I’m extremely confused what he thought her obligation to him was when they didn’t have a contract nor was he paying her for it. He essentially just harassed her into giving him free promotion. I also remember seeing his first video and wondering how all those random facts he listed about timing are connected to each other at all or signify any sort of planned sabotage towards his company. Sure it may suck when a person doesn’t stay true to their word, but her word came after he bullied her into contacting him in the first place. Mikayla could’ve gone on to never review the product and act like she never received it in the first place. After all, it was a free PR package. She owed him nothing.

I agree with Ethan here. The only thing she did wrong was lie about it. BUT I think he has a good case of detrimental reliance for that $10,000 AKA she might owe him. Here is my legal analysis. In contract law, even if an agreement had not been made yet, if there was a reasonable expenditure that 'detrimentally relies' on the performance of something not yet agreed- courts may actually grant that. I think that he REASONABLY assumed she would make a video. The question would be was it reasonable to take out the loan and could mikayla reasonably foresee that to happen. Courts would only grant money to him if they deem his expenditure 'reasonable'. So, I think he has a good case but it could go either way. Lets also note that contracts need not be written. They can be enforceable verbally too BUT In order for it to be enforceable there needs to be exchange though. Here, it does not seem like there is any exchange of money and he was just expecting it for free. That is called a gift. However, detrimental reliance bypasses exchange requirement if it was REASONABLE! and there was reliance on the promise!! So, I think the case here is strong. Her defense would likely be that she flaked on him before so it was unreasonable to take the loan out. Secondly, I think she would argue that it was not reasonably foreseeable that he would take the loan out DUE to her promise. The reliance NEEDS to be foreseeable for the promisor.

Mikayla isn't the most transparent person, if you've seen anything about her you know. But this isn't her scamming anyone, and her saying "yeah sure I'll review it" isn't a legal or binding contract that forces her to do this review. He shouldn't have taken out that loan. What I do think that Mikayla should've done is to just say that she won't review it, so not saying that and "leading him own" is kinda shitty. But hey, now he has a lot of publicity so hopefully he'll be able to get the money back.
