If you were married and had children when you got your Green Card, you might be able to bypass the I-130 and go straight to the Green Card. I initially thought I could do the I-824 as Dr Grey advised earlier but when I called the USCIS in New York, they said I had to go through I-130 process. In the website they also said I wouldn't be eligible to file I-824 because I received my visa through a consular process. There is a lot of confusion on this though. How long do you think the I-130 process will take please? Thank you

On August 4th I have attended my biometrics appointment. Earlier I tried to put an expedite request on my employment authorization card because my previous was expiring on August 11th (it was an OPT based card) I am a healthcare worker and I tried to appeal to current pandemic situation as a reason for expedition. But I was denied to expedite. As of today on the "check my status online" tool it states that my I-485 is ready to be scheduled for an interview. So the question is: is that even normal to have an interview coming before the Work Authorization? All online resources state that Work/Travel permit will arrive first and interview will follow.. But my employer said it is risky to file with Premium Processing because it has higher denial rate if it is being filed as a first time H-1B. Does using an Attorney per se speed things up. I have friends who have completed their application after me and they have their green card. Meanwhile, I am waiting for my permission to travel renewal. I don't think there was an error, just long processing times. That's why I wanted to know, do attorneys speed up the process once they get involved?

@Courtney Hey, I filled for my Citizenship its been more than 3 years. I did my interview, I passed they told me they will get back to me. ... (when I won a greencard and I never included my son, but when I filled for Citizenship, I added my son ) they then last year January asked for my son's birthday certificate and I sent them. In July,I received a letter to appear in court for deportation proceedings that I lied to the consulate... so they have been postponing my court date... I didn't manage to travel last year, I was advised not to cross any border... what are the chances of me getting sworn in? I already petitioned for my son too already. Hi Courtney, what form is using visa bulletin final action date and date of filing? As in the chat session, I mentioned that I concurrent filed I-140 and I-485. My priority date on both of them is 3/26/19. I already did the fingerprints in Dec 2019. I got my I-140 approved on 4/1/20. Lately, I checked the visa bulletin for September 2020, the final action date is 4/1/19. Does that mean my I-485 is in the queued now?
Hi Thack Le, The final action date is the chart you are interested in. If your priority date is before the date listed, you are good to go. Hello Ma'am, I'm married to an US citizen and filed for AOS (i-130 & i-485) in Sept 2018. Also, our interview was completed in June 2019. Since then it says Interview completed and case must be reviewed. During the interview, we were told that we will be approved for a temporary green card and the IO went on to explain how to remove the conditions. I never called and followed up my case with USCIS. Do you know why USCIS is taking so long?? Will we be called for a second interview or home visit??? Please let me know Thank you

Chuk O You May still file an I-130 for your Mom. Once that is approved, she will likely undergo normal consular processing and should file all the steps. At that point they can issue a waiver allowing her the Green Card or decide she has to wait until the ban is lifted. If it is that she must wait, when the ban is lifted the I-130 is already approved and she can resume the process where she left off.
I have a friend who filed for her mom last year oct when she was a permanent resident but she became a citizen this year and she got approved about two months ago

Unfortunately, USCIS does not list I-589 processing times. They endeavor to process applications in 180 days but have fallen behind. I hope you hear something soon. Always feel free to contact USCIS to check on the status of your case.

Will these tips help w/an EAD through VAWA???? I filed to renew my EAD in February & STILL haven't received it. USCIS customer svc told me as it's a VAWA case I have to write VT which I did 3 wks go......NOTHING. This is so frustrating!
@@louisek256 ~ They never did. This entire situation has been a nightmare. I have an atty who doesn’t respond to case status questions. I’m beginning to think she’s really sabotaging my case. I had to call the bar on her to respond (reaching out to her since September 2020). She filed my Vawa case in September 2019. When she finally got back to me in February (ONLY bcoz the bar called her) she tells me she got my Prima Facie a few weeks ago. Like REALLY? Why didn’t you give it to me? She emails it to me & it’s dated Oct 2020. So she had it for 5 months before giving it to me! It expires today! I’m so angry. I told her to go ahead & re-file the EAD application as she believes it got lost in the system somewhere. Why does she need me as a client to tell her to do that? It’s been an ENTIRE year since filing that document, what’s she waiting for? I want to get on w/my life. My mother needs a leg operation so she’s still continuing to work to support the both of us, I NEED THAT EAD! Sorry to rant but every time I think about this I get so upset.
I am a lawful permanent resident of United States. I had applied for and issued a Re-entry permit in 2018 valid till September 10, 2020. However, I have not stayed outside US for more than 180 days till date. I returned to Nepal on 16th March 2020 after spending around 11 months in United States with a return flight scheduled on 5th May 2020. Since there was lockdown in Nepal and no international flights were available, I couldn't return to United States on 5th May 2020. On surfing the website, I found about the Returning Resident Visa. So receiving request of evidence, within my I-129f, they are going to refuse my petition? I started the application November 22nd 2019. And May I received the request of evidence and it is due August 30th; that I already sent back with all of the documents they requested. And on the website it states that they are reviewing our application. Is that they're whole agenda is to get information just to deny our application?

The interview should be rescheduled automatically. If they start scheduling interviews and you do not here anything in a reasonable amount of time, I would reach out to them and give them a gentle reminder.

Courtney Morgan-Greene it has been 107 days after USCIS has received my RFE response and nothing happen... i raised SR(s), on July 24 they responded that i have to wait next 30-60days... now it has been almost 30 days after they responded my SR, still quiet... i just got frustrated because my RFE is for medical and i sent one with my application on November 2019 already... they might have lost my first Medical? I gave the second one as they asked but they are still sooooooo slow. Happy belated Birthday anyway!🍰

What's is your family's is not yours so you can't use that as a tie you need to prove to them you will come bck to your home country but not having a job is sticky you can use the houses you rent as your job your monthly pay check from them can be your income
