Yeah, if you just let it go you're sending two messages: 1) that the kid can do bad things and get away with it, and 2) the parents can lie and cover up their kid's wrongdoing and get away with it. -- this is less about punishment and more about grooming people in your community to be upstanding neighbors.

The child damaged your property, his parents are accountable. take them to small claims court, simple as that. don't make it more difficult than it is for yourself.

It actually costs very little to file in small claims court. Also, finding out she has money is not retribution, it is investigation. Stuff like this is hard.. it is not about forgiveness because the woman is not asking for it.. it is about doing what is right, taking responsibility and ensuring it does not happen again. The money is minor. Knowing that the woman and her child might walk away from this having learned nothing and not done the right thing is hard to accept. Pay the $35 and take her to court.

When I was young this happened to my family, we were driving and young boys were throwing rocks at cars. It was a warm day where the window was down and went straight through by the grace of God not hitting any of us in the head. This can severely injure people.

@@tolar9 This wasn't even about the property damage for me. People have been killed from kids throwing rocks at fast moving cars. They need to learn consequences for this kind of action. And maybe not destroyed but damaged. It could have caused them to swerve and hit someone else. This is a serious move that kid did that needs to not happen again.

People are emboldened by No Consequence. The kid obviously has a good arm, he'd have no trouble pressure washing your house (or Whatever) for restitution. a) he devalued your vehicle, and you are paying $ for his actions, either now, or at the point where you sell the vehicle at a reduced price. b) $900 is a BIG DEAL. c)Not emergency fund type situation d) requiring the parents of the minor to make this right is not immoral.

Its weird hearing them insinuate 900 isn't enough money to worry about and should be covered by an emergency fund, yet just a few minutes ago I watched a re-run where Dave says 800 is plenty of enough money to care about and go after. And almost the entire Step 1 emergency fund. I think Dave still remembers being broke in a more visceral way than the co-hosts do.

I think this is really bad advice. He should press charges against the child. The child broke the law and what he did was VERY serious and VERY dangerous. It’s only LUCK that there was merely physical damage as a result of the very dangerous thing the child did. Once charges are pressed against the child, part of having them resolved often times includes restitution that the courts WILL enforce. I would also file in small claims court. It’s cheap to file, usually less than $50, and a day in small claims court is not as heart wrenching as they are making it sound. He will be doing this child and their community a big disservice by letting this go. If the child doesn’t receive any consequences for this type of behavior and thinks it’s acceptable, the next rock he throws into traffic may hit a windshield and cause a head on collision...

This boy is being taught by the mom that when you break the law, there are no consequences. Bad parenting. She should see this as a gift from the Lord. He is allowing her an opportunity to teach her son a cheap lesson. $900 is nothing compared to where this kid is heading. He is probably begging for her to guide him but its easier and cheaper to let it go. Well, one day this kid will end up in a situation where he can't just walk away. He WILL have to talk to a judge then. My guess is she has never allowed him to suffer consequinces. Thats why he thew the rock in the first place. Parents need to parent.

There’s no expense and heartache and drama with small claims court over $900. Small claims court is designed to not be a huge expense, that’s why small claims courts have low fees and you’re not allowed to use a lawyer. There are no “pain and suffering” fines in small claims court, either. A lot of what you guys said here is simply incorrect.

I've taken a roommate to small claims court before for a less amount. The dude left without paying his share of the rent and bills. It wasn't much of a headache for me as its illiustrated here. Its more about the principal of the matter. You can't do people wrong without fixing the issue in some capacity, and expect to live a great life! Could you leave it to God? Sure. But, like they said, you have every legal right to go to court.

Bad advice this time. First, Christians forgive your sin against them, they don't absolve you from responsibility for your actions. Second, in nearly every state, small claims allows you to add your court costs and a fixed rate of interest to the damages so that you're never stuck "paying $100 to sue for $150". Third, you sue her AND her husband with his "great job" so you can then garnish his great wages. Finally, there's another pressure to excerpt. "Ma'am, I'm not only worried about my car, I'm concerned that your son isn't learning about being responsible for his actions. So there are two options. A: You pay for the car and you make sure your son is present and understands he is responsible for this money being lost. B: I sue you in small claims court AND I file charges against your son in juvenile court. Which will it be? "

I think the reason they are saying forget about is 1. In some states the parent is not responsible so you would have to sue the kid. 2. Even if you get a judgement she still might not pay and then you would have to go back to court to garnish their wages. They are just saying the headache, the time, the energy might not be worth it because even if you get a judgement that just means she owes it you still have to find a way to collect.

@@i4wolves 2. Is wrong. You don't have to go to court to garnish wages. Once you have the judgement, you just fill out a form. If you can figure out where they bank you can attach to their bank account too.

It is still costing you time and money to prepare the case and get necessary documents with no guarantee of winning and what if she fills bankruptcy? Then you have a judgement and no means to collect it. Should you sue, yes. Do they need to be held responsible, no question All they were trying to say is it’s not as easy as it looks and it takes time and stress, and money with no guarantee of a win and I think all they were saying is $900 might not be worth all the stress it will take preparing for court.

I had someone steal a prescription bottle of oxycodon. He was there painting. He is a cousin of my landlord. My landlord asked me what I was going to do. I told him I was still thinking about it. My landlord told me to pray about it - meaning Christian - do the right thing. So, I didn’t do anything. Looking back about it, I strongly feel that I should have called the police.

Did you ever file a police report? The specter of law enforcement won't get you any money but it should help reinforce the lesson that needs to be learned by the kid and his family.

File a claim with her homeowners or renters insurance. If not send a demand letter for the damages and rental car. She has money, wages can be garnished. If she owns a home put a lien on it. If she doesn’t pay it she will owe a lot more once attorneys get involved. The ethical thing to do is to make her pay otherwise the boy will do worse things to other people with no consequences.

Small claims court fees is less than $100 dollars in most states. As long as he has documentation proving they admitted fault it doesn't hurt to make an attempt. Its the principle lesson that has to be taught. If he doesn't try it will be hard to let go especially if you already feel like you are getting taken advantage off. The guy sounds like he would have been happy if she said she can only afford $100, this lady said I can't pay anything meaning ZERO dollars and the son learns nothing. He is old enough to be held accountable and it does not sound like the guy saw any remorse from the boy nor the mom. Because I am sure if they had the guy wouldn't have felt the way he did and made the call in the first place.

@@A2Kaid Police reports arent admissible in court as evidence. He needs proof so hopefully she sent text messages that she would pay him...that's all he needs really. Photos of damage and estimates. Actually in small claims they are admissible from a search. Still hopefully he still has a voicemail or text message from mom.

I disagree. A parent should always be accountable/make their children accountable for the behavior of their children. Of course an emergency fund is important. If someone else/their children destroys your property, you have every right to ask payment for repairs from them. If they are not able to pay- your emergency fund comes into play. What's bigger is depending on the age of the child throwing the rock that damaged someone's vehicle- a police report should be made. Young vandals should be held accountable. I'm surprised this wasn't discussed.

I had to take a person to small claims court its not that bad. You know your going to win this case. You have to file and you can ask for court costs in settlement. Let her know if you don't pay then the court is going to make her pay with more court costs its her decision to make it right. Your only asking to do what is right here. From her stand point if she says No then you have to take her to court and don't have another option. Or her kid got away with this and no one was held responsible.

Kid really does need to know that there are consequences just taking in consideration that if he gets away with it now and they keep letting him get away with it, he will continue to do things like this and then she’ll be the mom wondering where it all went wrong when kid finally does go to jail for some thing even worse. Better to learn from “little mistakes” than from deadly ones. Parents always told me own up to what you do and fix it, no matter what.

Money has different value to different people, 900 may be like 9000 to some people if they don't have money. The frustrating part is that she is looking for a play station likely for the little brat that threw the rock!!

These answers the guys are giving are the problem with the country now, allowing the kid and her to get off without taking responsibility for his actions. That Only way that kid is going to learn is to take her to small claims court. He won't have to pay anything for the court cost due to the court making her pay the court cost which is normally 1.00 if she isn't acting the fool.

Fill out a police report, contact your insurance company, and they will go after the woman directly. It's at least worth a try since it won't take up your time going to small claims court. Why in the world would you pay for it yourself? At the very worst you would just pay your deductible. It won't affect your insurance rate because someone else caused the damage.

Terrible advice in this video. Unfollowing someone from face book does nothing. Take her to court for the amount she owes. Nobody in this video is LISTENING to what the caller is saying. She shouldn't be buying an expensive video game when she owes this guy money. And if she spend the video game money on his car. then she can teach the child a lesson by letting him know that this is the consequences of his actions and her lack of responsibility. $900.00 might not be much for you guys but.........

Sometimes it is NOT all about the amount of money. It is about the principle of teaching the lesson that people will have to pay for their wrong doings against others. Making the kid accountable for his actions now, will likely result in a more responsible adult in the future.

It's hard...it would be nice if the mom was at least slightly repentant about the situation. But you can show forgiveness and grace and set up healthy boundaries at the same time.

The caller said he doesn't want to make an insurance claim because his insurance will go up. That does not make sense to me. Why would his insurance go up? This was not a car accident or a speeding ticket.

I would have filed a police report right away. Tell them the son thru a rock at your car. Filed a claim with insurance and see what they will do if you have the coverage. Really there isn't a way to prove it and get anything out of her.

The judge will probably order her to pay but that judgement isn't worth the paper it's written on. That leaves you with $900 to fix your truck, court cost to file in small claims, and probably time off work.

Once again the simps are wrong. It's easy for them to sit in their high chair and say nah forgive them. In the real world this touchy feely attitude will get you taken advantage of. Take her to court. It's a hassle for you but also a hassle for her and a lesson for her to keep an eye on her brat.

The boy needs to realize there are consequences to his actions. Call the police, get a report. They should take him to juvenile court and ultimately pay restitution. If you do nothing, the boy learns nothing.

Don't tell her anything. The talking is a waste of time. Just take her to court for your legal fees plus restitution for the damages. There is nothing punitive as you didn't miss work or suffer damages other than to the physical property from the incident. You already went and asked for the money and the moment they say no deal you take it to court to not waste any time.

I say go to court He will have to pay the deductible and higher insurance rates > there son did they said they would pay. Especially when he knows they have money and he has no emergency money Judge Judy would say you must pay for the damage your son did to there car because he threw a rock at your car

The only good advice here was not spending emotional energy on it. Also, life didn't "happen" to the guy, the child committed a crime and now his legal guardian gets to take responsibility for it. The police should've been called immediately and a report filed. Why would you even bother talking to the child's mom before you talk to the police? That's just stupid. It doesn't have to be this big emotional project like they're describing here on the show. She should be the one reaching out to you to settle before it goes to court; not the other way around. If I'm him, then I'm going to be asking for repair plus costs for time and any increase in insurance.

I’m an insurance agent. Take her to small claims court. You can recoup your court costs through the lawsuit.

After finding out whose child it was you should have went to the police and filed a report. The kid thinks it's all right to throw large objects at moving vehicles. This kid could potentially harm someone.

Lol @ the mom saying she can’t afford but going on facebook bragging about how much her husband makes. Mother AND son both need to be taught a lesson, otherwise they won’t be held accountable. They seem like they are use to getting away with this type of behavior.

I haven't read all the comments so this may have been previously mentioned, but why not have the kid take responsibility? He can't pay money perhaps and it doesn't fix the vehicle, but have him do chores at your house until he has "paid back" $900. Wash the car, mow and rake the yard, if there is a garden help there or with livestock. Age appropriate chores of course. Helps to teach consequences and who knows what everyone could learn in the process and how it might better the boy's future.

Very poor advice....filing in small claims is only a few dollars and you can’t get pain and suffering compensation...also you can get a judgement against her and decide not to follow up on collection.....forget her...this could be an important life lesson for her son

It seems like they all have a "one size fits all" response so I knew their answer before listening to their response. Not everyone has the means to have an emergency fund either but they seem to tell everyone to go out and make more money as if it was that easy. The caller doesn't want drama but if the mother doesn't take responsibility, its not his fault for subsequently taking them to court.

How about offer the boy “work off” his debt? Snow shoveling? leaf raking? Yard mowing? Or help you collect food for the homeless. As a mom, I would jump at that! Hope it all works out.

Yes but it still affects your rates. My insurance put a lien against the house that hit me in 2010. Insurance did go up some after the years and it’s on my insurance report. The guy and wife still in live the house. I’ll get my deductible back whenever they sell. I’ve been waiting 10 years now lol. I’ll get it back when they die because I don’t see them ever leaving
