Tenant will happily show their face on TV and say landlords owe them something. That won't solve anything. Only way is to break into their house and throw them out along with their stuff. It is a repossession of own property so burglury case will be bailable. Without flexing muscles they will forever cry. This is not a police matter as its not a criminal offence, its a civil matter.
My landlord (in Mysore) was refusing to pay the advance amount (which I had paid while renting the house). He started giving excuses and later stopped taking calls and was not responding. I approached Mysore police after struggling for 3 months. Within 15 days I got my money. Appreciate the work of Mysore Police. 🙏

@@wonderwoman7557 I’m merely speaking on the basis of statistics. On an average, the blatant criminality of people in Uttar Pradesh is more, the attitude of “do what you want, I’m not vacating”. Landlords in India can be high handed and aggressive in any state. But to have audacious and criminal minded tenants who are not afraid of court cases, not afraid of the police, the authorities, these numbers are the most in Uttar Pradesh.
I am impressed with NDTV and Sanket Upadhyay for their empathy towards a victims of crooked tenants. I never thought that any other mainstream media house would have spared time to cover this issue.

The flat owners are nice people. In Bangalore, I don't think any landlords would have chosen such a nice approach rather they would bring goons and break into the house and throw you out.
Lolz...not true..they don't bring goons for eviction. They themselves are capable enough to get a whole family (even if from uttar pradesh) evicted from their rented house that too single handedly. And believe me, they have otherwise super duper cool and chilled attitude.
Once my tanent also started telling everyone that it is his house. Then immediately I got him vacate my flat. Some of the tenants are very bad people and want to occupy the flat of weak landlords.
Most tenants are garbage humans. Even we rent out our many flats. We have tenants living for 10 months without paying rent. Our next door tenant moved in and locked the door without even paying advance amount. He just said they want to do some puja. We gave them key, but they moved in next day without our permission. 90% of our tenants don't pay rent for months. And get angry if we ask . And when they leave they trash the place where even advance amount won't cover the damages.. news always show landlord's as villains.. but, most tenants are like the one in this video
It took our tenant 7 years to vacate the house after we gave notice. After he vacated the renovation contractor looked at the house and asked if cattle were living in the house. Kitchen is gone, flooring in one room is gone and cupboard laminates were removed completely in the same room. Wood was peeling off. We didn’t even understand how such damage could occur. Renovations costed more than 1 year rent🤦🏻♀️

Indians, including your Sanket Sir community, have been taking away our properties for centuries. First, they come into our land citing poor, persecution victims...and they threaten us out of our properties in one hour. Not to mention that our properties are occupied overnight if we are not around. That's one of the reasons why Indians are disliked.

And everything is online nowadays.. nobody has any rent receipts
This has become a very common thing , if tenant stays even after the contract date then i think police should be allowed to drag them out instead of going to aa civil court which is very time consuming procedure

Lessons learned: The person in possession is the defacto owner not the owner mentioned in documents. The burden of proof lies with real owner to claim their property, while the tenant can exploit this loop hole to buy time and humiliate real owners. Hence, we must choose tenants carefully....
true. One colleague of my had once was such an issue. She broke into the house and started breaking and throwing things around. Court and law would take years
But the tenant can later claim fake charges of being looted etc as their belongings are still in the flat so this might affect the owners in wrong way..

I would suggest just break into the house and stay and no one vacates the property and when they enter take video so they can’t claim. Something was stolen . They can say it was our alternative key we used to enter the house as the tenant verbally allowed us to do so ( it’s a lie but no one can prove it ).
Not a good idea. They are tenants from he'll and seems like serial offenders. They will make a false complain about anything and everything. Only way out is by involving local politicians and building society with some offer of goodwill money to the tenants. The couple later could join a political party and do some service to the people in need and help themselves in situations like this.
No no, not breaking.. there is something better.. take off the lock break in remove electricity fuse. Cutting off water and electricity is a very powerful way against stubborn tenants
We had a same situation a month back . A single lady tenant refused to vacate and was playing around. Please do not go to the civil court instead go meet ADM E in surajpur court and he will resolve this matter in his court. Rent authority is the fastest way to go. It took us 2 months to get this matter resolved.

Many people got murdered in my city but most of the times I don't care. Many animals die but I don't care. Great job by NDTV bringing up such issues which impact common people ! The problem is Indian Judiciary system is screwed up , here squatters have more rights than owners who purchased the property thru hard work and toil !
Happening all over India. Cops say that's a domestic dispute go to court. The court systems is screwed up. Do you expect these rightful owners to live there for years. Take over your own place the old fashioned way. When they are not there get some goondas throw their stuff on the road and occupy the place. There is no justice in India.
People don't even have idea what the govt laws has done. I know cases where poor house owners have lost their houses to tenants. Farm owners to their care taker farmers. Such laws have made people beggars. And the cases run for decades with no justice in sight and enormous money.
And if you approach the police, they start questioning the Land lords and try to blame them that they have rented the house to wrong tenant and it's the land lords fault. How can a person predict? Obviously if something happen only then the land lord will realise. And there is no proper law in India to help the helpless land lords who can't use muscle power. My brother in law and sister is facing the same issue in Kolkata.
This is the pitfall of landlord and tenets dealing directly. In USA, we have property management agencies who will do due diligence inquiry into tenets background, financial status and evict the tenet if things comes to worst of scenario. Landlord and tenets are not encouraged to deal directly with each other

In cases like this there should be immediate action from police as well as judiciary. The tenant should be arrested and taken out of the house if he cannot produce a valid tenancy agreement. This is the most important action to be taken immediately. Tenant should be out if he cannot produce a valid tenancy agreement. If the owner is the legitimate owner with verifiable docs he should be allowed to occupy his premises, irrespective of the matter that tenants assets are inside. Tenant should face his own losses for such arrogance. If authorities don't act they should be punished, separately.
Harsh reality? Do you know how many harsh landlords are there in India? The law provided rights for tenants for a reason. The landlord in this case must be aware of the law and just follow it. Get an eviction order from the court. Not sit here and cry in front of NDTV.

I myself had to face the same in my flat in G. Noida where a Samajwadi party MLA had refused to vacate the house... took me 3 years and loss of multiple lakhs.. stopped paying rent.. stopped paying electricity bill.. talk about nightmarish experiences
In Ireland you need recommendation of landlord to get another rented house and law favors landlord . In Germany if you want to vacate the house you need to inform landlord three months in advance and won’t get advance if landlord is not happy with condition of house . If landlord wants they can take you out of the house.

It is not within 3 days after the lease expires. In USA too, tenants have rights and the landlord has to get court eviction order for the police to take an action.
I faced similar problem, tenants were not vacating my rented place. His cheques were bounced for more than 3 times. In my case tenant had good contacts with local SUb inspector. At the end we vacated the house forcefully by using local groups.
Its happening in kolkata since many years. Many tenants who have been staying on rent since 10 to 20 years in same place have illegally occupied it and still paying peanuts as rent like rs 50 to 200 per month, whereas actual rent as per corporation is rs 8000 to 10000 in that area! Mind it in many cases the landlord appealled in court of law only to hear that court declare that the tenant has the right to stay and cant be removed !!!

There is another matter to those..there used to be a pagdi system, where near market value of flat was taken at the time of renting out.. so sometimes it is not so clear and straight forward. Here the couple looks like genuine victims of a bad intentioned tenant. This news report to help them. Surprised the owner association has not apprently tried to help.
@@rajesh_624 I am aware about pagdi system but even without pagdi many flats in kolkata were rented out at then market price and it increased on some basis like 10% after 2 years and so on. Since the tenants have stayed more than 10 to 15 years at same place so court declares that they cant be evicted. (Its as per Old calcutta rent act on 1970 or 1980s i guess)
I know someone from North Kolkata have similar case but finally after 1 years they vacated there house because the house owner forcefully made them leave.
Please help me i am in complete distress. I have a very similar rather worse situation. I am an NRI and lost my job in 2020 and had to return back to India. I have a flat which is the only property i purchased with all my hard earned money during my stay in abroad. During my absence my flat was rented to a family. Both of them works in a high position. My parents were taking care of the renting of the flat in my absence. My dad is a retired army officer and ag present 85 yrs old. When the covid was in its peak, the first agreement was getting expired. The tenant called my dad and said he is in a different district for a surgery and will not be able to come for renewal of the agreement so requested my dad to have the agreement renewed for next 11 months in his wife's name. My poor parents did not feel anything suspicious and in the humanitarian grounds got the agreement renewed for next 11 months in my tenants wife'name. After few months in the year 2020, I lost my job and had to return back to India. When I returned back, i requested the lady to look for another house and i don't have any place to live. She refused saying its pandemic time and moreover agreement is not yet over. I thought I should wait for the agreement to get over. Before 3 months of agreement termination i sent a notice to her saying, i do not have any plans for renewal so kindly look for another alternative. For this she went to court and got an interim injection against me stating false allegations against me that I had come to the flat and threatened her and all. The fact is that I had visited the flat only once during the construction of the flat. Since then my parents were dealing with everything related to my flat. No one in that building have seen me or my wife. My tenant threatened me to file a case against her if i wants the flat back. I don't want to go that way due to the long court proceedings. I tried to approach district collector, police, everyone but everyone is discouraging me by saying its a civil case and they cannot help. Its more that 2 years now and still i haven't got my flat back. Since 8 months she have not paid the rent. We came to know that she have not been paying the monthly maintenances for a year. And not only that, she have not paid electricity for over an year. She have filed a case against the electricity dept for excess charges. The lady is very influential and have tie ups with politicians. Her husband is not helping us saying that he and his wife is separated now. When I see this family got help from NDTV, I really wish if someone help me to get my flat back.
When an agreement is made govt takes money for it and now when they need their home it's a civil matter? That's Ridiculous. Their washing their hands off from their job. If they cannot get the flat, break the damn lock and take possession of their flat and keep the tenants things outside.

This is a very common practice by Tenants and when you demand for the possession of your flat you have to register a case in court for their evacuation this is the legal procedure it doesn’t matter that you have made a register rent agreement.

Court mein Saalo tak case chalega, there should be a law where as soon as the registered agreement expires the landlord with police can evict them without wasting years in court
As soon as agreement expires this is house trespass, even if it is a civil matter that does not extinguish the criminal offence committed by the tenant as soon as agreement expires any tenant extending his stay is committing house tresspass
All owners of that scheme should come together and take combined legal action and also file combined legal fir against these tenants. Because this can also happen with other owners
There is no legal obligation from the owners part to wait if the tenant does not get other flat or if it’s hot outside. There is no humanitarian consideration required here if the tenant is acting smart when she already knew that her time as per rental agreement is up and she has to vacate. Now the tenant will seek more time on empathetic ground and everyone will support her even when she is at fault here. The tenant knew well in advance she has to vacate and she not finding a place is not owners concern at all. Not able to understand why they cannot get an eviction notice from the court or if not they can approach Police commissioners office to get help. In US if the tenant does not vacate on time, they will have to face legal charges and pay penalty to the owner. Wish our Indian system was strict about these laws and protect rights of owner.

You do sound like a landlord and i tell you, only few of the kind are good landlords!!! Yes, tenants use the loopholes, but if you are just you will realise, tenants should be indulged as they have goods to move and so many factors whilst yours is simply collection of rental!! Your risk is loss of rental, tenants suffer goods damages, transporter fraud, labour, new landlords set of torturous demands, etc. Hence equal notice periods exist for termination between landlord and tenant, but for tenant, pain of moving is much more, so any decent democracy favours the tenant with just reasoning, humanity. @@awesomed007 I have commercial store at the ground floor of my house. And all my Tennant pays only Rs 2000/month while in the market the rent value for such size, location is Rs 25000 to 30000/-. My father is a senior citizen and I am doing a high health risk job at Private company with very low salary. You don't even know what my family has gone through since many years. I didn't able to get proper education when it was required, I dropped for 2 years started working and paid my education fees. And the biggest problem is the medical issues and the bills. These crooked greedy adharmi tenants are wealthy crorepatis are having their own Big Buildings & Bungalows at high society areas but they still neither giving us the fair market rent value or vacating the store. And the loop holes and poor law helps them. I am not alone in this I know many of such landlords in my area. Just 5 days ago one guy took his last breath while while fighting with serious medical conditions at poor govt hospital as he can't afford the treatment because the ultra rich tennant don't want to pay him & illegally occupying his store.
Why dont the landlords just barge in their home and start living cooking and sleeping there. That will definitely oust the tenants. Just keep silent and do your stuff. This living outside on stairs wont do anything it will only make you look weak. Never ever give home on rent and make rental agreement with a woman. Only with a man, not even with both husband and wife. All authorities have sympathy for women . It looks bad to refuse a woman but it's important in the long run.

Individuals or a group of individuals cannot promote discrimination against another group of people because of biases. Do you expect India to become a global powerhouse if there are biases like this. How about all the women who move to cities for jobs? They shouldn't be rented to? So all women should be punished because a few abuse the system? I am from Kolkata. My maternal grandfather was the landlord of 4 houses of his building. The tenants after living there for 15 years had taken over the house. Wen my grandfather wanted them to evacuate the houses, they refused and had him and his wife thrown out. They died in a rented hut a year later. Even his sons abandoned him for property dispute..
