like it.

@@kamalpant3089 where did I say that they do? Or where did I blame the Supreme Court? Judiciary’s job is to uphold the constitution and the laws in the light of constitution. What Supreme Court did, isn’t wrong. They did what they could sometime ago by scrapping IPC 377 in the light of constitution. Now it’s up to the parliament to include a provision for LGBTQ couples in the marriage act(s). But it won’t happen because of the reasons I mentioned.

बहुत गलत समीक्षा की सौरव जी ने की है शुरू में। पांचों जजों में दो बात पर एकमत था - शादी fundamental right नहीं है, और, दूसरा, कोर्ट Special Marriage Act को नहीं बदल सकता क्योंकि कई और कानूनों पर असर पड़ेगा। दो जजों ने माना की शादी को मान्यता न भी मिले तो भी बाकी सारे अधिकार बराबर होने चाहिए। यहां पर तीन जजों का अलग मत था और गोद लेने जैसे अधिकार को भी विधायिका के हाथ में दे दिया।

If they (also lallantop) dream of a society which is way too much open or forward in terms of sexuality, then why don't they think of something as substitute of marriage for adopting a child/or whatever. If marriage between only man and woman is conservative thought, then please spare marriage system (which is also a conservative idea), for conservative people. Please explore something else as they explored their sexuality.

So will be your religion one day because there's no scientific proof of any God till now. It will go too. So I don't care about your ethics and values, don't apply them on me. @@gauravdwivedi2224 you are enjoying marriage and everything. We have social exclusion, hardly any family support none of the privileges that society gives you. Still we are balancing things trying to find a life, a family, you have problem with that. Before hating on LGBT COMMUNITY just because they look weird, you should do some scientific research or talk to a psychologist or neurologist - LGBTIQ is not at fault, you are villain in the story, society is. Few people are born with it, few are lgbtiq because of unexplainable reasons but in either case they can't change it. So why make their life difficult.... Just because you are majority?

विवाह एक तरह से तो धार्मिक बात ही है न और इस पर अगर कोई कानून बन भी सकता है तो वो संसद बना सकती कोर्ट नहीं। समलैंगिकता को अपराध की श्रेणी से हटाना सही कदम था लेकिन विवाह के लिए क्या समाज तैयार है ये बड़ा प्रश्न है? बिना समाज के तैयार हुए ऐसा फैसला करना सही नहीं होगा। ऐसे में lgbtq वर्गों के प्रति ही द्वेष बढ़ेगा। मेरे विचार से अभी इंतजार की जरूरत है...
