Watching all of your videos. I don’t know what’s going on but I’ve had a cervical spine multiple disc herniations, got RFA done and injections prior. Then also found out and been diagnosed with TBI. It’s been almost year and half and my lawyers haven’t even filed a lawsuit yet. Inwas just informed they want to do pre lawsuit mediation with the supermarket inwas injured at. I don’t like that. Do you think it makes sense with my extensive injuries?

I wouldn't say a jury trial is a hammer. It's more like a bus with bad brakes going through an icy mountain road. The side with the better facts has more tread on the tires, but both sides are at risk of a blowout (rogue judge or jury) causing the bus to go flying over the cliff. That's why, 90-97% of (viable) cases settle before jury verdict. This doesn't even consider years of appeals after a jury verdict regardless of which side prevails.
Well if you prep the case properly then it’s a hammer in the sense that if the insurance company doesn’t pay you your number you’re going to get more from a jury. No one will every trial but trial is the only way to get the insurance companies to pay fair value
@@AttorneyArkady I'll put it this way. I'm a trial lawyer and a crypto investor. Juries worry me more. I probably take 20-30% more depositions in every case than necessary so as to leave no stone unturned. That said, I came up after OJ and before Casey Anthony. Also, I consider 60-70& of judges subpar in some fashion or form. I rarely settle and hardly ever mediate before expert witness disclosure, but if I can get 80% of what I'd consider a good jury award via mediation, I'll recommend it--because living the nightmare scenario is not worth the extra 20%.
Attorney Frekhtman I know someone who had A slip and fall in A major retail store and the Dr's diagnosed them with A Lumbar Spine Injury L5 S1 and is going to require A Disc Replacement Surgery, can This case be settled before the surgery, and how much do A case like this usually settle for?

If it’s a mediation or court appearance you can go. Ask your lawyer if they want you to go. Usually clients either attend mediations or they are available to discuss then settlement offers and provide consent

So what if the insurance company give u a good offer the first time would it be smart to take it like say if you was ask for 500 k and they offer 375 k would that be pretty fair
Yea it depends on the case and all circumstances. 375/500 isn’t bad bc you have to consider going to trial you may spend 2 weeks time and pay experts $20k or more if you have 2 or more doctors , or safety engineering experts , and economists etc. plus you always have the risk of losing or getting less
Yes it should be free. I think you are referring to a case management conference. That’s when both sides and the judge have a conference and decide on how to handle the case including document discovery, depositions, etc. A mediation is different as it is a negotiation to attempt to settle the matter.
