The Scottish government's victims and community safety minister Siobhian Brown talks to Sky's Trevor Phillips about new hate crime laws in Scotland.
The Hate Crime and Public Order (Scotland) Act makes it illegal to stir up hatred against certain groups in Scotland.
Ms Brown says: "It would be an offence to incite hatred, to be abusive and threatening, stirring up hatred towards an individual which would cause them fear and alarm".

Let’s not forget that this is a blasphemy law via the back door. She cannot define hate. She cannot define fear and alarm. Anyone can report someone and claim they were caused fear and alarm. Therefore anyone can and will claim ‘fear and alarm’ to silence people they disagree with or have an axe to grind with and report them to the police who will investigate. This is going to take up ALL police time - and the police are delighted as they can police this from the comfort of their desks, read social media and emails and do all their work from home even! Much better than being out on the beat tackling burglars, knife crime, physical assault, domestic violence, it’s brilliant.

She lied. These new Scottish laws are just like the new Hong Kong laws banning criticism of the Chinese government. They apply to statements and actions that are read or heard in Scotland, (even if they posted or originate abroad), so your comments on social media, if aired in Scotland, can be reported and investigated. This will lead to some very strange scenarios where someone in England might say something on Twitter, that is legal according to English law, get reported in Scotland, investigated by an English police force, required to attend court in Glasgow, then get convicted for a Scottish crime, despite never having set foot in Scotland before. And FYI the burden of proof lays with the person "feelings", and the simple accusation. The hate crime act wouldnt be workable if it were the rules for a playground. As a mechanism of law, its just going to be used as blasphemy laws, and as a way to arrest the political opposition.

Most men are murdered by other men. So although female on male violence is often a neglected problem don't try and make out that it is anywhere near the equivalent of male on female violence.
