It is a difficult situation and I believe she has every right to reject the operation. However, if she does so, I also think the couple has a right to sue for breach of contract. She was warned about this situation and she signed. This entire conflict happened because she signed without fully grasping the implications, so I don't think her getting sued is unfair

I don’t think she misunderstood the contract when she signed. I think that she - like every other mother on the planet - didn’t know how she would really feel until she got to the point of having to abort a foetus to save the other. Hypothetical agreements to let others decide for you are one thing… but in the moment it’s actually happening? How could anyone predict how they would feel in the literal moment? I’ve never been pregnant, but I can understand in the abstract that whole ‘I would die to save my baby’ instinct that many pregnant women have when they actually get pregnant. Some women in my family have literally been through the worst experiences you could imagine to deliver their babies healthy and safe, so I get it - in an abstract sense, like I said. The baby comes before anything else on earth when it is growing in the womb.

This is an interesting moral dilemma. On one hand, it's her body and she shouldn't be forced to undergo something she doesn't want. At the same time however, her choice in placing the lives to two children in danger. I agree with Will's choice to stand by his patient, just that the patients choice is a really dumb one.

I agree that it wasn’t really a logical decision that she made but we need to remember that she can feel those babies inside her. She can feel the so much life in that little boy and to be told that the only way is to kill him… well, I can understand how unbearable that must feel. It makes sense that this would be a mercy kill, that would save his sister and end whatever future hardships he may have to go through, so the decision should be obvious. But sometimes we aren’t so rational.

Surrogacy raises difficult questions around body autonomy, especially when there are complications that put the babies or the surrogate mother in danger. I gather that the contracts would be fairly extensive, but the best contract in the world can't cover every situation. This would be particularly difficult when decisions are time sensitive, because any sort of legal action would be time consuming :(

it's her body but not her kids. If there's a risk to her life sure she has her rights... but the parents have full rights over their babies. I don't see how this is a difficult decision. I get the surrogate is emotional... but she took a major risk when the outcome could be fatal or a shitty life for both the kids. In the real world you have to comprise...

It was a last resort as it could have resulted in her death, in which case both the twins would have died as well and her biological child would be left without a mother. It ended well but it could have done so badly wrong.

He is well and truly out of order; he has no right to interfere in this way. And, to do so against the explicit instructions from the Chief of Staff. Dr. Halstead should be suspended or dismissed.

@橙 how was he in the wrong? It’s NOT the bio parents body, it’s the surrogates body and EVERY surgery has risks and the surrogate was not willing to take that risk. She has the right to say no to whatever procedure she doesn’t want, even if the bio parents didn’t want that. It’d be like the surrogate wanting a cesarean or pain medication because she isn’t comfortable with non medicated vaginal birth, and the bio parents saying “no you have to have a natural birth no medication or cesarean”.

While I think Selena should have followed their wishes, it's still up to her what she does with her body. Halstead was 100% in the right here. No matter anyone's feelings on the choices she's making, it's her body, she's his patient and trying to steamroll a hospitalized pregnant girl with legal intimidation is not okay. Bottom line, you can't force someone to undergo an invasive medical procedure against their will.

I understand she doesnt want to terminate, but when she keeps saying "we could wait to see if they stabalise" but shes been told multiple times the likelyhood of this happening is low. She is in breach of contract and she is isnt the one whose biologically related to those babies. To be honest, she is a human incubator, even though that is harsh. What is she so worried about with terminating one of the foetuses? She could lose both if she doesnt, and these are their last 2 eggs.

Right to body autonomy stays way above any written contract of civil law. She may have been sued but not forced to do anything to her body. These ethical/law conflicts are the reason why surrogacy is illegal in most of the Europe.

There's nothing harsh in saying that she'ds a human incubator. That's exactly what surrogates are and is the reason -- the total objectification of the human being -- surrogacy should be illegal.

Dr. Halstead's job as a doctor is to present all the options and advise on the safest and best choice whilst respecting the wishes of those under his care; if the safest/best option is to terminate one and potentially save the other, then he should present that as the best option and, if asked, do his research and locate other options whilst the pros and cons of the presented option/s are being assessed and processed by those advised. Presenting another option when the current best option isn't accepted is part of best practice; finding solutions to patient's problems that they will agree with is better than no treatment at all. His conduct leaves a lot to be desired, but his research and presentation of options for patient care is exceptional.

This is interesting to watch.. as I've personally been a surrogate and carried someone else's baby to term.. it's so very important to have these kind of conversation prior to embryo transfer. In the end of the day, while the babies are inside surrogate it's up to her as it's her body.. morally, that's debateable..

In the UK the birth mother is always the legal parent until the baby is born and either a parental order is granted to the prospective parents (they have to be genetically related to the child) or the baby is adopted if the parents aren't genetically related. So legally in the UK these decisions would always be down to the birth mother. Surrogacy agreements aren't legally enforceable either. It's interesting how the law is different in different places; I have no idea what's right and wrong but it It does seem incredibly wrong to force a procedure on anyone without their consent.

While a procedure shouldn’t be forced on someone without their consent, I do believe the surrogate mother is in the wrong for not giving consent. The procedure will not put her life at risk and the babies are not hers. She signed a legal contract saying she would terminate on the parent’s decision and she needs to follow that. If she signed it without fully grasping the concept then that is her own fault. She wouldn’t have any problems either way but the parents are risking losing their babies and this is their last chance.

@Rachelcookie321 yes I think I agree with you there and certainly on an ethical standpoint. Morally I tend to think if you are willing to enter into a surrogacy agreement you have to be prepared to follow the wishes of the prospective parents and if there are any deal breakers in the contract I think you have to say 'no I can't go ahead and be your surrogate' and that decision should be made prior to starting implantation etc. I also agree with you that thet shouldn't force a procedure on a person. I think that should never be the remedy for a breach of contract of this nature; That said it doesn't mean they shouldn't sue for damages and breach of contract after the fact.

I agree with Will. You cannot force a selective reduction, or any medical procedure on an adult who has not consented. If she were unable to make the decision for herself, and someone was acting on her behalf, that would be one thing. Clearly she is able to make this decision. I might not agree with it, but we cannot force people to undergo medical procedures.

Legally, no matter what papers were signed, the fetuses were the surrogate's at the moment. Legally people cannot be parents of fetuses. No matter what the parent's wanted, they were not the legal parents at the moment, and will not be until birth. It was the surrogate's decision. The contract would have not held up in court.

This procedure harms no one but the fetus. Forcing someone to have an abortion, which what this is essentially, is against the law. No court would force her to have an abortion, no court would make her pay any penalties for breaking the contract, because the contract was illegal. An illegal contract is not binding. It is illegal to force people to have medical treatments they do not want, while they are mentally capable of making sound decisions. "The surrogate resigned herself to being a womb for hire." im sorry but this girl is way to emotional to be a surrogate, even if she didnt want the surgery she acted and i quote "i cant lose him" which clearly indicates she cares for him as her son n thats not the case lmao even the parents themselves made the hard decision yet she feels entitled as a "third parent" to keep him alive??? i would be on her side if she didnt want the procedure bc of the risks of death but this doesnt seem the case also she signed a contract n should have read all the tiny letters if she was gonna act like this. glad everything went well at the end tho the parents deserve both kids

my thoughts exactly. It's awful to say that, but she let herself on unfair road. That's not her babies, not her genes. Some people don't care about this but some do. If all hadn't gone well, she'd have said what? Sorry? And the parents would never be able to raise their biological child(ren). Which they obviously felt was important.

yes, pregnancy makes u emotional.. what a surprise. It would be best if surrogacy were illegal and then there would be no such problems. If two people are not biologically compatible then they should adopt. It's sick to implant your own child into someone else as an "alien" and then dominate their body

Its good to see Will cares about his patients but this was a little bit too much. yes she was his patient but he should have also cared about the babies and their parents as it was there last chance of having babies. Doctors are always taught not to get so emotionally invested that they forget the ethical ramification. Its her body but refusing the surgery after she signed the contract just jeopardises both childrens' health and its potentially fatal.

If you sign a contract to be a surrogate you have to read it! This is the last chance for this couple to have a baby, you are entirely too selfish for risking both of their potential children because you want to carry both to term. They just want to have A child; the boy is having developmental complications and they are well within their right to terminate him to stop potential suffering or death of both children in the future.

@@nex7072 the problem IS the contract tho i understand there's gotta be some regulations but ultimately the body of the birth mother is still hers. think about the psychological (and physical, thus minimal) consequences a procedure like that can have on someone depending on their personal history. it is a big moral dilemma but i think the surrogate's individuality is top priority.

That's the picky thing about surrogacy, because while it is Selena's body, it's not her child. When you become a surrogate, especially to someone who you didn't know before, you're almost just becoming a vessel, a vessel that carries the baby. While I think Selena definitely should have a say, but ultimately as long as she's not affected by the surgery it is up to the parents to decide how to proceed and what surgery to take

You will always be affected by a surgery. A surgery can lead to complications, infections and even death. It can leave you weak or even bedridden for a long time, it leaves scars and can lead to psychological trauma. Even a little dental procedure under anaesthesia can be dangerous.

Yeah every surgery has risks, even something as minor as a infected toenail removal surgery can have risks (infection, heavy bleeding, etc) so something major like this (which could actually result in both foetuses being lost) could have major complications including death from bleeding out, major internal infection, later issues with fertility (if scars form on cervix from procedure), etc. In the real world, that contract would not stand up in court because another adult cannot make decisions on another adults (of sound mind) body just because that body is carrying their genetic material currently. Just imagine if the surrogate suddenly had severe pregnancy complications and had to terminate both foetuses because they were putting her life at risk, and the bio parents were all “nope we don’t consent to that” even though not doing it could cause death. Hence contracts like this don’t exist outside of TV shows...

@@rusokana3642 any surgery can become life threatening. Do you have any idea how often “routine” surgery ends in death or disability to a patient. Drs fucking up is one of the leading causes of death in the US. All it takes is a vein being nicked, or there being more veins in an area than expected, or too much medication, or bleeding out, or an infection, etc.

Really, Im with the Addisons. They are THEIR Children, not Selenas... they have the right to request that and Selena signed the contract, they have the right to terminate one if it smedically necessary. Even if its her body, she gave that choice over when she became a surrogate. One child is better than no child, and they were the last embryos of the couples. Selena is playing god here and its annoying.

Its a way that parents who are unable yo have kids of there own for any reason to have a child that is there's by DNA. Its one of the few options to try and have a child. Adoption tends to be the last option in cases like this.

@@suzannekirkwood6392 tbh that i disagree with, alot of bonding happens in the pregnancy. If you want a child but dont wanna get pregnant then just adopt. Same as elective c-sections. They shouldn't be allowed enless its absolutely necessary as it is major surgery and long hard recovery. People tend to think its the easy option when its not. Tbh tho America needs to make gas and air more available.

Ok I’m sorry I love this show & all but WHAT? If a women I trusted enough to give my LAST two embryos to decided she had a bigger say than I did even though she’s the one holding them because I physically couldnt? I’m sorry but as far as I know this women got lucky , if either of those babies passed away due to HER decision, hell I’d sue her for everything she’s got plus some. This really pissed me off , at the end of the day a contract is a contract .

Sure, but you still can't force someone to undergo a surgery they are against. If that did go to court, all she'd have to do is mention: them trying to intimidate/threaten/coerce her to undergo surgery she didn't want and them changing her doctor without her consent. She signed away the babies, but she didn't sign away her medical rights and that means that at the end of the day, she legally can refuse the surgery and no-one can force her into it. You can make your case for why she should do it, but you can't unilaterally decide she'd have surgery against her will. ETA: If she were a Jehovah's Witness and religiously opposed to the transfusion of blood it would be highly unethical to force her into surgery.

I think the surrogate was in the wrong but I do feel bad for her. Like imagine carrying a life (regardless if its her child) and then being told you have to remove it. I think you would get attached when growing human beings inside of you. Like you must feel a responsibility to keep them alive so when someone tells you you "failed" to do that I can see why she would want to hold on. Once again still in the wrong for breaking contract but still

Personally, I don’t agree with surrogacy. If a couple can’t have a baby on their own, then they should adopt. There are enough children in this world that need loving homes without creating more just because you want to share your DNA. It can also cause problems like this where the parents and the surrogate come into conflict with the child in the middle.

This one hit hard, I was born with cdh (cogential diaphragmatic hernia), it can be linked to other conditions like me. I was on a ventilator for a fews weeks and a c-pap for a few weeks after. I had it repaired at 6 days old and I was so sick they had a nurse/doctor with me 24/7 for the first few weeks of life. I was full term.

I think, despite the positive outcome, Dr. Halstead and the surrogate were still ethically and legally in the wrong. If she wasn't willing to accept to the biological parents choices, she shouldn't have signed the contract, it's that simple. She also shouldn't have put two lives at risk for her own selfish hope that things will be ok; that wasn't her decision, as per the contract she signed. Yes yes, it's cool they found a way around it, but if it wasn't for TV magic, those babies probably would have died in a real life situation and, if I was the biological parents, I would have sued the surrogate and the hospital.

In such a tough situation I honestly agree but at the same time differ- I'm taking BVetMed as a surgeon, and this situation (regarding the babies, ethics and etc.) I see what you mean as in reality the chance of this situation neutralising in a positive outcome for all patients (the mother and twins) is rare (however not impossible) and breaching the rights of the parents and even ethical harm of likely killing those babies when regarding the legality. I have full sympathy on the fact the surrogate mother wishes to have a choice as it is her life and she, through Dr Halstead's words, "Isn't a human incubator", but the procedure they used can be quite effective in stabilising the health and outcome of the babies as well as the mother, which was better to try than do nothing and let both the surrogate mother, and babies suffer x Sadly this scene is cut short so I'm not sure whether there was a scene of discussion about this alternative procedure with the woman carrying the babies and the couple, but if there was and they all equally agreed to try this alternative, then even with regards to the signed contract it can be overruled via the biological parents legal grant in cooperation (which is then obviously documented by the lawyers with a settled agreement contract because if the procedure failed and they wished to sue, then legally they couldn't as they would have given a legal agreement to the procedure happening). x

More than just the contract come into play here. You cannot force someone into a medical procedure there do not wish to have. Take her to court afterwards for reneging on the contract if you wish but you don’t get to force her into a procedure. She is sane and can make choices for herself. She is the one at risk and the mother’s life is always above the fœtus’s (except for rare cases where the patient is unlikely to survive). The doctor could and should lose his license if he goes through with forcing an unwanted procedure on his patient, regardless of some contract. I personally would refuse to perform the procedure. That lawyer would have definitely been escorted off the premises by security if this happened at the hospital I work at, and if the couple is unhappy with that, they can leave as well.

The only thing I’d disagree with is that you said “the mother’s life is always above the foetuses” -and I disagree simply for the fact of the surrogate not being the ‘mother’. It’s not her decision to decide the fate of those children; she signed over those rights when she signed the contract 🤷🏻‍♀️ however, I am not a lawyer, and I don’t particularly care to change someone else’s morals, so I’m just stating my opinion based on what I think is right, and the information I got from the show ^_^

@@AlexanderMason1 Law works with contracts not feeling , if it was a procedure that was too risky for her health sure I'm 100% with you , but it wasn't , so its her obligation to follow "some contract" that she signed knowing that everything is a risk, pregnancy included, and it's hypocritical to say she didn't know . Especially since those are the only embryos left and the only chance for the parents to have a kid. But at the end She choose to have a surgery , just not the surgery the parents wanted , so the "she can't risk her life" doesn't work here ,and if she lost both then that lawyer wasn't lying, she would have been sued for not respecting the contract and the law.

Got live these shows but those contracts are just not likely. You cannot create a contract that is against the law. For example is someone signed a contract to kill the president then didn't the contract holder could not sue them because its illegal to kill. She has the legal right to refuse treatment and make her own medical decisions. a judge could intervine I see this being unlikely to go in the Addisons favour. I personally think these contracts should be banned, no one should have control over another person's medical decisions unless they are under age or cannot make their own decisions due to illness.

I understand the mental trauma a surrogate goes through, caring for a fetus and bringing to term a child only to have to give them away because they were never yours. Of course, the biological parents deserve a child of their own but my fundamental belief is that surrogacy is wrong precisely due to that trauma. The surrogate should've had the procedure. These twins aren't hers to keep, she doesn't get to decide if she is willing to take the risk of both babies dying because she won't be the one affected by the death of these children, the biological parents will be. Her 'job' is to deliver a baby, in this case healthy twins. One is worst beyond saving and the other is more or less being murdered by her brother. These parents have lost who knows how many embryos and fetuses in the process of trying to have a baby, they don't deserve to lose both of these too if one has a real chance of survival. The surrogate is threatening the life of their unborn daughter because she's too attached to the unborn son who, most likely, will die regardless. If you're going to be a surrogate, you have to be aware that you're a 'tool' to deliver someone else's child, specially if you're not a relative to the biological parents, you're an outsider and have no rights to that child. Any choice regarding that child isn't yours to make. Humans aren't meant to be 'tools' or to be 'used' in such a capacity, which is why I think surrogacy shouldn't be a thing in the first place. It's just upsetting to see two babies die needlessly

Traumatic process this surrogacy is. Baby being born from a mother who is then going to giv it away to a family. Kid doesn't even know who birthed him. And u think it's going to be easy on any woman to just be used as a tool to giv life to a child and give it away after she already experiences the difficulties from birthing? No person can have zero emotions on this.. It's really not fair for a human to go through this for the sake of money even if it is happening by consent. So confusing and unfair this process is gosh! Saddeing! There are millions of orphan kids in this world.. why would it hurt you to adopt one of them and give it a new life and loving family instead of causing this nonsense in everyone's lives.

You do realize that Insurance exists? Plus the Swedish government has accumulated a debt of over $240-250 Billion for a meager population of just 10.2 million and that debt isn't set to go down anytime soon, meaning that eventually you're gonna have to pay off all of that debt via some way or another, and don't expect the "top 1%" to bail you out since they will immediately flee at the sight of any increases in their taxes, leading to the average middle class person to face the storm...

You can't legally sign away consent to your own body. It's her body so it's her choice to undergo surgery, you can't force her to have an abortion, not even in this case. It may be unfair but she has the right to withdraw consent, and you can't legally sign that away. An illegal contract is not binding. Can you imagine forcefully holding down a pregnant woman, forcing anesthesia on her and open her up, operating on her without her consent? You just can't, that is unfortunately one of the risks of using a surrogate, but you can't get full control of her body no matter the contract. (which is a good thing, can you imagine what you could make people sign in the name of poverty, if you could sign away their human rights)

They would only be able to sue the surogate for breach of contract, not the hospital. You can't sign away your human rights, you can't sign away the rights to your own body, so the hospital could not force her to abort even if they wanted to. It would be entirely her choice, but there would be legal consequences if the parents decided to sue.
