The Philippines Could Be The Last Country To Legalize Divorce (HBO)

The Philippines is the only country in the world - besides Vatican City, the city-state of the Roman Catholic Church - where divorce is illegal.
Lawmakers are working to change that.
The Philippine Senate is back in session this week, and it’s considering a bill that would legalize divorce. The country’s House of Representatives approved the bill back in March.
But it’s far from a guarantee. Most Filipinos remain split on the issue. A special report from March found that 53 percent of Filipinos are in favor of legalizing divorce, with 32 percent against it, and 15 percent undecided.
There are two other major obstacles: President Rodrigo Duterte and the Catholic Church.
Thus far, Duterte has dodged questions about his stance on the issue, though his spokesperson said he’s against divorce. Meanwhile, the Catholic Church has been pulling out all the stops.
Congresswomen Pia Cayetano, one of the authors of the new bill, said the Church’s influence is the main reason why divorce still isn’t legal. She worries the powerful religious organization will go all out to keep it that way.
She felt the Church’s wrath in 2012, when she voted for a bill that allowed free access to contraception.
“My name was mentioned in Church as you know whatever messenger of the demon.” Cayetano recalls. “We have a very strong and influential Catholic Church and a lot of politicians, a lot of legislators tend to be concerned about what views the Church has.”
The Philippines remains a deeply Catholic country - more than 80 percent of the population identify as Catholic, and many rely on it for education and social services.

While I do believe that marriage should be a lifelong commitment, sometimes things don't always work out. Some marriages were arranged by family members for the purpose of wealth instead of love. Sometimes there is abuse in the home (not just from the husband, because a wife can also be abusive), and you have to think about your safety and the safety of any children you happened to have. Unfortunately, counseling doesn't always work, and some people never change from their old ways. You shouldn't have to spend your life suffering because your partner doesn't want to change. Marriage should be a partnership. If someone isn't doing their part you both suffer from a lifetime of unhappiness and regret.

there is legal separation law in the Philippines...Only Divorce is illegal.... The difference is, in Legal Separation, the couples can separate houses and property, but they can't remarry....In Divorce, there is total dissolution of marriage and so they can Remarry again...

The philippines doesnt practice arranged marriages and you can always leave your abusive partner.. The lesson is think really really hard before deciding to marry a person. I hope your country has a high percentage of families that are together. In the Philippines people are family oriented and both moms and dad are important. Its actually very equal here with comes to marriage. And yes abusive spous do exist but your abusive partner will still abuse you with or without divorce we dont focus on the small numbers of cases when strict marriage law does work in this country. In countries where marriage can be easily nullify. People do change partner as like how they change clothes and abusing partners still exists.

marvioxious1989 not all families need a mother or father. Many families do good without one. My mother's divorce of my father has been the best choice she's ever made. Your argument is flawed. If you can still be abused even if you are divorced then what is the point? The point is that it is a step to forever getting away from your abuser.

Spain brought Catholicism in the Philippines, leaving 86% Filipino Catholics yet Spain, now having only 68% Catholics in which the majority are non-practicing ones. p.s., Spain taught Filipinos that being “brown” is ugly. When I was a child, 12 years old, in 1981, divorce was legalized in my country, Spain . Now, nobody, including Spanish Catholic Church, think about unlegalizing divorce. If the Filipinas legalizes divorce now, nobody, including Filipino Catholic Church, will think about unlegalizing divorce by 2022 or so.

Suicide rates dont dictate happiness. So if there is a certain number of people dying each day does that mean thats how many murders take place? Wrong. You aren't taking into account the other factors.

Jazz Mina so we consider that marriages always end up in bad experiences? Lol The Philippines has occational cases of those but its not very common. Kaya ang mga pinoy against ra divorce kasi kung di mo pansin sa mga bansa na legal at easy ang divorce,nawawalan ng halaga ang kasal kasi parang ang dali naman ecancel. Pinoys are family oriented. Ang ok if mas easy ang annulment but no to divorse.

Im from Philippines, one of my classmates' mother had died when she was young. the Father wants to remarry again and and my classmate allows it because the woman is great sadly the woman cant be her new mom because of the law here, the fathers marriage is still tied to the first woman he married.

There is no legal issue in the Philippine constitution or the Catholic canon with regards remarrying after death. My dad died when we were young and everyone in the family was encouraging her to remarry because it is hard to live and work as a single mother in the Philippines. She was the one who loved my dad so much she chose not to date again.

It's the couple's fault for marrying. They made their vows and they must stand on that marriage. They should never marry at first place if the woman does not know the man well because making life decision based on emotion with lack of rationality was always dangerous. Now that the marriage was done, there's no turning back and she must keep moving forward.

In marriage vows in the Philippines, you would hear the priest say "babae magpasailalim ka sa iyong asawa" which means "woman be subordinate to your spouse" and I think that already says a lot.

In order to file a divorce to your husband or wife instead of committing adultery or making your married life worst. In the Philippines, there's no divorce unless if you're Muslim. Since most Filipinos doesn't want to convert to Islam because they love pork and alcohol then convert to Buddhism.

laws shouldn't even be based off of religious statements in the first place, imho, religious people shouldn't have a place in the government since their religious beliefs cloud their lawful judgment. in times like these, i really miss former senator, Miriam Defensor-Santiago.

Hold on...here in Philippines, divorce is illegal but they can be separated whomever he/ she . but they can't be married again...In the eyes of a church and a promise to God..he / she didnt only one who vowed, both. Nonetheless if you get a chance to have a marriage..just think wisely and expect the unexpected...

As a "Cano", western guy, I was surprised in a negative way how many women were separated/legally separated and could not get a serious new relation and future because of not able to divorce. Also the fact that an annulment was hard to do. Both parties have to agree for that (and pinoy have a silly pride not to accept the wishes of their legal wives. They prefer to fool around). Next to the crazy costs to get an annulment and the time it takes (400k plus 4 to 5 years). All determined by huge influence by the Catholic church.....all single persons who have no experiences in relationships like marriage.

Divorce should be legal. The church should not impose thier belief to people who dont share their religion thats just not right if you personally think divorce is wrong then dont participate but dont stop other people from making that choice. Only dictators do that. There is nothing wrong with falling out of love from your partner its natural and its normal. my parents are married but separated. both of them are Christians who value their believes, there was no third party or sexual and physical abuse, its just they aren't ready for the commitments that comes after marriage so things between them got messy. I'm glad they didn't divorce, because that's the only thing that connected us to our mother and father. my family and the people around us still value our Christian believes, and I'm thankful for that.

Church doesn't want divorce because they rather keep the ANNULMENT option. Why? because ANNULMENT IS WAY MORE EXPENSIVE! that's the truth, it's all about money and it's a hard pill to swallow for the so called Catholic country like the Philippines. My aunt filed an annulment case because her ex husband was cheating from day one and he spent all their money on bad habits like drugs and alcohol. They had one child and he had special needs. By the end of the annulment, most of my aunt's lifetime bank account savings was wasted on the annulment case. It took 15 years and almost 1 million pesos. That money could've been spent on their child who had special needs. He eventually died because his parents couldn't afford his medical needs anymore. You may ask me, "why did she want the annulment so desperately?" because her husband was holding her back. My aunt is an OFW. Her ex husband was making all kinds of threats against her like "he would take their son away when she's working abroad, he would sell all of their properties because it's a conjugal property." And a lot more. Bottom line, she needed to get out of the marriage LEGALLY. So really though, not having a divorce is a burden to the Filipino families. Divorce being illegal is not stopping the Filipino families from separating. It's not stopping people from cheating. It's not stopping people from making children out of wedlock. Google the statistics. 63% of the children in Manila are ILLEGITIMATE and it's more than 50% for the overall population of the Philippines. To top it all off, the Philippines is leading the teenage pregnancy in Asia. AGE OF CONSENT in the Philippines is only 12 YEARS OLD. Let me say it again, TWELVE YEARS OLD. I am a catholic but i do not follow everything what the priests preach. One they should never intervene in marital affairs, they are not married and pls do not say they are because of holy order. My parents always tell that when it comes to marriage, think about the family, not "yourself". We separated with my father for nearly 3 years. My mother and my siblings went to my grandmother's house due to the cool off. Years later, we finally decided to live together and became a happy family. God has plans for you, you just need to do the right actions. Wag mo Lang pangunahan.

If it can have negative impacts on your children’s mental health then staying is not an option anymore. At this point it shouldn’t be about keeping the “family together” anymore if you can still call it that since it’s already been broken from the start. Not every story is the same as yours so i think you shouldn’t really have a say in it and just let everyone have the free will to decide what’s best for them.

I'm a married Filipino but I do believe that Divorce should be legalized. The greatest wall in here is the Catholic Church which makes business out of naive people. I agree on divorce BUT only with specific grounds like domestic violence, adultery and child abuse. The one who committed the said acts should also compensate the other half financially so as to prevent married couple from filing divorce just because of petty reasons esp. when they have kids.

Since most Filipinos doesn't want to convert to Islam because they love pork and alcohol then convert to Buddhism.

It's amazing that the fact that I grew up still in a country, where I didn't even knew until now that divorce was illegal because of the Catholic church, I never or didn't knew that it was illegal. It would be nice and definitely better for the benefit of the people if divorce was legalized, imagine some crime and social issues slowly falling down but surely. The catholic church acknowledges that some marriages are bad, and allows marriages to be annulled (divorce is with the gov, annulment is the divorce of the church basically) if the marriage is unhealthy, if a partner cheats, or if they are forced into the marriage

Many politicians are against divorce because many of these crocs have lots of mistresses. Divorce granted will have a financial cost for these greedy creatures.

I believe the lawyer lobby is behind this. Annulment is already a huge industry here and out of reach of many ordinary Filipinos. Divorce will just take the same route.

I'm a young Filipino who comes from a Catholic family and I am starting to believe the (Catholic) religious authorities here just disagree with the government just for the sake of doing or saying something. Blocking the rights of men and women to get out of a marriage that turned into an unexpected mess makes a lifelong prison. The priests would only say it's the responsibility of the future wives and husbands to choose their future spouses very carefully but they truly do not understand the picture. Shame.

In Philippines people are being discriminated for not having a complete family even if the reason is right. Both sides has points but I'm unti divorce....people should think deeply before getting to marriage......people are also discriminated if they has a child before marriage or having one but not married. But for today I think people are getting open minded.

With any change in culture, someone has to come first, and someone has to come last. It's been about a year since Malta legalised divorce, I expect divorce to take a year or two, hopefully it doesn't take 10 years.

If Divorce many will not take Marriage seriously. It would be like a pre marital relationship that people can come and go anytime you want. It's not the solution. Those who support divorce like what Pia says " Messenger of the Demon", what else do you call it? Whether in an abusive relationship or not, Divorce must not be allowed, because God says so! The couple can be separated, but they cannot remarry as long one of them is still alive. The problem is that they want Divorce, because couples want to be remarried.

@@anonymoususer8056 there are many single kids right now regardless if there's divorce or not, the benefit of devorce is so you can start a new life that's not to say you forget your old one of course not, if you have kids divorce dosent neccessarily rob you of your obligation to the kid this is a misdirection which has nothing to do with divorce whatsoever, annulment does the same thing by the way which makles you a hypocrite for siting "divorce makes more single parents" but annulment does it too so why bring that up? your last question " Why would you marry in the first place if you would just have a divorce someday" you dont go out marrying someone with that midnset at all again another distracting question. times change sometimes you fall out of love sometimes the person change so much that you dont love him anymore so what? thats normal, instead of forcing people to be sad together you should just be happy appart. not to mention married couple without any kids why are you not mentioning them? you're looking at it with a black and white lense when there's many many situations where divorce is the only logical moral and economical option

I am Catholic but I definitely believe in divorce. All the counties except the Philippines has divorce. Even the country who spread Christianity in the Philippines has divorce. There are some aspects that people do not fully understand. With the divorce are laws where properties are distributed equally between spouses. Laws giving Alimony to the spouse so he or she doesn’t get hungry if he or she is not self sufficient at the time of the divorce and laws requring child support to guarantee children are taken care of. When physical and verbal abuse is present in a relationship and all recourse has been explored to na avail. Divorce is justified. The separation of the church and the state should be respected by the church and should not meddle with its creation and implementation of state laws.

The laws on concubinage and adultery in the Philippines are written by men and is so out dated. The only way a man can be found guilty of adultery is if he buy or rents a property for the mistress. Catholic church in the Philippines represent the family as like the church. Most Filipinos are devoted Catholics and the reason why this kind of laws are difficult to pass. Secondly, Filipinos are very family oriented. Sadly, living together out of wedlock, or separating with the legal wife and having a common law wife is not uncommon. If you are not a married to your partner, by law in the Philippines you have little power on him and his estate. Even your children will have less than what the legal children have. I have seen someone died and his common law wife had no legal power on his medical decissions and his remains. This is even if the man was separated with his legal wife for almost 10 years.

It is not about religion but the very sanctity of marriage solemnized either by the church or state is highly regarded in the Philippine constitution. To legalize divorce would mean charter change will have to be in effect, which of course could still take a very long while.

If divorce is to be allowed, then there should be a provision that if are kids involved, their welfare needs to be taken care of STRICTLY. The unintended outcome of this law is groups of single parent with kid/s that has little or no support from their divorcees. That is also not good
