And at the time of Hijri Asma born in 595 AD, was 27 years old . The prophet married Aysha 2 years after hijri which makes her 19 years old. Also consider the fact that Hadith are orally transmitted not written, so again this is like a case of broken telephone over time. @@hha8356 There are 2 scholars I can remember off the top of my head although I know there are more who have spoken on the topic. Abu Layth and Shabir Ally are the two I remember. Abu Layth has done a two and a half hour exposition on the topic where he goes in depth on the topic more than ANYONE that has ever covered the topic at least online on youtube, and Shabir Ally also has some videos on it. They are both orthodox Sunni scholars of Islam. I actually took a class with Shabir Ally once at university, he was my professor and he's definitely very knowledgeable as is Mufti Abu Layth. Also there is a really good article written on the topic by Ruqaiyyah Waris Maqsood who is a learned sister. She was a Christian who graduated from a Christian theology school who later converted to Islam. She's written over 40 books on Islam and other religions. She wrote an amazing article which unfortunately I can't link here because youtube will take my comment down, but if you go to google and type her name Ruqaiyyah Waris Maqsood and age of Aisha, you'll see a link to the article. that is another great resource. The video by Abu Layth though goes into excellent detail about the subject, ranging from the chain of narration of the hadith, to the resourcefulness and practicality of the Prophet peace be upon Him's marriage to Aisha, to scholarly opinions on hadith. It really does an excellent job in looking at it from multiple angles. There is also a shorter version of the 2 and a half hour long video but I recommend the full length one to get the most detail.

Sa’d ibn Mu’adh, one of the Prophet’s companions, went to Mecca to perform his pilgrimage at the sacred mosque. I imagine you are supporting and helping him. By Allah, if you were not in the company of Abu Sufyan, I would not let you safely return to your family! Source: Ṣaḥīḥ al-Bukhārī 3734, Grade: Sahih In other words, if Sa’d had not been under the protection of Abu Sufyan, a powerful tribal leader, then Abu Jahl would have had him killed. In this context, Allah revealed a verse allowing the Muslims to defend themselves after having required them to be patiently endure up to this point. Allah said: أُذِنَ لِلَّذِينَ يُقَاتَلُونَ بِأَنَّهُمْ ظُلِمُوا ۚ وَإِنَّ اللَّهَ عَلَىٰ نَصْرِهِمْ لَقَدِيرٌ الَّذِينَ أُخْرِجُوا مِن دِيَارِهِم بِغَيْرِ حَقٍّ إِلَّا أَن يَقُولُوا رَبُّنَا اللَّهُ Permission to fight has been given to those who are being fought, because they were wronged. Verily, Allah is able to give them victory. They are those who have been evicted from their homes without right and only because they say: Our Lord is Allah. Surat al-Hajj 22:39 This verse makes clear that the reason the Muslims were allowed to fight was because they had been driven out and violently oppressed only because of their religion. As the Meccans were preparing for war, the Muslims prepared to launch raids on their caravans as a means to disrupt their economic war-making capabilities. What is more, the Meccans had confiscated the property that the Muslims had left behind and were taking it to Syria to be sold for war funds. Despite suffering this persecution, the Prophet commanded the Muslims to adhere to the highest standard of conduct and he prohibited them from plundering the enemy’s wealth. Abdullah ibn Yazid Reported: عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ نَهَى عَنْ النُّهْبَةِ وَالْمُثْلَةِ The Prophet, peace and blessings be upon him, prohibited plundering and mutilation. Source: Ṣaḥīḥ al-Bukhārī 5197, Grade: Sahih The Prophet declared that the one who plunders, robs, and loots people is not a true Muslim. Abu Huraira reported: The Messenger of Allah, peace and blessings be upon him, said: وَلَا يَسْرِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ حِينَ يَنْتَهِبُهَا وَهُوَ مُؤْمِنٌ The thief is not a believer while he is stealing. The plunderer is not a believer while he is plundering and the people are watching him. Source: Ṣaḥīḥ al-Bukhārī2343, Grade: Muttafaqun Alayhi pمَنْ انْتَهَبَ نُهْبَةً فَلَيْسَ مِنَّا Whoever plunders the wealth of others is not one of us. Source: Sunan al-Tirmidhī 1123, Grade: Sahih In another narration, the Prophet said: وَمَنْ انْتَهَبَ نُهْبَةً مَشْهُورَةً فَلَيْسَ مِنَّا Whoever is notorious for plunder is not one of us. Source: Sunan Abī Dāwūd 4391, Grade: Sahih On one occasion, the Prophet saw that some of his companions had looted the enemy’s sheep. He commanded them to return the property to their owners. Tha’labah ibn Hakam reported: We came across some sheep of the enemy, so we plundered them and set up our cooking pots. The Prophet passed by and ordered that they be overturned. The Prophet, peace and blessings be upon him, said: إِنَّ النُّهْبَةَ لَا تَحِلُّ Verily, plunder is unlawful. Source: Sunan Ibn Mājah 3938, Grade: Sahih As mentioned in the verse, permission was given to fight back only as a response to aggression. Muslims are allowed to fight for the right to practice Islam and to defend innocent people from oppression. No other motives are permissible, especially not to fight for worldly gains and spoils. Death of Kinana - This story is not found in any of our most authentic collection of Hadith. Nor is there any truth to it, This is because it is claimed in the report that Kinana was tortured with ‘fire’- this cannot be true because there are many authentic Hadith where Prophet (p) forbade torture with fire. Moreover, the Prophet (p) had everything he wished, he would never torture someone for money. As a matter of fact, the Prophet (p) was offered by the Quraish anything in the world he wanted and even would have made him leader of them as long as he stopped preaching the Message of Islam. The Prophet declined their offer. This just goes against the character of the Prophet (p). Furthermore, scholars below mention that there is no truth to the part about ‘treasure’, as it is false. The reason he was killed is because he took a innocent life unlawfully. It is simply not true that his whole family was punished by death, for his own brother was still alive in Hz Umar’s Caliphate. The Holy Prophet never permitted any person to be tortured for the purpose of procuring information. Traded in black slaves - Firstly, don’t compare american/European slavery to muslim slavery. Prophet Muhammad (pbuh) ordered that you had to treat slaves like your brothers, feed them with what you eat, and dress them with what you wear, do not overburden them & help them, and flogging/hurting them was completely haram. “They are your brothers whom Allah has put under your authority, so if Allah has put a person’s brother under his authority, let him feed him from what he eats and clothe him from what he wears, and let him not overburden him with work, and if he does overburden him with work, then let him help him.” Narrated by al-Bukhari (6050). Uthman ibn ‘Affan tweaked the ear of a slave of his when he did something wrong, then he said to him after that: Come and tweak my ear in retaliation. The slave refused but he insisted, so he started to tweak it slightly, and he said to him: Do it strongly, for I cannot bear the punishment on the Day of Resurrection. The slave said: Like that, O my master? The Day that you fear I fear also. When ‘Abd al-Rahman ibn ‘Awf (may Allah be pleased with him) walked among his slaves, no one could tell him apart from them, because he did not walk ahead of them, and he did not wear anything different from what they wore. One day ‘Umar ibn al-Khattab passed by and saw some slaves standing and not eating with their master. He got angry and said to their master: What is wrong with people who are selfish towards their servants? Then he called the servants and they ate with them. A man entered upon Salman (may Allah be pleased with him) and found him making dough - and he was a governor. He said to him: O Abu ‘Abd-Allah, what is this? He said: We have sent our servant on an errand and we do not want to give him two jobs at once. 4. There is nothing wrong with slaves having precedence over free men in some matters with regard to any religious or worldly matters in which he excels over him. For example, it is valid for a slave to lead the prayer. ‘Aishah, the Mother of the Believers, had a slave who would lead her in prayer. Indeed the Muslims have been commanded to hear and obey even if a slave is appointed in charge of their affairs.

Just because intercourse between a slave and master was LEGAL, doesn’t mean forced assault was. If a slave was married, a master could not touch her. If it is possible to have intercourse with her without harming her, he may do that. If it is not possible for him to have intercourse with her except by harming her, he does not have permission to have intercourse with her.
