can you drink whilst living in a van? or even weekend campervan adventurers staying off grid?
this is my experiance of what happened when the police turned up to myself and 5 other van conversions in the lake district while we were drinking!
asks the question can you drink whilst off grid in a campervan? i sure am not drinking any more! will you?

Exact same happened to my mate about 25 years ago. Him and a few friends went camping in the Lakes (I can't recall the location) the weather turned, so they decided to turn back to find the car snowed in!! Fortunately their was a pub 1.5 miles away from their location, so they hiked there had a few scoops and tried to get a room, to which the establishment couldnt help them with. They stayed in the pub till closing then hiked back to the car about 12am. All 4 fell asleep by 1am. By 2.30am a snow plough had been and cleared the road. Followed by a police car. They knocked on the window to check on the guys, who told them the story, they continued to explain to the officers the situation, but the tits still decided to give him a ticket, despite them voicing their intentions of staying stationary untill he was sober. Even the fine is just bloody robbery.

Yes this dude is clearly telling porkies. You have to do two blows on the proper breathalyser at the cop shop to be found over the limit. Or maybe a blood test instead.

EVERYTIME......No question, you are NEVER issued with a ticket and allowed to remain in charge of a vehicle, you are at the point of a positive breath test arrested and detained. You are ALWAYS taken to a police station where you are asked to undertake a second test on a calibrated machine for comparison to the initial test, failure to comply immediately ends up in a ban. He's a bullshitter, and this time his lies have caught him out.

It's mad how I literally found out the "drunk in charge" law the other day. Then you post this... It's quite sad how common sense doesn't prevail. You are still in charge of a motor vehicle if you are drunk in a house!!?? You can just pick up the keys and go... most ridiculous law I've ever heard of.

Yh honestly ur right.... Even if you put the keys into the drunk of your car it still counts if u have access to them. I think it even counts if you give them to say a bartender... So where do you draw the line? You still have access to your keys while at home.

I wouldn’t drink unless I’m on a campsite or a legit park up that is really safe. If I want to move due to not feeling safe I don’t want to be over the limit. Sounds like the copper might have been okay if the guy hadn’t riled him. What a numpty.

Reminds me of a time me and a few mates drove to Blackpool for a night out. One of my mates wasnt drinking so drove. He ended up wanting a beer so we said we'd sleep in the car and drive next morning. Police turned up and we explained, they were alright and left us to it. A couple of hours later they came back, probably to check we were true to our word. We stayed till morning and drove home. I respect the police but sometimes things like this turns people against them.

I would of recorded this incident and showed the courts, and then made a civil claim against the police, obviously I don’t know all the details of what happened. But that all sounds rubbish to me.

The passengers only got breathalysed so that they couldn't drive the van. I don't think they actually got fined ? Just who ever owned the van got the fine. The exact thing happened to me in Devon

The person who didn’t get done had a person who was deemed to be in charge of the van. If she hasd been over the limit they’d probably just have done one of them.

@@exploresandtosummit the officer let the one with a passenger that WASN’T drunk off. He said if you was going to drive off you have a way of doing so as she is legal having insurance etc too. But yes this law prevents you from sleeping in your car if drunk too… At the age of 18 going clubbing on low income i often went back to my car to sleep in it until 10am. Walk to town get breakfast then drive home when i felt A ok. Not knowing this was a crime… I now know doing this is basically just aa bad as drunk driving 😂😂😂😂 MAKE IT MAKE SENSE

The whole story is made up to get clicks. None of the story would happen. Police don't find you over the limit and firstly leave you still with the vehicle and secondly not arrest you and that's just the start! And let's not get started how the Judge dealt with it 🤣🤣🤣🤣

Your lying you cannot be charged with a road side alcohol testing device as it’s only a guide. You have to be tested on an evidential device in a police station that is calibrated.

Drunk in charge of a vehicle is a completely different offence from drunk driving. If you are the only person in the vehicle with the means to drive it you have committed an offence.

Yes, different countries have different rules about this. In Australia (unless it's changed lately) my understanding is that the rule has been the keys have to be in the ignition.

While watching this I was googling for a breathalyzer lock box for keys, but there seems to be a hole in the market. only other thing I can think of would be to see if you could get a blow-to-start device fitted as a safeguard.

If you do get done for drink driving then make sure you discuss it with your insurance company. They might push the premiums up, but if you don't you might lose your insurance cover.

The way the law addresses this is bonkers to say the least. Obviously, if you're on a campsite you're probably going to stay the night yet you're still in charge of a vehicle the only difference being what you call the land - ridiculous. What if you're in a pub and have a car nearby? Surely everyone over the limit near the vehicle with keys should have the same logic applied - nonsense. In fact, to me, in this circumstance there is a bit of victimisation at play. For the record, I'll only have one beer but I'm not preaching - now we all have phones you never know when someone will call looking help. Having had some dealings with he police, I would always record what is happening, ask for clarification of the law/act that the officer is concerned about, get clarification about what the suspicion is and what the officer considers to be reasonable grounds for speaking to me, object where necessary and then I would say nothing else at all. If you are in a motorized vehicle and are in possession of the keys annoying the police have the right to ask you to take a breathalyzer test. So no you can't drink when in a camper . Unless

You have to give details if you are driving, believe to have been driving, involved in a crime etc then you have to give details. Say for example they believe you to be driving a corsa at night speeding down this road they can ask for it.... Laws are there to protect the police not us.

That isn’t the same thing. However ridiculous you think the law is or the police activity is, if you are in you vehicle drunk, you are drunk in charge. If you are in a house there is no reason to suspect that you might drive. People in vans need to familiarise themselves with the law because it can have a severe penalty. I suspect in this case that the police have had a complaint and sent someone along. Once he has encountered antagonism they have gone to town. They probably wanted to discourage gatherings.

@@michelleoconnor4085 yh we get the law. You can’t deny MANY laws are ridiculous. Such as motorhomes doing 70mph on duel carriageways yet a work van is limited to 60mph. Another rule that makes no sense. People wont respect rules that are unfair and make no sense. Things simply need evaluating on a regular basis i don’t know why this isn’t done

That is insane, I was given a tip if you are going to drink make sure you get your bed ready and put your pjs on the bed and tooth brush etc so if the police start about drinking you can say you are not driving and all your bed is ready to go, apparently the court will throw the fines out because you do not need to go into the cab and you have proved you have everything ready to sleep so only going in the back and not into the drivers seat.Glad they didn't ticket you too.👍

They needed better briefs.. I'd imagine they got the fine because of the plans stated at the time, and the amount over the limit they was in the early hours. Thus presumed they would have still been over the limit when leaving in the morning. Its a grey area, and kind of BS, but a good brief would have probably been more expensive than the fine

They have to show intent to drive..if the key is locked away or not on your person , you are in your pj's and the windows are all covered over you would never get prosecuted in a court.No one gets a ticket for drink driving you have to have a second test at the station..Great story 🤥

Very surprised by this, because on any other day, would the same situation happen? Or was that just bad luck due to the time! I'll tell you what's bugged me for years and still does, you have alot of these remote pub restaurants with cars parks and the amount of people iv seen go in and wonder how much do they drink before they know when to go home? Of course if a partner doesn't drink would be the driver then thats fine, but how often do you see police just randomly check up these locations! I think if the other party kept there cool you all may of got away with it and continued your night in peace

I think all of that could’ve been avoided if that one guy had simply kept his mouth shut. Guys, especially drunk guys always seem to need to have a contest about who has the biggest penis by trying to be the most alpha. The officer could’ve done the same thing with the threat of a ticket rather than actually worrying everyone tickets. I can’t believe they ticket people that live in their vans. If you’re not driving or causing a ruckus, it shouldn’t be an issue. Cops really need to take these things into consideration. I’m glad I don’t drink though. Who needs all of that? Insurance is expensive enough!! That whole situation was ridiculous! Sorry it even happened.

Im sure if you chock the wheels as in it cant move then that would mean assensually its dissabled the law would struggle to get a conviction , becouse as the law is written being in charge of a motor vehicle etc then any and all car owners whether drinking in a pub or in there own house are guilty if they drink becouse who else is in charge of that veichle no matter where it is

Very strange: could only be pressure applied to punish your 'friend's' attitude, and make the whole party think twice about playing-up. From what you describe, you were all parked on forestry land and, therefore, not the public highway (PH). None of you were seen driving to or from there; so, to the Police's knowledge, any drinking happened off the PH, no DUI was or could have been observed. Whilst they may well have breathalised at the scene to teach you a lesson, no court case would have been brought, let-alone tried and convicted. The CPS only pursue dead-certain cases, any barrister would have destroyed their challenge. No-one was caught or observed driving to or from the venue, and the venue itself is part of the PH. The only charges that could have been brought would have been for AntiSocial Behaviour (your Pass-Agg friend alone), or Public Order offences like the old Breach-of-the-Peace, not designed for the case you describe...

There was the problem, from someone who had police in the family at times. If it had stayed nice like your interaction he would have likely said no worries behave don't leave a mess etc. The egit who mouthed off threw everyone under the bus. The moral of the story do what you where going to do Rich. It irritates me that people mouth off and it gets themselves in these scenarios when they are only doing their job and it can be avoided. Glad it all worked out but yer lessons to be learnt

No way would I be paying that fine, fine for absolutely nothing, in yep I would get smashed dingoed parked up for the night in camper van. Same as if you at home getting smashed and your cars out side. Your still in charge of a moto 😂 stupid law. In if that campers your full time home you park up go to bar and go to your home/camper. The road traffic clearly states the need for an evidential breath sample at a police station and the police would need to prove an intention to drive! Total jackanory and click bait. As sad as it seems, you’re better off not engaging with the Police. The only reason they ask you questions is to potentially incriminate yourself… The lad who was there with you didn’t do you any favours, with his Bolshe response, but hey-ho, you live and learn…
