Should you Give Way to Pedestrians at Junctions and How it's Marked on the British Driving Test

Since the update to the highway code there has been much confusion about giving way to pedestrians who are waiting to cross the road at junctions. In this video I explain how it is marked on the driving test in Great Britain and I give examples of when I give way and when I don't give way. I also explain why I think the new rule is not working and increasing danger.
Here is the note from the driving test centre:
The most notable change for candidates and trainers is “At a junction you should give way to people crossing or waiting to cross a road into which or from you are turning”.
People driving or riding a motorcycle will need to take this new requirement to give way to people crossing into account as they plan their approach to the junction. This includes being aware of:
The actions of the person crossing
The actions of other road users nearby
If someone is waiting to cross, they’ll normally be standing at the edge of the pavement, actively looking in the direction of the traffic and the direction they intend to cross.
People driving or riding a motorcycle need to be aware of the person crossing’s actions and those of the other road users, so they can plan their approach safely and take the right action as they negotiate the junction.
Assessment on test
On a driving or riding test, failure to give way to someone who is clearly waiting to cross the road but is standing safely on the pavement would normally be assessed as a driving or riding fault.
This is because the candidate would be deviating from the defined outcome. It’s clear though that our examiners will need to consider all factors, including:
The presence of following traffic
The speed on approach
To the visibility and actions of the person waiting to cross
Whether it was clear the person intended to cross
Serious or dangerous fault
We won't be changing the assessment level of a serious or dangerous fault with the introduction of this new rule.
If the learner driver or riders’ actions place a person crossing at risk, for example if they failed to give way to someone who is actually in the road, a serious fault would normally be recorded.
But the actions of the person walking and other road users nearby will have a bearing on how our examiner assesses the action.
They’ll consider things like:
What they might have done driving in the same circumstances
Whether the actions of the person walking were reasonable and could be anticipated
The presence of other road users nearby
As novice drivers, candidates are more likely to err on the side of caution and this will be considered.
End of driving test centre note.

I love how they have made one of the most simple and easily understood processes insanely complicated. It used to be you got to the edge of the road, looked both ways a couple of times and waited until it was clear. Now you look both ways, see multiple cars coming and have to wonder if every car in the stack of 6 cars one side and 6 cars the other side are all going to be expecting the first car to stop randomly and give way. It only takes 1 car to shunt them forward to end your life. I and most people I know completely ignore this rule entirely, both drivers and pedestrians 90% of the time also aren't even aware the rule exists in the first place. Pedestrians don't read the highway code after all.

I remember when crossing the road was much simpler; you just had to remember the green cross code and you'd be safe. Now, with these new rules, they have actually managed to make a simple process more complicated... I think I will stick to what I know works and wait for the road to be clear or cross at a crossing, call me old school but I value my life!
@bugnazbinnyking1198
@bugnazbinnyking1198 Год назад
It certainly flies in the face of the Green Cross Code. The only trouble with sticking to the GCC is you now have to turn away from the road while waiting for it to be clear - or drivers will stop and try to wave you on. It's happened to me multiple times, and most times there is the other side of the road to contend with and I don't want to be stuck in the middle - so I'm learning to turn away and wait. The other option is to cross expecting cars to give way, and get blared at as they sound their horn like you've stepped onto a race track and you shouldn't be there.
@mattycotgrave1945
@mattycotgrave1945 Год назад
Totally agree with the assessment of the dangers of this rule. Personally, unless the road is clear behind and ahead and the pedestrian is actively looking to cross, I'm going to pretend this rule was never added when assessing the situation and how to act when driving. The worst part of it is that it introduces uncertainty making drivers more unpredictable and that increases risk massively. If they actually want to implement this rule then they should've painted zebra crossing at the junctions rather than introducing this rule which just increases danger. I suppose with the state of some road markings across the UK, I'm not surprised they've gone the cheaper route of adding a nonsensical rule rather than the more expensive option which everyone understands. We'll probably have to deal with this for a while before the inevitable study comes out showing that this rule has led to an increased rate of accidents at junctions followed by a recommendation to junk it.
@aztimms
@aztimms Год назад
Of course if the road is clear behind and ahead why give way anyway - it only takes a couple of seconds to pass them and then they can cross with all the time in the world behind you thus reducing fuel consumption and pollution by keeping moving rather than stop starting.
@mattycotgrave1945
@mattycotgrave1945 Год назад
@AZ TIMMS I agree in principle, but that's what the highway code says we should do :) . If I was making good progress then yes I probably would still not give way as it slows both sides down but if I was coming up to a t-junction with poor visibility then I'd be more inclined to give way. I don't think I ever would on the exit to a roundabout unless there was a zebra crossing there. I think for most drivers, we won't change our behaviour substantially but the problems will appear when a subset of people religiously follow these new rules without consideration of other road users.

As a pedestrian & therefore more vulnerable party I’ve always thought I’d rather wait & go hen I’ve judged it’s safe rather than assuming or rather, hoping that a given driver will stop. I still remember the video where a driver beckons a kid on a scooter to cross a two lane junction & nearly gets him run over because the driver didn’t check the adjacent lane for a car & the kid just trusted him.

I had this nearly happen to me the last time someone waved me across. I nearly stepped out, and then stood there trying to figure out how to hand signal to them that there is another lane beside them that is fast flowing (same direction) and I didn't want to get stuck in the middle or forced to cross into that lane. The best I could manage was a V sign for 2, then to point to his lane and the lane beside him. He kept waving me on, and eventually the traffic slowed in the other lane and a higher vehicle (lorry/van - which I could see above the stopped cars roof) waved me across as they approached meaning I could finally cross and stop with all the hand gestures to the other driver. Not ideal... (I now wait with my back turned and glance over my shoulder, which seems to work).

@@ConquerDriving oh brilliantly said about stopping for those of us are blind. When we are trained to use our white canes we are taught to wave on vehicles that stop to let us cross just in case it’s actually stopped for another reason. You’re spot on when saying the engine noise hides the sounds from other vehicles. I’ve commented on videos on other channels where people tell me I should trust the sighted driver, when I explained that I don’t know if it’s a car/ taxi picking up or dropping off a passenger, someone stopping to manoeuvre into a parking spot, someone giving way to oncoming traffic who has a quieter vehicle. It’s especially perilous in places with multiple lanes. Having said that the near misses I have had tend to be cyclists overtaking vehicles stopped at a light controlled crossing (because that red light isn’t for them); cyclists on paths deciding the cyclist dismount sign they just raced past didn’t mean them, cyclists on shared cycle/ pedestrian paths deciding that it’s their racetrack and they can go as fast as they like with no regard for others, motorists backing out of their driveway immediately on switching the engine on without seeing me halfway across the driveway (not sure they looked) or driving into their driveway in similar circumstances, and of course the inconsiderate parking forcing me to stumble over bikes laying on pavements, or walking in the road to get around cars and vans blocking the pavement. Brilliant video that literally just popped up as a suggestion. Well done. For the most part

4:20 In this case, the woman was expecting the driver to go first. I can tell because she hesitated for quite a while, wondering why you stopped. This actually poses a fairly great danger, because you can run into problems where she runs out into the street because she feels she is holding you up. If this happens at the exact moment you try to pull ahead, you will have a collision.

Thank you for this video Richard. I've added it to my 'Pedestrian Crossings' and 'Getting ready for your test' playlists for my students. When you sit and think about the complexity and multi-conditional nature of the decision making processes involved, it really does bring home how ill-thought through this well intentioned rule change is. This is one of those situations where passing or failing your test will end up being down to luck and where I encourage my pupils to vocalise/justify their decision making process with the examiner as it happens to give them more time to consider how they mark it.

Completely agree. It's a bonkers addition to the HWC which only puts pedestrians at greater risk at exactly the wrong time. As you say there's so much ambiguity surrounding when and where cars may, should, might or not stop that this only creates more confusion. Thankfully commonsense prevails at the moment as I see no cars or pedestrians following this stupid rule.

It's such a shame that many drivers don't know when to give way to pedestrians. I was crossing a junction on foot just yesterday when a car turned right onto the side road nearly wiping me out. It was apparent he'd seen me and even made gestures at me as though I was in the wrong. Even under the old rules, he was clearly in the wrong. Years ago it seemed to be common courtesy to give way to pedestrians but many car drivers now forget they are driving the equivalent of a loaded gun and appear too preoccupied and in too much of a hurry to stop. I think the pedestrians right or way needs to be better advertised. I have to admit though, that I did not realise this new addition also applied to roundabouts!

I've mentioned before, I'm a Canadian in Toronto and I've been on vacation in the UK before. One time I was in London before the Highway Code change, particularly in Hammersmith and it was then I realized how differently the roads are designed. While North America is generally not super pedestrian friendly I found UK road design nearly entirely inconsiderate to pedestrians. In Toronto unless a sign or light says not to cross at an intersection (junction) the pedestrian pretty much always has the right of way given their vulnerability. At major intersections and any intersection with a traffic light and maybe rounbadounts (we don't have nearly any in this city) there is always a clearly marked walking path for pedestrians that drivers must yield to. As for what happened in Hammersmith I was walking through a small roundabout off the main road when I thought I had the right of way. A car came came through and nearly clipped me upon exiting and the driver she pulled the window down to share an expletive comment with me 😂 for me it was a strange experience
@DatPiggy
@DatPiggy Год назад
That driver who nearly ran you over sounds like an expletitive themselves! As a Brit on Vancouver Island I feel the opposite! Yes they have marked paths for pedestrians at every set of traffic lights, but since drivers can turn right on red anyway you're always hypervigilant. The roads are so wide that it takes an eternity to cross, and for many zebra crossings they don't bother to narrow the road, speed bump, or even put lights up. Some 30mph roads in densely populated urban areas don't even have sidewalks.
@RichardHartl
@RichardHartl Год назад
@@DatPiggy oh I definitely agree with you on all accounts there. I live just outside downtown Toronto where it is still very walkable before all the suburban highway-like "stroads" (street/roads portmanteau) start. I'm quite lucky in that regard as far as North American road design is concerned
@charlesc.9012
@charlesc.9012 Год назад
There are zebra crossings here, and where there are not, there is no legally enforceable right of way, it is usually a judgement issue even now. The problem is that pelicon crossings are unreasonable, they only stay green for about 3 seconds (not an exaggeration), and that is insufficient time for even a fit person to walk across the road. There is a constant risk that overtaking mopeds can hit you. They also take 5 hours to turn green at junctions, so people typically cross anyway, because it could take a full hour to walk home if you strictly followed the lights, and it is not making you much safer, because most drivers are highly vigilant, but you can ride a moped around town without a driving test

This is one of the better explanations of this stupid new code, and if I was ever charged with an offence of disobeying this code this is the video I would show in Court along with my own dash-cam video. As a car driver of 30yrs, a motorcyclist of 35yrs and a cyclist of 40yrs I feel this is the most dangerous codes they've ever created, and they've created some right stupid ones in the past, but this is dangerous for all parties who venture outside, there are just too many variables that need to be considered, and it places everyone in a position where they have to read the minds of others which isn't a task humans are aren't able to do. I'm quite a considerate driver at my age now, in my younger years less so, but after trying this code and watching not only others follow this code but a number of near misses because of drivers followed this code shortly after it came into force (most don't follow it now it seems), as such I have decided that for reasons of safety I will not be changing my driving habits regarding when I give way to pedestrians (pavement/crossing island etc use) using a non controlled crossing point, and will instead continue to use my eyes, something called common sense and experience when driving. I also feel that a driving examiner could make bad judgement calls during an exam as the definition within this code (as was mentioned in the video) is not defined precisely enough.

I do let pedestrians cross on t-junctions because its safe to do so and is the law, but oftern it does pee the people behind me off, people just need to relearn the highway code and take a chill bill in my opinion... That said on fast roundabouts and traffic lights i fully agree with you on that one! This video has helped me a lot, as the 2022 new laws are somewhat confusing and I don't think many drivers are aware of it either, just like sticking 2 metres away from a cyclist is the law - that said I was told to keep that distance from cyclist when i was learning back in 2015 so my driving instructor was saying this befoe it was law - he was probably also a cyclist too tbh.

Hmm in most European countries that I've visited, many (not all) of the situations you showed would feature marked crossings - especially on double lane roads, making it a mandatory stop for the driver when a pedestrian wants to cross. I am surprised for example that 5:45, 7:10, that there is no marked crossing. But otherwise, when there are no markings (usually small T junctions), then yes, it's mostly a case of who came first & safety... Interesting!

@ConquerDriving Thank you for covering this. But can you also make a video about how to respond to those pedestrians crossing the road NOT using any pedestrian crossing? 1. When I approach a T-junction from a minor road to a major road. There was a pedestrian walking along the pavement on the opposite side ahead to the left, with no sign of crossing. Afterwards when I feel safe to move out to the left, the pedestrian also sets foot on the major road 1-2 car length away from my junction. How should I respond? Stop or not? 2. When I drive along a straight road in 2x mph, there is a bus ahead stopping at the bus stop. A person, who was probably just getting off the bus, was standing behind the bus behind the center dashed line awaiting to cross. How should I respond? Stop or not?

In Victoria Australia pedestrians do not have right of way at roundabouts and you must give way to pedestrians on a road you are turning in to (but not the one you are turning from) and on slip lanes. Pedestrians are expected to give way to you at roundabouts but of course you use your judgement as to whether they might even know the rules.

Hi MrTV, you obviously do not spend any time in or around where I live!, I have been stopping for pedestrians at all junctions marked with double broken lines , as we find at junctions joining a major road. There was always some ambiguity about priority when turning into such a junction, here it gas always been more a matter of whether or not pedestrians are already crossing when I get there. There are no circumstances in which I would not stop simply because of close following traffic!, I do not brake hard or stop suddenly in any situations, only ever driving at appropriate speed does depend on reliable observation and judgement but both are acquired skills that improve with practise. The bit where you describe a situation where there are pedestrians waiting at the exit you want on a high speed roundabout cannot simply appear there out of the blue!, they will be there or nearly there from some considerable distance in which it is very easy to slow down sooner and make it clear that you will stop, this will also slow down any following vehicles, this part of safer driving where constant observation of pedestrians does take a bit of getting used to but since the effect of colliding with a pedestrians is for me utterly unacceptable I am happy to make whatever effort it takes to avoid it!. Cheers, Richard.

Thank you for explaining this so much more clearly than the Highway Code does. I agree with all your reasonings for when you would and wouldn’t give way to a pedestrian waiting to cross at a junction you are using, they align with how I’ve approached this change even without feeling like I’ve fully understood what’s expected. When I spot someone waiting to cross and weigh up the whole situation if feel I’d be putting them or myself at risk I don’t give way. If there’s no risk of a misunderstanding then I’ll do it. Better safe than sorry. I do feel that these changes have tried to achieve giving crossing pedestrians more priority over road users on the cheap. It could have been achieved without changing the rules using existing crossing infrastructure such as zebra and light controlled crossings built where “they” want this pedestrian crossing priority to happen. There’s no confusion exiting a two lane roundabout when both lanes have a red light signal ahead allowing pedestrians to cross safely. But of course that costs a lot more money than just changing the old rule of the onus being pedestrian to wait for a safe time to cross. The problems with just rewriting the rules are (as you’ve said) the Highway Code is contradictory, explains what’s safe poorly and the whole change has been abysmally communicated to the public.
@ado543

The rule is good in principle, but the main problem, as you said, is that the wording is too broad and vague. I agree that I only think they intended it to apply to T-junctions and maybe crossroads. If it was clarified so it was made clear it does not apply to traffic lights or roundabouts, then it would be fine.

At 6:46 you could have easily allowed them to cross. Had you observed them early you could adjust your speed to manage the speed of the vehicle behind. We need to address the issue of people driving too fast on roundabouts. Your assessment here helps to perpetuate that problem.

Its dangerous because no one knows what to do, and most motorists WONT be thinking about STOPPING SUDDENLY ON A CLEAR ROAD. Also you explained the examples nicely, but if you had a pupil sat next to you driving it would be totally different, as they often struggle to know how or when to turn or cross junctions, and wouldnt be able to judge speeds, positions, or the intentions of vehicles either behind or in front of them.

An incredible video which brings clarity on this important issue. However, why did they have to create the issue in the first place? Cars only go along roads, not pavements, into buildings and gardens. Roads are their realm. Pedestrians, in my opinion, shoud stay out of it and cross with care when it's clear, green for them or at a zebra crossing. Now, they can just keep walking at junctions. This risks teaching them they can be careless or pushy, which creates more danger on the road. Isn't the Highway Code supposed to keep us safe?
@Ep1cure

If you have the right attitude first, everything becomes clearer. No one wants an incident no matter who is wrong or right. People make misjudgements often. Stay hyper aware. And go at a pace that is adaptable. You can always get a good pace in areas where there is little to no hazard, and visibility is good. When this isn't so, create a margin of error for yourself and others so nothing goes wrong. That way, the worst that can go wrong is highly probably minor inconvenience.

It's an incredibly poorly thought-out rule that adds uncertainty to every pedestrian-vehicle situation. And uncertainty is absolutely not one of things you want to add into the equation when you're dealing with a squishy pedestrian and a 1-2 tonne block of metal. Drivers don't stop for me at junctions when I'm a pedestrian, and I don't stop for pedestrians when I'm a driver (other than where I/they previously would've done so out of courtesy, kindness, or convenience), and I'm absolutely fine with that.

In majority of Europe at least, they put designated pedestrian (and nowadays even bicycle) crossings in junctions where the paths logically cross in junctions. That way, it's normal and obvious from day one that you give way on these. If there isn't even a pedestrian/cyclist path, there's no marked crossing either and motorists can safely expect no one to be there trying to cross. They're marked with paint AND traffic signs so that they are visible even when it rains and snows! Super handy, removes this whole debate of "It's the basic rule but does it apply here?"

Agree that this is a poor rule and creates danger in scenarios when there isn't any. I'm not sure who it's supposed to benefit because as a pedestrian I'd rather the car just carry on so I can cross behind it, and as a road user you end up holding up traffic behind you and putting the pedestrian under pressure to cross which could be dangerous for them if another car is coming the other way and doesn't stop. It needs to be removed.
@ConquerDriving

It is a benefit when walking along a busy road with numerous side roads. In this case, the pedestrian must assume some form of priority over the traffic on the main road, otherwise it would take ages to walk along a busy road. The old rule didn't really work well because pedestrians were expected to take account of traffic from 3+ directions and you just had to hope that anyone turning was indicating before you stepped out, which they often don't. In my experience, the majority of pedestrians do not check all directions before crossing a side road anyway, especially traffic approaching from behind them. Many drivers assume priority over pedestrians at junctions, even pedestrians who are already crossing, and often beep at and nearly hit pedestrians who they perceive to be in their way when turning into the junction. This is a ridiculous situation that is much less of a problem in the rest of the developed world. This rule aims to make drivers more aware of pedestrians' priority at junctions.
@andrewbush65

@@ado543 In this type of situation, I tend to walk along the pavement on the side of the road which has fewer junctions to cross along my route. Being a child in the 60's, I use the green cross code and would NEVER cross unless the road was clear and plan my route to use suitable pedestrian crossings along the way. The new rules would work fine if pedestrians were fitted with indicators to signal their intentions. If we genuinely care about the environment, expecting vehicles to perform increased stop/starts to save pedestrians a few seconds would seem illogical.
