@@Annie497 Defense could easily have included a motion for the judge to recuse himself from this case in her proffer since he was clearly biased. Prosecution would no doubt have objected to that but there would not have been a judge to sustain that objection since he had walked out of the courtroom. And everything would have been on the record. But maybe that is just me and my revengeful thoughts, at least they now have excellent grounds for appeal if Kelly is found guilty.

He has allowed the state to go over and they still not finished. Now he is going to limit the defense on an important witness. This not fair of the judge to do this. Appeal IMO

Why didn't the defense attorney put everything in the record after the judge walked away?? She should have said everything that she wanted to ask everything that the judge denied them & she should also put down in the record to recuse this judge, appeal. He is showing bias. Defense was limit to ask questions but not the prosecutors. They need to get down everything in the record of this man who is calling himself a judge - he is anything but that. Worse I've ever seen. Judges like this man are giving justice a bad reputation in this country.!
This judge and prosecution case screams of corruption. This trial is UNFAIR for the defendant. Disgusting. Is this investigator an illegal, himself? He sure behaves and sounds like one.
I have watched every day of the trial, and until today I thought he had been fair. Today changed all that, it seems the cartel paid him a visit last night, or something. This is scary what is happening. The State has been given 12 days and still not finished, and now he will limit the Defense to a couple days if that.
I thought he had been fair till today. After watching this a couple of times, I'm thinking two things. Either he gave them the legal grounds to appeal (for their benefit) or he felt the crunch of time because he had to speak to one of the jurors bosses. After he throws his fit over time, the first thing he does is address the juror over the phone call. The prosecution takes and excruciating painful amount of time doing nothing and asking stupid questions. The best part of the trial is the defense. If he's convicted, the jury has just been asleep this whole time. The prosecution has not proved their case. They've actually made him look innocent because the state is so inept.

Mid stream, the Judge wants to require time restrictions AFTER the state has filled 4 weeks. How is this fair to the Defense? This is outrageous! 4 minutes for cross examination of a crucial witness.
I’m only making an observation here. I’m not suggesting that what happened to this migrant was justified or not. BUT it’s Interesting that the prosecutor argued during his closing statement that the victim and his friend came to America illegally to chase the American dream. The prosecutor also stated that the victim had a radio so that he could communicate with the people that needed to pick him up once he arrived at the predetermined location, that it had nothing to do with coordinating with cartels or smuggling, yet in this testimony, the prosecution is asking this detective about the victims cell phone. HE HAD A CELL PHONE!! And yet people are not to believe that he wasn’t some sort of coyote or working for or with the cartels, despite the fact that he had already entered the United States without being caught (prosecution says to chase the American dream) but yet he didn’t go to his pickup location and continue to get further away from the border, he, according to the prosecution, was on his way back across the border into Mexico when he was shot on this ranchers property with the backpack, a fanny pack, binoculars, a cell phone, AND some kind of walkie talkie or 2 way radio. How in the heck would anyone not question what this man was actually up to??
The judge is walking on THIN ice, here, and if he does not allow the defense to present their full case, then it should be thrown out on appeal. If the state has hogged the entire 3 plus weeks and it's running behind schedule, that is the STATE'S problem. The judge is the one responsible for keeping things on track, and he should have been discussing this with the attorney's a good week prior. This man deserves a FAIR representation and the judge needs to make sure that his rights are not violated. I am effing sick of illegals being placed above our own citizens. If they weren't breaking the law and entering on land they have no right to be trespassing on, then no one would have gotten SHOT. BS on whether he was running towards the border or not.....the fact is, he'd illegally CROSSED it! Enough of this BS.
besides all that, since when is a judge worried about the amount of time taken. Look at all the adjournments taking place daily for insignificant reasons. These clog the court dockets more than a thorough defense attorney. a travesty of justice is taking place.
This judge should not be a judge after this case. A defendant is innocent untill proven guilty and theres laws set inplace that this judge has clearly violated and obviously has made his mind up the the defendant is guilty and cleary us treating this as so

She is the one who estimates defense case will take 2 days. He isn't limiting her. As to the cross she has already been crossing for over an hour, her partner chewed up hours the day before on the 911 witness

Clearly you have not watched the trial on Thursday, the prosecuting is stalling as much as they can. But glad this judge is so openly biased that he gave them enough grounds for appeal in case they lose. But I think the jury will find him not guilty cause so far the state has only been speculating, we have yet to see any proof.

Even if prosecution is wasting time, there are constitutional rights of a defendant that cannot be violated. We've seen plenty of time wasting in other trials that was infuriating. If that leads to loss of jury because of illness or other and you don't have enough left to deliberate than let that be the reason and then it's on prosecution and not because the judge is limiting defense attorney.
@@origamikiddo2625 Agree. To me it seems that the so called 'confession' to BP of shooting over their heads was misconstrued by the police as an admission of shooting the victim. Now it makes perfect sense why they arrested him immediately. When they eventually realized their mistake, instead of releasing Kelly they dug themselves in even deeper with this trial as a result.
