If the goal was actually to seize the records, that would have been easier when no one was home. They wanted him home so they could provoke a confrontation and kill him.

what is truly sad , the AFT is trying to make Bryan Malinowski out to be this lawless criminal when he had no criminal history, asleep in his own bed. They knew he was a gun owner, did they not think he would protect his family. This happened in the Brianna Taylor case and her boyfriend was acquitted of shooting officers because they failed to announce themselves and he believed it was a home invasion. No knock raids are INSANELY dangerous and it's only made more dangerous by there being no announcement.

@Psycogenius There were plenty of outpoints in the execution of the warrant: 1) It was a search warrant, not an arrest warrant. 2) ATF and FBI agents in full tactical gear arrived in 11 vehicles to execute the search warrant. 3) ATF cancelled an earlier attempt to serve the warrant because Malinowski was not home. Those subject to search home warrants do not need to be present for them to be executed. 4) Body cameras were not used. 5) An agent taped over his Ring camera so Malinowski could not see who was there. 6) The warrant was executed at 6:00 am to catch him off guard. 7) Agents cut his electricity but used weapon-mounted lights, preventing him from being able to see who was inside his home. 8) Agents did not announce themselves before or after entering. 9) Agents kicked in his door causing Malinowski to attempt to defend his family against unknown intruders. Malinowski was, for all intents and purposes, lynched to make an example out of him.

As former LE myself, I wholeheartedly agree. ALWAYS minimize risk and catch the subject / suspect in a place or at a time that keeps everyone as safe as possible, INCLUDING the subject / suspect.

problem is they only had a search warrant, not an arrest warrant. this was sent to the US citizen as an intimidation tactic. never seen even an arrest warrant served where police covered up security cameras while executing the warrant.

This was allegedly over a $200 license requirement change and could have been performed by two agents in suites, knocking on his door at 9am "Good morning, we're from the ATF and we have a warrant to search the premises." He takes the warrant and says to his wife to call his lawyer. Hell they could have sent him a letter requesting he apply for a damn license if he met the criteria outlined in it.

The fact that they decided not to execute the SEARCH warrant the first time because he wasn't home tells us everything we need to know. This was not truly about successfully executing a search warrant, it was about successfully executing a man. They did everything possible to make sure he showed up in front of them, confused and in protective mode, with a gun pointed at them so that they had the proper excuse to murder hime.

They didn't have an arrest warrant. They had a warrant mainly to search for records and they chose to do a no-knock when he would be most likely to be home and most likely to lawfully respond with deadly force on an intruder. The agents had a duty to retreat, identify themselves and state they had a warrant before using ANY force. If AFT just wanted the records and to see his guns, they would have sent a pair of agents in business suits to speak with him at work while having a team watch the house and asked him for voluntary compliance, not even telling him about the warrant unless he refused to cooperate. Then if they needed to serve the warrant, they could have a pair of agents in suits knock and announce and remove the wife from the home peacefully and quietly and business-like.

In other words, if they used just a little bit of common sense.

As a former LEO/ SWAT officer No Knock warrants are needed at times when dealing with violent criminals. This wasn't one of those circumstances. ATF needs to focus their LE efforts on gangs, drug cartels, and weapons related activity and be subject to strict oversight or be disbanded.

Who had the right to authorize the execution of this man? If it was a mistake, it's a mistake that must NEVER happen. But because of our Constitutional rights (e.g. 2A), a no-knock warrant is either murder or attempted murder.

The only way to reform LEO across the country is to disband unions, create an automated system of transparency that makes body cam footage immediately available to the general public, have insanely high standards for mental/physical/emotional fitness, and then simultaneously pay A SHITLOAD MORE money (because now we are saying that your job will likely result in you getting murdered, and if you make a mistake there is no safety net). The only way you can attract new labor that is willing to take on such a position is to pay an absurd amount of money; otherwise who the fuck would want to be a cop if they're held to criminally serious standards with a system of oversight outside of human control?
