I tell my students; After a shooting, after the Police has secured the scene you give a VERY VERY BRIEF statement "That guy tried to kill with his (weapon). I feel sick and I want to throw up." After that use ONLY one word with two syllables "Lawyer".
That doesn't legally entitle you to anything. You need to exercise your fifth amendment right to remain silent. At that point, they must cease asking questions. Not when you say, "lawyer".
Corrupt Prosecutors are never held accountable until someone above them is in political danger. Judges have the power but never do more than threaten to hold them in contempt. They virtually NEVER actually do it and have them remanded to custody for lying to the court or violating defendents rights.
Garrity makes sense: It codifies the line between protecting the citizen and holding the public servant accountable. Both need to be true and finding that balance can get fuzzy in a hurry without a clear rule.
@@FabiolaDavidWedding Prosecution team was desperate, I think. I suspect they were counting heavily on the age factor creating an environment wherein Rittenhouse would be denied the right to a deadly force self defense. When Defense showed conflict of statute under [§29.304(3)(b)3], they knew they were in trouble and shifted to [more] theatrical tactics. Hard to know for sure, but Binger seemed Hell-bent on dancing right up to, and sometime over, ethical and procedural boundaries. For all his other perceived faults, the judge rightly put him in his place.
We are going to wait until it’s over. I will say this: no one should look to this trial as a model or example. It is so, so unique and so out of the ordinary that I worry that people are going to think this is how murder trials go in defensive shootings.
Hey John, love the content! These particular videos shot in this room are almost unwatchable though due to audio. Mike and the lawyer almost blow my speakers out, while John sounds like he’s talking to me softly from the end of a very long hallway.
I appreciate these round table discussions, but it seems like the sound quality needs a boost.. maybe my ears are failing me but John seems to fade at times.
I don't agree with this policy. What a cop says should always be able to be used against them, just as it is for a private citizen. It is right that he has to choose between his job and self-incrimination.
John, I find it very catching [in a good sense] that you gave a tip on what the next lesson is going to be about? Now, I want to wait, search, and find your next video 😁😁 Please keep on doing that. Perhaps in the middle or in the early part of the video.
Mike, you showed (justly) your "tell" around one and a half minutes in. I suppose that you aren't easy to make angry; I'd prefer to be at your shoulder or behind you when you are so.
