Problem, when people compare Aadhar with Social Security Number in the US, is that there is enough wire tapping protection for American citizens that Government needs to provide cause to a judge before the government can tap a citizen. In the case of Aadhar, there is nothing that prevents the CBI or any other agency to causally snoop into the private details of the citizen.
I would like to go, on record, and say that The Big Picture is possibly one of the best presentations by Rajya Sabha TV. Frank Pereira, you do a wonderful job as the moderator for all discussions. I look forward to seeing more such enlightening exchange of thoughts and perspectives.
Aadhar should not be treated as an ultimate solution...... Police reform,Judicial reform are also required....... Illegal migrants aadhar have also been there....... Ample safeguard should be there, Issues have to be concern, full proof assurance on the government part has to be there.......

I don't understand 2 things : 1) If Right to dignified life and Reputation are Fundamental Rights then how can we make privacy out of the box, will making it out of the FR serve the purpose of dignified life where one's private data is known to the state and if yes then Judiciary needs to define the boundary of Reputation. 2) Irrespective of whether Right to Privacy is a FRs or just a legal right, the benefit of Aadhar is immense but the safety of privacy and data security is the need of the hour.. Because Aadhar without Value of Privacy is like Jawan in the border without arms.
Fundamental rights were made when there were no technological advancement (they don't even think about this as a issue)...But by seeing today (modern era) privacy to human life is major issue ....so i think this issue must need to looked after by intervention of parliament to include RIGHTS TO PRIVACY ...
1. Dignity and reputation are emotive terms and their definition may or mayn't include right to privacy. You are correct it is to be decided by SC. In the name of right to privacy transparency can be compromised. Moreover it can be subjected to other conditions e.g. public order, national security etc like other FRs. You can have a dignified life without right to privacy. E.g. State has your health data. It helps them serve you a healthy life. A healthy life is a dignified life. But as the state has your data your right to privacy is breached. 2. You are right. Having the data of the citizens and not being able to protect them not only deteriorates credibility of the government but also endangers the safety of its citizens.
Yes your example is right and i am not telling that right to privacy is the pre-requisite to achieve dignity rather Right to privacy has numerous scopes where instances are infinite which will evolve with the time. And yes judiciary is there always to define Privacy. Also, Privacy must me compromised for the welfare of the society if needed to do so but this needs a tough mechanism, stringent law and technology where it must benefit our country and not frauders as we have seen earlier.
With all due respect to the Former Additional Solicitor General, Advocate Vikas Kumar's argument that the Parliament should only revisit a legislative provision is flawed to a great extent. The reason being even though it's the Parliament's duty to discuss and improve a law keeping in mind the present needs, the parliament time and again in various other contexts has failed to exercise the same option. The casual approach of the Parliament has made it necessary for the Supreme Court to step in and see whether people rights are being violated or not. The apex court has successfully played its role over a period of time. Now if we see the court's recent judgment of sex with minor wife as amounting to rape, if we see carefully the Parliament has failed to accept that and henceforth the court has to step in. Someone has to deliver justice and Supreme court is rightfully doing it. Our system is not that rigid - thus if Parliament fails to do something which is right, there is no harm if the Supreme court does the same.
Why it’s mandatory to link Aadhar with bank a/c just bec of subsidy but every individual doesn’t get subsidy Actually the concept of subsidy is not good bec they take money from us and later sum of the money is refunded Concept of subsidy should be removed and price should be fixed The govt is playing wit poor peoples money in the name of subsidy and Aadhar
the problem with aadhaar is that all the data about a single citizen is concentrated at a single place and a single authority is responsible for this huge data ,,, so the concern about its safety is legitimate ,,, why is that the aadhaar is being potrayed (as deepak correctly pointed out) as the single silver bullet for the reforms??
mass surveillance not desirable, target surveillance can be done...... Government should not intrude in the Pan card details...... Problem of confidentiality.... Address these concerns about data law......
