It is a difficult situation and I believe she has every right to reject the operation. However, if she does so, I also think the couple has a right to sue for breach of contract. She was warned about this situation and she signed. This entire conflict happened because she signed without fully grasping the implications, so I don't think her getting sued is unfair

This is an interesting moral dilemma. On one hand, it's her body and she shouldn't be forced to undergo something she doesn't want. At the same time however, her choice in placing the lives to two children in danger. I agree with Will's choice to stand by his patient, just that the patients choice is a really dumb one.

Crazy thing is, had the doctor suggested the second procedure as an alternative, both sets of parents would have agreed immediately

She would have been transferred to OB immediately. No way does this go on in the ER.

I understand she doesnt want to terminate, but when she keeps saying "we could wait to see if they stabalise" but shes been told multiple times the likelyhood of this happening is low. She is in breach of contract and she is isnt the one whose biologically related to those babies. To be honest, she is a human incubator, even though that is harsh. What is she so worried about with terminating one of the foetuses? She could lose both if she doesnt, and these are their last 2 eggs.

Dr. Halstead's job as a doctor is to present all the options and advise on the safest and best choice whilst respecting the wishes of those under his care; if the safest/best option is to terminate one and potentially save the other, then he should present that as the best option and, if asked, do his research and locate other options whilst the pros and cons of the presented option/s are being assessed and processed by those advised. Presenting another option when the current best option isn't accepted is part of best practice; finding solutions to patient's problems that they will agree with is better than no treatment at all. His conduct leaves a lot to be desired, but his research and presentation of options for patient care is exceptional.

Since when contracts are above the law? she can't be forced, period and a lawyer and the hospital administrator will know.

This is interesting to watch.. as I've personally been a surrogate and carried someone else's baby to term.. it's so very important to have these kind of conversation prior to embryo transfer. In the end of the day, while the babies are inside surrogate it's up to her as it's her body.. morally, that's debateable..

In the UK the birth mother is always the legal parent until the baby is born and either a parental order is granted to the prospective parents (they have to be genetically related to the child) or the baby is adopted if the parents aren't genetically related. So legally in the UK these decisions would always be down to the birth mother. Surrogacy agreements aren't legally enforceable either. It's interesting how the law is different in different places; I have no idea what's right and wrong but it It does seem incredibly wrong to force a procedure on anyone without their consent.

I agree with Will. You cannot force a selective reduction, or any medical procedure on an adult who has not consented. If she were unable to make the decision for herself, and someone was acting on her behalf, that would be one thing. Clearly she is able to make this decision. I might not agree with it, but we cannot force people to undergo medical procedures.

the doctor is in the wrong, the contract is there for this type of issue, if you aren't gonna abide by it then why have it in the first place, so unprofessional

im sorry but this girl is way to emotional to be a surrogate, even if she didnt want the surgery she acted and i quote "i cant lose him" which clearly indicates she cares for him as her son n thats not the case lmao even the parents themselves made the hard decision yet she feels entitled as a "third parent" to keep him alive??? i would be on her side if she didnt want the procedure bc of the risks of death but this doesnt seem the case also she signed a contract n should have read all the tiny letters if she was gonna act like this. glad everything went well at the end tho the parents deserve both kids

Its good to see Will cares about his patients but this was a little bit too much. yes she was his patient but he should have also cared about the babies and their parents as it was there last chance of having babies. Doctors are always taught not to get so emotionally invested that they forget the ethical ramification. Its her body but refusing the surgery after she signed the contract just jeopardises both childrens' health and its potentially fatal.

Surrogacy is in the grey area. The union of mother in child is the closest thing to feeling mother nature's thoughts.

If you sign a contract to be a surrogate you have to read it! This is the last chance for this couple to have a baby, you are entirely too selfish for risking both of their potential children because you want to carry both to term. They just want to have A child; the boy is having developmental complications and they are well within their right to terminate him to stop potential suffering or death of both children in the future.

That's the picky thing about surrogacy, because while it is Selena's body, it's not her child. When you become a surrogate, especially to someone who you didn't know before, you're almost just becoming a vessel, a vessel that carries the baby. While I think Selena definitely should have a say, but ultimately as long as she's not affected by the surgery it is up to the parents to decide how to proceed and what surgery to take

Really, Im with the Addisons. They are THEIR Children, not Selenas... they have the right to request that and Selena signed the contract, they have the right to terminate one if it smedically necessary. Even if its her body, she gave that choice over when she became a surrogate. One child is better than no child, and they were the last embryos of the couples. Selena is playing god here and its annoying.

I think the surrogate was in the wrong but I do feel bad for her. Like imagine carrying a life (regardless if its her child) and then being told you have to remove it. I think you would get attached when growing human beings inside of you. Personally, I don’t agree with surrogacy. If a couple can’t have a baby on their own, then they should adopt. There are enough children in this world that need loving homes without creating more just because you want to share your DNA. It can also cause problems like this where the parents and the surrogate come into conflict with the child in the middle.

This one hit hard, I was born with cdh (cogential diaphragmatic hernia), it can be linked to other conditions like me. I was on a ventilator for a fews weeks and a c-pap for a few weeks after. I had it repaired at 6 days old and I was so sick they had a nurse/doctor with me 24/7 for the first few weeks of life. I was full term.

I think, despite the positive outcome, Dr. Halstead and the surrogate were still ethically and legally in the wrong. If she wasn't willing to accept to the biological parents choices, she shouldn't have signed the contract, it's that simple. She also shouldn't have put two lives at risk for her own selfish hope that things will be ok; that wasn't her decision, as per the contract she signed. Yes yes, it's cool they found a way around it, but if it wasn't for TV magic, those babies probably would have died in a real life situation and, if I was the biological parents, I would have sued the surrogate and the hospital.

Got live these shows but those contracts are just not likely. You cannot create a contract that is against the law. For example is someone signed a contract to kill the president then didn't the contract holder could not sue them because its illegal to kill. She has the legal right to refuse treatment and make her own medical decisions. a judge could intervine I see this being unlikely to go in the Addisons favour. I personally think these contracts should be banned, no one should have control over another person's medical decisions unless they are under age or cannot make their own decisions due to illness.

I understand the mental trauma a surrogate goes through, caring for a fetus and bringing to term a child only to have to give them away because they were never yours. Of course, the biological parents deserve a child of their own but my fundamental belief is that surrogacy is wrong precisely due to that trauma. The surrogate should've had the procedure. These twins aren't hers to keep, she doesn't get to decide if she is willing to take the risk of both babies dying because she won't be the one affected by the death of these children, the biological parents will be. Her 'job' is to deliver a baby, in this case healthy twins. One is worst beyond saving and the other is more or less being murdered by her brother. These parents have lost who knows how many embryos and fetuses in the process of trying to have a baby, they don't deserve to lose both of these too if one has a real chance of survival. The surrogate is threatening the life of their unborn daughter because she's too attached to the unborn son who, most likely, will die regardless. If you're going to be a surrogate, you have to be aware that you're a 'tool' to deliver someone else's child, specially if you're not a relative to the biological parents, you're an outsider and have no rights to that child. Any choice regarding that child isn't yours to make. Humans aren't meant to be 'tools' or to be 'used' in such a capacity, which is why I think surrogacy shouldn't be a thing in the first place. It's just upsetting to see two babies die needlessly

Problem is the parent ready paid the agency. The agency will not pay her and the parents will not get reimbursed. A class action can force the agency to pay back the money

As a triplet, the prognosis hit close to home. As much as I both love and hate them, I can't imagine my life without them, let only one day being told one/both had to die for me to live.

How can this be legal? I know, it's a contract, but this violates human rights, so this contract would be null and void, since human rights are always more important than some clause in a contract.
